Maintenance of Public Order Ordinance 1960: LHC asks federal Law Ministry to review detention provisions
LAHORE: The Lahore High Court on Thursday asked the federal law ministry to review the preventive detention provisions of Maintenance of Public Order Ordinance 1960. A full bench headed by Chief Justice Aalia Neelum heard the petitions of PTI former MPA Zainab Umair and others challenging detention orders of the party/workers. Earlier, the petitioner's counsel argued that several provisions of the law were in conflict with the Constitution and that hundreds of people had been detained under its cover. He said the law had been misused politically and arbitrarily by the government. He pointed out that before detaining a citizen, the government must satisfy itself with justifiable grounds. However, he alleged that dozens or even hundreds of people had been detained under a single order. The chief justice remarked, 'The courts are awake, not asleep, that's why the system functions.' The chief justice observed, 'Everyone wants peace but if peace is disturbed, who will be held responsible? What happens if a protest is not peaceful?' The Chief Justice also remarked that laws are framed on the foundation of the Constitution. The bench, while concluding the proceedings, decided to forward two of the petitions to the law ministry and disposed of two others as being withdrawn. Last year, a report submitted by the Punjab chief secretary in the court revealed that the provincial government had delegated its powers under section 26 of the MPO Ordinance 1960 to the DCs to issue detention orders subject to reasonable restriction. "Assam Pushed Back Over 330 Illegal Infiltrators": Himanta Sarma
Guwahati (Assam): Assam Chief Minister Himanta Biswa Sarma has said that the state government was responsible for "pushing back" over 330 illegal Bangladeshi infiltrators in the last few months and intends to speed up the process. Referring to the Immigrants (Expulsion from Assam) Act of 1950, Mr Sarma said that the attempt to filter out the illegal infiltrators would continue with the help of a special provision (of the Immigrants Act of 1950) that empowers district commissioners to identify and expel them. "In our vigorous fight against illegal infiltration, we draw strength from a special provision, which empowers DCs to identify and expel infiltrators from Assam. We have pushed back over 330 illegal infiltrators in the last few months, and this operation will be expedited in the coming days," Mr Sarma said while addressing a one-day special session of the Assam Assembly. In a veiled attack against Assam Congress chief Gaurav Gogoi, CM Sarma said that the state government has identified 2,600 accounts on social media that write about "Palestine and Assam", operating from Islamabad and Riyadh, and welcome a particular leader from the state. He said that he would reveal information regarding such accounts to the press in the coming days. "We have found around 2,600 Facebook accounts that write only about Palestine and Assam. They are operated from Islamabad, Riyadh and Saudi Arabia. They don't even welcome Rahul Gandhi, but welcome a particular leader of Assam. I have documents, and within 10-12 days, I will provide some such account information to the press," he said. Moreover, Mr Sarma asserted that his identity as an Assamese comes before his post as the Chief Minister. "I am an Assamese first and Chief Minister later, and all my actions will reflect that. In our journey of safeguarding the interests of Assam, we do not dither in taking inspiration from former CMs," he said. The Immigrants (Expulsion from Assam) Act of 1950 empowers the government to expel illegal immigrants from Assam, specifying procedures to identify and expel them. The act gives the power to order the expulsion of immigrants whose stay in Assam is "detrimental to the interests of the general public."

Haryana forms committees to intensify efforts to curb female foeticide
Chandigarh, A senior Haryana government official on Wednesday chaired a meeting with all the deputy commissioners to intensify efforts to curb female foeticide and strengthen measures under the flagship 'Beti Bachao-Beti Padhao' campaign. At the meeting, Additional Chief Secretary , Sudhir Rajpal, issued a series of directions to the deputy commissioners to deal with the problem of female foeticide by treating it as a priority. As part of the strategy, district-level standing committees headed by the DCs with chief medical officers as member secretaries are being formed to ensure tighter monitoring and coordination to improve the state's sex ratio. These committees will conduct weekly meetings, gather reports on the sale of medical termination of pregnancy kits, inspect the ultrasound centres and design strategies to curb sex determination and female foeticide, an official statement said. "The issue of illegal abortions is a deep-rooted societal challenge that demands a whole-of-government approach, along with active participation from all sections of society," the statement quoted Rajpal as saying. He also directed the DCs to ensure that there is no illegal sale of MTP kits in their districts, adding that regular inspections and strict action against the offenders were required to deal with the problem. Any doctor found engaging in sex-selective practices will face stringent disciplinary action, including cancellation of their licence by the Haryana Medical Council, Rajpal said. All abortions beyond 12 weeks must be thoroughly investigated, particularly in cases where the couple already has one or more daughters, the statement said. Civil surgeons have been instructed to lead these investigations and maintain a close watch. Any suspicious MTP case shall be tracked and action shall be taken according to law, Rajpal said. The health department has also been directed to ensure ANC registration of every pregnancy before 10 weeks. To provide personalised support, all pregnant women with one or more female children are being assigned an ASHA or Anganwadi worker as a 'saheli' to counsel them and monitor their pregnancies, the statement said. In the event of an abortion, appropriate action will be taken against the concerned ASHA or Anganwadi worker, it said. The district administrations have also been directed to expand information, education and communication campaigns, and involve religious and community leaders in amplifying the messages of gender equality and the value of a girl child.

HC pulls up govt over missing biomedical waste mgmt report
Ranchi: The Jharkhand high court on Thursday pulled up the govt for being unable to produce the status reports on biomedical waste management that it had sought from the deputy commissioners (DCs) of all districts in February.A division bench of Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar was hearing a public interest division (PIL) filed by the Jharkhand Human Rights Confederation on the improper disposal of biomedical court on Thursday expressed annoyance as the DCs have not taken heed of its February order. It told the DCs to furnish the required report by June 16, when the case would next be 2024, the Jharkhand State Pollution Control Board had informed the court that biomedical waste treatment plants have been set up in five districts – Lohardaga, Ramgarh, Pakur, Dhanbad, and Adityapur in Seraikela Kharsawan. Another biomedical waste disposal plant is under construction in Deoghar and would be commissioned very soon, the board petitioner organisation had filed the petition in 2012 for compliance of the Environmental Protection Act , under which Biomedical Waste Disposal Management Rules have been formulated and ought to be implemented. In absence of the rules, biomedical waste generated from hospitals, clinics, nursing homes are required to be disposed of in a manner, which does not adversely affect the environment. But biomedical waste was littered in the open and rummaged by stray dogs, the petitioner added.
