Garage forecourt ‘drive-offs' without paying for fuel a daily occurrence, court hears

Fuel 'drive-offs', where motorists leave forecourts without paying, happen at a Dublin filling station every day, a judge has been told in a case in which a van courier successfully sued Circle K for defamation of character, winning €10,000 in damages. Judge Mary O'Malley Costello heard some drivers return to pay their bill when they realise they have made an error, some are never seen again, while others return to pay only when the guards are notified and visit or contact them. Barrister Kevin D'Arcy, counsel for courier Paul Brooks, of Palmerstown Lawns, Palmerstown, Dublin 20, said his client only realised he did not have his wallet with him after he had poured €20 of diesel into his van. Mr D'Arcy, who appeared in the Circuit Civil Court with Mackay Solicitors, said his client had not driven off but had gone into Circle K filling station beside Glasnevin Cemetery on the Finglas Road, Dublin, in May 2020 and told the sales assistant of his dilemma. READ MORE He told her he had forgotten his wallet and would ring his mother so she could pay for the diesel by giving her card details over the phone. Mr Brooks was told Circle K was not set up to take an over-the-phone payment. He told the court he had made an arrangement with the sales lady whereby his mother would call to the filling station the following day and pay for the fuel, which she had done. While he was confident he had such an understanding with Circle K, the sales lady had told the court that Mr Brooks had been told the debt had to be paid that day. Mr Brooks said that a month later he had been embarrassed to hear in a phone call from his sister that gardaí had called to his home inquiring about him and telling his sister and his mother of a fuel drive-off by him. He said his neighbours had seen the gardaí pulling up at his home and making inquiries. Mr Brooks sued Circle K of Circle K House, Beech Hill, Clonskeagh Dublin 4, for defamation of character. His mother had called and paid for the fuel the day after the incident. Judge O'Malley Costello said she found Mr Brooks and his mother and sister, and the Circle K sales lady, to have been honest witnesses. She said it was clearly accepted in its defence by Circle K that the fuel had been paid for on the following day. Somehow the gardaí had not acted on a report until July 9th and had attended at Mr Brooks's home, causing him the difficulties he had complained of in his defamation proceedings. She awarded him €10,000 damages and Circuit Court costs against Circle K. A member of Circle K staff had told Judge O'Malley Costello that drive-offs were an everyday occurrence at the filling station.

Steven Mooney is making plans after winning the top prize of $100,000 with an instant lottery ticket his wife picked up at the Circle K on Essa Road in Barrie. The Barrie man says he's been playing the lottery for nearly 40 years and admitted this was his first big win. He says his wife only grabbed the Instant Crossword Tripler ticket to even the bill after buying some milk for her coffee. Mooney played a couple of instant lottery tickets before revealing his big win. "I scanned it using the OLG app on my phone and was completely shocked." The couple shared the news with their kids, who were in disbelief. "At first, they thought we were joking. They had to come home and see the ticket for themselves. When they confirmed it was real, they were just as thrilled as we were," Mooney shared. The couple has plans to travel with their winnings. 'It feels unreal. You don't think it'll happen to you until it does, and it doesn't register in your mind right away. This win was a very pleasant surprise.' Instant Crossword Tripler costs $5 per play with a top prize of $100,000.

Jun. 16—Police released the name of a man who allegedly robbed a convenience store, fled from police and was shot by officers in a vacant lot in Northwest Albuquerque on Sunday. Gabriel Moralez, 23, of Albuquerque, is charged with armed robbery, aggravated assault, false imprisonment and resisting, evading or obstructing an officer. Moralez is being booked into the Metropolitan Detention Center, Albuquerque Police Department spokesperson Gilbert Gallegos said in a news release at 5:50 p.m. Monday. At about 3:10 p.m. Sunday, APD received an alert from a cash tracker — a GPS tracking device that allows police to track stolen money — inside the Circle K convenience store in the 300 block of Coors NW, near Bluewater, according to a criminal complaint filed in Metropolitan Court. Two minutes earlier, a store employee called dispatch and told them he had been robbed at gunpoint, police said. The employee told police a man — later identified as Moralez — walked up to the door and yelled, "Mask, mask mask," the complaint states. The employee told police after they told Moralez he could not wear a mask inside, he pointed a gun at them and said they had to give him money from the register or he would shoot them, police said. The employee told police Moralez left with $140 in cash, eight packs of cigarettes and the cash tracker, according to the complaint. The tracker traced Moralez to the 200 block of 63rd Street, near Central, where detectives conducted covert surveillance, police said. Minutes later, they saw Moralez walk in the area of 60th and Avalon SW where they contacted him and he ran, the complaint states. Moralez then jumped over a fence carrying a black backpack and ran through a vacant property on Westcourt Place then "produced a handgun and officers shot a rifle" and less lethal rounds at Moralez, Gallegos said. After being shot, he ran again before being arrested and taken to a local hospital, Gallegos said. In March, Moralez pleaded not guilty to criminal trespassing after hanging out in an alley outside a Southeast Albuquerque apartment, according to court records. He was ordered to enter a pre-adjudication diversion program, court records state.

'I couldn't process it until I got to the Canton office to make a claim,' she told lottery officials. Tickets for the Cleveland air show are on sale now After mandatory state and federal taxes, she will take home about $108,000. The woman told lottery officials she plans on using her winnings to help buy a new house. As of Thursday, the $5 scratch off game still has five top prizes worth $150,000, according to Ohio Lottery.
