Parliament to get to work on amending Constitution following high court order barring John Hlophe from serving on JSC

CAPE TOWN - Following last week's high court ruling that a judge impeached for gross misconduct can't serve on the Judicial Service Commission, Parliament is set to get to work on amending the Constitution during this administration. Besides a submission made to the Constitutional Review Committee by the Council for the Advancement of the South African Constitution (CASAC), the DA says a bill to this effect is already in the pipeline. ALSO READ: The party's justice spokesperson, Glynnis Breytenbach, said it's important to tighten the law to prevent impeached individuals from making a return in other spheres of government. The National Assembly speaker is yet to announce the next steps in filling the vacancy on the judicial service commission. The seat belongs to the MK party, which plans to appeal a ruling preventing its parliamentary leader, John Hlophe from serving on the body. CASAC wants Parliament's Constitutional Review Committee to consider amending sections 177 and 194 to specify that any person removed from judicial office or a Chapter 9 institution may not hold any other public office. Breytenbach, co-chair of the committee, said a Private Member's Bill has already been prepared and is with Parliament's legal drafters. "I think it's very important that Parliament is populated with MPs who are ethical, honest, reliable and have integrity, so the sooner we can prevent bad eggs like John Hlophe and Busisiwe Mkhwebane coming to Parliament, the better." The Western Cape High Court said in a judgment last week that the National Assembly had not acted rationally nor constitutionally when it rubberstamped the MK Party's nomination for the JSC.

CAPE TOWN - The National Anti-Corruption Advisory Council (NACAC) is suggesting the Special Investigating Unit (SIU) be merged into a new, independent body it proposes be called the Office of Public Integrity. Like many other African countries, which have anti-corruption commissions, the council established by the president thinks South Africa should do the same. On Wednesday, NACAC briefed Parliament's justice committee on changes being mooted to the country's anti-corruption architecture, and how this differs from a private member's bill introduced by the Democratic Alliance, Glynis Breytenbach, for the establishment of a Chapter 9 anti-corruption body. The second phase of its work, before wrapping up its three-year term in August, NACAC said it doesn't believe a single body is capable of fighting corruption. The council's David Lewis said it's weighing up whether setting up a constitutional body under chapter 9 would delay the establishment of an agency that can deal with systemic corruption in the country. "Can this SIU be strengthened in such a way as to enable it to carry out already a large number of the functions that we're recommending should be undertaken by this body, so as to short-circuit the way of establishing the institution."

SA hosts Commonwealth Anti-Corruption Conference

CAPE TOWN - Combating corruption in Africa will feature prominently in Cape Town on Monday, where Commonwealth countries will gather to discuss best practices. As the South African host, the Special Investigating Unit (SIU) will lead the 15th Commonwealth Regional Conference for Heads of Anti-Corruption Agencies in Africa. The unit has been at the forefront of unearthing corrupt practices in state institutions in the aftermath of state capture and during the COVID-19 pandemic. Anti-corruption bodies from 21 countries make up the Association of Anti-Corruption Authorities in Commonwealth Africa. They will be meeting under the theme, "Enhancing Inclusive Participation of State and Non-State Actors to Prevent and Combat Corruption." South Africa is estimated to lose billions of rands each year as a result of corruption in procurement in state departments, and the COVID-19 pandemic made this even more apparent, as civil servants also tried to fraudulently claim relief benefits. READ: SIU launching corruption & maladministration probe into govt depts, SOEs The Democratic Alliance (DA) has tabled a bill in Parliament seeking to establish a new anti-corruption body - an independent Chapter 9 institution to investigate and prosecute high-level corruption and organised crime. But the proposal is yet to garner the necessary political backing. Some of the countries that have similar anti-corruption commissions - including Namibia, Eswatini, Malawi, Mauritius and Kenya - will be present at this week's regional conference of anti-corruption bodies. Justice Minister Mmamoloko Kubayi will deliver the opening address.
