Trump can continue control of California's National Guard, appeals court rules

A federal appeals court is allowing President Donald Trump to continue having control of thousands of members of California's National Guard. The 9th US Circuit Court of Appeals granted a request from Trump to lift, for now, a lower-court ruling that had required the president to relinquish control of roughly 4,000 guardsman from the Golden State that he had federalized to beef up security in Los Angeles amid unrest over immigration enforcement. The court said in an unsigned ruling 'that it is likely that the President lawfully exercised his statutory authority' under the federal law he invoked to federalize the guardsmen earlier this month, rejecting arguments pushed by California Democratic Gov. Gavin Newsom that Trump had violated federal law when he seized control of part of his state's militia. Last week, US District Judge Charles Breyer directed the president to relinquish control of the guardsmen after concluding that Trump had violated several provisions of the law he leaned on in order to take control of the troops, including one that requires presidents to issue an order 'through the governor' when they want to federalize state troops. The appeals court briefly put Breyer's ruling on hold shortly after it was issued, and Thursday's ruling from the 9th Circuit extends that pause while the legal challenge plays out. California has the option of asking the Supreme Court to step in on an emergency basis. This is a developing story and will be updated.

Newsom, the Democratic governor of California, is among the top names being rumored for a 2028 presidential run. Over the last week, he has been locked in a protracted war of words, which has also manifested itself in a court battle, over President Donald Trump's response to the riots in Los Angeles. Newsom has called Trump's use of the National Guard and Marines to respond to the rioting both "immoral" and "illegal." A longtime progressive, Newsom has recently moved to present himself as more centrist, starting a podcast titled "This is Gavin Newsom" that hosted the likes of conservative commentator Charlie Kirk. According to Catholic Vote's report, however, Newsom is "one of America's most radical, destructive politicians" who "remains the same ideologue who has trampled parental rights, championed the transgender mutilation of children, and taken pro-abortion advocacy to a sickening extreme." The report says that despite professing to be a Catholic, Newsom has not only advocated for a right to abortion but even used biblical scripture to advertise and promote abortion. The report points to how, as governor, Newsom commissioned billboards in Oklahoma that advertised "Need an abortion? California is here to help," with a quote from the Bible saying, "Love your neighbor as yourself. There is no greater commandment than these." It says that in 2023, Newsom again "doubled down on this strategy of imposing radical ideology and calling it 'freedom.' When he instituted new penalties on public school districts that fail to promote homosexuality and transgenderism to children, he framed this as a matter of 'families' having 'the freedom to decide what's right for them.'" According to the report, Newsom's office released a statement in 2023 after he signed a slate of "Supporting LGBTQ+ Californians" policies that declared "hate-filled attacks" of "far-right extremists" would "not be tolerated." Trump can keep National Guard deployed to LA for now, appeals court rules

A US appeals court has temporarily blocked a federal judge's order that directed President Donald Trump to return control of National Guard troops to California after he deployed them there following protests in Los Angeles over immigration raids. The 9th US Circuit Court of Appeals said it would hold a hearing on the matter on June 17. The ruling came just hours after a federal judge's order was to take effect at noon on Friday, local time. Earlier on Thursday, US District Judge Charles Breyer ruled the Guard deployment was illegal, violating the Tenth Amendment and exceeding Trump's statutory authority. The order applied only to the National Guard troops and not Marines who were also deployed to the LA protests. The judge said he would not rule on the Marines because they were not out on the streets yet. California Governor Gavin Newsom, who had asked the judge for an emergency stop to troops helping carry out immigration raids, had praised the earlier ruling. "Today was really about a test of democracy, and today we passed the test," he said in a news conference before the appeals court decision. The White House had called Breyer's order "unprecedented" and said it "puts our brave federal officials in danger". "The district court has no authority to usurp the President's authority as Commander in Chief," White House spokesperson Anna Kelly said in a statement. "The President exercised his lawful authority to [mobilise] the National Guard to protect federal buildings and personnel in Gavin Newsom's lawless Los Angeles. "The Trump Administration will immediately appeal this abuse of power and looks forward to ultimate victory on the issue." Mr Newsom's case was solely focused on the National Guard, and the judge said when the state attorney asked about whether this could apply to the Marines that he would not rule on that because they were not on the streets yet. About 700 Marines have been undergoing civil disturbance training at Naval Weapons Station Seal Beach in Orange County, California. "I have been told by the office of the governor that within the next 24 hours, 140 Marines will replace and relieve National Guard members in Los Angeles," attorney for the state Nicholas Green told the court. Typically the authority to call up the National Guard lies with governors, but there are limited circumstances under which the president can deploy those troops. Mr Trump federalised members of the California National Guard under an authority known as Title 10. Title 10 allows the president to call the National Guard into federal service under certain limited circumstances, such as when the country "is invaded," when "there is a rebellion or danger of a rebellion against the authority of the Government," or when the president is unable "to execute the laws of the United States". Judge Breyer said in his ruling that what is happening in Los Angeles does not meet the definition of a rebellion. "The protests in Los Angeles fall far short of 'rebellion,'" he wrote. It was not immediately clear how that would change the situation on the ground. Mr Newsom sued to block the Guard's deployment against his wishes. California later filed an emergency motion asking the judge to block the Guard from assisting with immigration raids. The governor argued the troops were originally deployed to guard federal buildings and called for the court to block the troops from helping protect immigration agents during the raids, saying involving the Guard would only escalate tensions and promote civil unrest. Major General Scott Sherman, commander of Task Force 51 which is overseeing the Guard troops and Marines sent to Los Angeles, said as of Wednesday about 500 Guard troops had been trained to accompany agents on immigration operations. Photos of Guard soldiers providing security for the agents have already been circulated by immigration officials. None of the Marines have been trained to go on immigration raids, and it is not yet clear if they eventually will, Major General Sherman said. In his broad ruling, the judge determined Mr Trump had not properly called the Guard up in the first place. The lawsuit argued that Title 10 also requires the president to go through governors when issuing orders to the National Guard. Brett Shumate, a lawyer for the federal government, said Mr Trump complied with the statute by informing the general in charge of the troops of his decision and would have the authority to call in the Guard even if he had not. In a brief filed ahead of the Thursday hearing, the Department of Justice said Mr Trump's orders were not subject to judicial review. "Courts did not interfere when President Eisenhower deployed the military to protect school desegregation," the department said. "Courts did not interfere when President Nixon deployed the military to deliver the mail in the midst of a postal strike. "And courts should not interfere here either." Judge Breyer, who at one point waved a copy of the constitution, said he disagreed. "We're talking about the president exercising his authority, and the president is of course limited in that authority," he said. "That's the difference between a constitutional government and King George." AP

President Donald Trump on Thursday stuck it to both Elon Musk and California Gov. Gavin Newsom with the stroke of a pen. Trump signed a resolution that blocked California's rule that banned the sale of new gas-powered cars by 2035 - something supported by Newsom that could have been a boon for Musk's Tesla. The president's signing ceremony included a long-winded speech with some of Trump's greatest hits - voicing his hatred for windmills, sharks and battery powered boats. He also brought up, unprompted, his fallout with Musk, which happened just one week ago. Trump claimed that on his first day in office he ended the 'Green New Scam' and abolished the electric vehicle mandate at the federal level. 'Now we know why Elon doesn't like me so much,' Trump said. 'Which he does actually, he does.' The president said he found it 'very interesting' that the billionaire Tesla head supported him during the 2024 race, knowing that he planned to do away with the Biden-era EV mandates. 'And Elon still endorsed me. And honestly, he never spoke to me about that. And I used to say I'm amazed that he's endorsing me because it can't be good for him,' Trump said. 'He said, "well, as long as it's happening to everybody, I'll be able to compete,"' the president said quoting Musk. Trump said he found this to be 'a very honest answer.' 'After that he got a little bit strange,' the president admitted. Last Thursday, Trump and Musk were throwing bombs at each other over the SpaceX head's criticism of the Republicans' 'big beautiful bill,' which the DOGE leader argued destroyed his efforts of federal cost-cutting. It got so heated that Musk wildly claimed that Trump appeared in pedophile Jeffrey Epstein's files and should be impeached and replaced with 40-year-old Vice President J.D. Vance. Tensions have simmered down since, as Trump has been busy going after a true political rival - Democrat Newsom - amid unrest in downtown Los Angeles over the president's 'mass deportation' policy. During the president's nearly hour and a half appearance in the East Room - which turned into a full-blown press conference, Trump referred to Newsom by his nickname 'Newscum' and also called him as 'Gov. Gavin.' 'Under the previous administration, the federal government gave left-wing radicals in California dictatorial powers to control the future of the entire car industry all over the country - all over the world,' Trump complained. 'They approved Gov. Gavin Newscum's ridiculous plan to impose a 100 percent ban on all new gas-powered cars within a very short period of time,' the president continued. He called the policy 'ridiculous' and then segued into this week's ordeal, where Trump was battling with Newsom over the president's decision to federalize the National Guard and send them to quell the LA protests - against the governor's wishes.
