MACC backs new Government Procurement Bill to boost enforcement and tighten oversight

PUTRAJAYA, June 21 — The Government Procurement Bill, scheduled to be tabled in Parliament this year, is expected to strengthen punitive legal action against parties found guilty of offences related to government procurement. The bill also aims to establish a specific legal framework to regulate the government procurement process, in addition to detailing the powers of stakeholders and enhancing check-and-balance mechanisms to ensure good governance in line with international best practices. The proposal and draft structure of the bill were presented by the Government Procurement Division of the Ministry of Finance, led by its secretary Datuk Norison Ramli, during an engagement session with Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Tan Sri Azam Baki at the MACC headquarters here today. Norison said the MOF welcomes views and suggestions from the MACC, particularly on enforcement and the application of existing laws under the commission's jurisdiction. Azam expressed his support for the key points of the proposed bill, which he said align with the ongoing National Anti-Corruption Strategy (NACS). 'NACS is the best platform for the MACC to address weaknesses in the government procurement system, and we fully support this initiative,' he said. — Bernama

KUALA LUMPUR, June 14 — The Malaysian Anti-Corruption Commission (MACC) has obtained a forfeiture order against USD954,299.58 (approximately RM4.05 million) held in a BSI Bank account in Switzerland, linked to the misappropriation of 1Malaysia Development Berhad (1MDB) funds. In a statement today, the MACC said this marks the commission's first successful recovery of overseas assets without having to pursue prosecution. The High Court's approval was granted by Justice K Muniandy after the deputy public prosecutor informed the court that there were no objections or claims raised by any party during proceedings before the High Court (Criminal Division 2) in Kuala Lumpur earlier today. In his judgment, Justice Muniandy allowed the forfeiture of the funds held in a bank account under the name Derivale Limited, with Azlin Alias named as the beneficiary. The funds are now forfeited to the Government of Malaysia through the MACC. The forfeiture was granted under Section 56 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, the statement read. — Bernama

(Bernama pic) PETALING JAYA : Officers from the Anti-Corruption Tactical Squad were deployed to assist in recording the statement of a Tan Sri on the alleged misappropriation of sukuk funds meant for a Klang Valley highway project due to suspicions that he had weapons hidden in a secret room at his home. The Malaysian Anti-Corruption Commission clarified this following a raid on the man's residence in Bandar Tasik Selatan, Cheras, yesterday. MACC's strategic communications division said it received information that a secret room at the residence contained valuables and weapons related to the ongoing probe. 'The presence of the ACTS team was to ensure the safety of the officers involved and escort the seized items back to the MACC headquarters in Putrajaya,' it said in a statement. MACC seized several luxury items, including branded handbags, watches, gold bars, coins, gold figurines, diamonds and other jewellery, in the raid. The items included 84 luxury handbags worth about RM3 million, 11 branded watches worth about RM1 million, gold bars, coins, and figurines valued at RM3 million, and diamonds and jewellery estimated at RM4 million. A set of luxury casino gaming equipment valued at about RM150,000 was also confiscated. 'MACC also discovered a bulletproof secret room used for storing firearms and ammunition, but no seizure was made as the weapons were registered under a security company owned by the individual,' the agency said. MACC chief commissioner Azam Baki confirmed that the total value of the seizures stood at some RM16 million and did not rule out the possibility of further confiscations. He said the process of recording the individual's statement had been postponed to a later date due to health reasons.

Meeting with Judicial Council President Mahmoud Ababneh, His Majesty was briefed on the status of the regular courts, the administrative judiciary, and the public prosecution, and called for continuing to increase the expeditious and timely adjudication of cases and litigation procedures, according to a Royal Court statement. The King commended the judiciary's efforts in raising the level of performance. According to the Judicial Council's report, the judiciary has reduced the total number of referred cases by 18 per cent, compared to 2023. The regular courts adjudicated more than 417,000 cases, accounting for 87 per cent of total cases that went before the courts, with an average duration of 57-day litigation in all courts, the statement said. His Majesty also met with Chief Islamic Justice Abdul Hafez Rabtah and Higher Sharia Court President Kamal Smadi to receive the Sharia Courts' annual report for 2024. The King commended the efforts of the Sharia Courts in enhancing the level of services provided to citizens. His Majesty stressed the importance of the Sharia Courts' role in promoting family cohesion and community protection, while noting the need to develop electronic services for these courts. According to the Sharia Courts' report, there were around 150,000 dismissed or dropped cases, accounting for 86 per cent of total cases. Meanwhile, the courts' family reconciliation and mediation offices succeeded in restoring more than 9,000 families to their normal lives, and diverting 39,000 cases from judicial litigation to consensual agreements. The report also highlighted that the Chief Islamic Justice Department launched a platform offering 73 digital services to facilitate access to judicial services. During the King's meeting with IACC Chairman Muhannad Hijazi on the commission's report, His Majesty praised the efforts of IACC staff. The King urged continuing strengthening the capabilities of the IACC's cadres, and to maintain coordination between official institutions to enhance the national integrity and transparency system. According to the IACC report, the commission recovered, contributed to recovering, or prevented the waste of public funds amounting to around JD61 million, in addition to detecting suspected tax evasion cases amounting to around JD110 million. The IACC also examined more than 2,000 investigation files, referred 197 of them to the public prosecution, and launched an initiative to raise awareness among university students about their role in promoting integrity and combating corruption. Royal Hashemite Court Chief Yousef Issawi and Director of the Office of His Majesty Alaa Batayneh attended the meetings.
