MACC, TI-M support efforts to improve Whistleblower Protection Act

KUALA LUMPUR: The Malaysian Anti-Corruption Commission (MACC) and Transparency International Malaysia (TI-M) have expressed full support for the government's ongoing efforts to improve the Whistleblower Protection Act. The MACC said the joint support was conveyed when the executive committee of TI-M, led by its president Raymon Ram, paid a courtesy call on MACC Chief Commissioner Tan Sri Azam Baki at the commission's headquarters in Putrajaya today. It said the enhancement of the Act is currently being undertaken by the Minister in the Prime Minister's Department (Law and Institutional Reform), Datuk Seri Azalina Othman Said, through the Legal Affairs Division of the Prime Minister's Department (BHEUU). During the meeting, Azam reaffirmed the commission's commitment to ensuring that the identities of whistleblowers and the information provided by them are kept confidential and not disclosed, once the whistleblower meets the conditions stipulated under the Whistleblower Protection Act 2010. 'Meanwhile, Raymon said TI-M had submitted proposals to BHEUU to review several sections of the Act that contradict other laws, which could result in the loss of protection for whistleblowers,' it said in a statement. Both parties also discussed mutual concerns, including political funding, the strengthening of the Integrity Pact in Malaysia, the implementation of the Anti-Bribery Management System (ABMS) MS ISO 37001 accreditation, and beneficial ownership declaration. 'All tenderers and companies participating in government procurement, based on the guidelines of the Companies Commission of Malaysia, are seen as capable of preventing corruption and fraud in procurement processes involving government suppliers,' the statement said.

Nada vows action over 2023 drug raid misconduct

KUALA LUMPUR: The National Anti-Drugs Agency (Nada) has pledged firm action against any staff found guilty of misconduct after the Enforcement Agency Integrity Commission (EAIC) revealed that suspects detained in a 2023 drug raid were released. Nada director-general Datuk Ruslin Jusoh said the agency does not and will not compromise or protect any personnel involved in misconduct or breaches of integrity. This followed EAIC's announcement earlier today that it had found evidence showing several individuals who tested positive for drugs during a raid on March 8, 2023, in Kampung Felda LBJ in Labu, Negri Sembilan, were released. The commission also found that Nada's Negri Sembilan branch had failed to comply with the agency's standard operating procedures (SOP) during the operation. "Firm action will be taken against any staff found guilty, based on the provisions of existing laws," Nada said in a statement. "Nada continuously reminds all its personnel to carry out their duties and responsibilities with integrity, in full compliance with the SOP and guidelines under the Anti-Bribery Management System." Nada added that it would continue to work closely with the EAIC to strengthen governance within the agency, particularly in investigations involving complaints of misconduct or integrity breaches among its personnel. Earlier, the EAIC said it would refer the findings of criminal conduct to the public prosecutor and the findings related to disciplinary offences involving Nada officers to the Disciplinary Authority with a recommendation for disciplinary action.

According to the International Organization for Standardization (ISO), the certification is an internationally recognised standard for the implementation of anti-bribery management systems within an organisation. MAG said in a statement the certification currently applies to group-level functions involving governance, risk, compliance, sustainability, and leadership, with controls in place to manage bribery risks across high-impact areas such as procurement, vendor engagement, and third-party interactions. "An effective anti-bribery system must be driven from the top. This certification is not just a formality—it is a firm declaration of our zero-tolerance stance against bribery, fraud, and corruption. MAG's certification process was strongly supported by its board of directors and group executive committee, and included a detailed corruption risk assessment, the formation of a dedicated Working group committee, and the development of the ABMS framework. MAG also operates a publicly accessible whistleblowing platform, providing a safe and confidential channel for reporting suspected misconduct. Within the organisation, the Group Business Integrity unit currently has two Certified Integrity Officers (CeIOs), with plans to certify more personnel across departments to ensure the ABMS is sustained and embedded throughout the Group. The group now aims to progressively expand the certification scope to include other business pillars and entities, with the goal of fostering a business ecosystem grounded in integrity and ethical conduct across all touchpoints.
