AGC Rejects Claims Of 'Flawed Prosecution' After Najib's DNAA In Second SRC Case
KUALA LUMPUR, June 20 (Bernama) -- The Attorney General's Chambers (AGC) has dismissed as baseless allegations that it carried out a 'flawed prosecution' in the second SRC International Sdn Bhd case involving Datuk Seri Najib Tun Razak. In a statement, the AGC reiterated its firm commitment to upholding the rule of law and stated that it would continue to fulfill its responsibilities under the Federal Constitution with integrity, fairness and respect for the judicial process. However, the AGC acknowledged the decision by High Court Judge K Muniandy to grant Najib a discharge not amounting to an acquittal (DNAA) on three charges of money laundering involving RM27 million in funds from the company. 'The case was registered in the High Court on Feb 7, 2019, and scheduled for trial on five occasions: June 2020, July to August 2021, March to April 2022, September 2024 and April to May 2025. 'However, all trial dates were postponed due to the Movement Control Order caused by the COVID-19 pandemic, requests by the defence, or applications by the prosecution itself,' the statement read. According to the statement, the prosecution's requests for postponement were due to the ongoing trial of the first SRC case, which proceeded at the High Court, Court of Appeal and Federal Court until its completion on March 31, 2023. At the same time, the trial proceedings for the 1Malaysia Development Berhad (1MDB) case had also begun while the first SRC case was still ongoing. 'Both cases involved overlapping material documents required for the second SRC trial. 'As these documents were critical to the second SRC case, the prosecution had no choice but to wait until they were available, which was until the 1MDB trial proceedings were completed. 'It must be emphasised that the material documents are available but are currently being used as evidence in the ongoing 1MDB trial,' the AGC said.

Najib's DNAA: Material documents unavailable because held up in 1MDB trial, says AGC
PETALING JAYA: All aspects will be examined and considered before taking any further action on the temporary discharge of Datuk Seri Najib Razak three counts of money laundering involving RM27mil linked to SRC International Sdn Bhd, says the Attorney General's Chambers (AGC). The AGC said there were some documents which were material for the current SRC International trial, and the prosecution had no choice but to wait until the relevant material documents were obtained after the 1MDB trial proceedings were completed. "It should be emphasised that the material documents are already available but are being used as evidence in the ongoing 1MDB trial," the AGC said in a statement on Friday (June 20). "The prosecution has requested time to gather all relevant material documents to be presented as evidence and testimony in the second SRC trial. This delay is not intentional but is to ensure that the integrity of the documents as evidence in the trial is always maintained. "The department is aware that this case has attracted public attention as it involves the former prime minister of Malaysia and throughout the proceedings before the Court, the department has taken action in accordance with the limits of the independence of the prosecution and the legal process. "The case was registered at the High Court on Feb 7, 2019 and has been set for trial five times in June 2020, July to August 2021, March to April 2022, September 2024 and April and May 2025." It said all trial dates of the case have been postponed for the following reasons: (i) Movement control order due to the Covid-19 pandemic; (ii) Application by the accused's counsel; or (iii) The prosecution's own application. The application for adjournment made by the prosecution is because (i) The trial proceedings of the first SRC case were still ongoing at that time at the High Court, Court of Appeal and Federal Court levels until fully completed on March 31, 2023; (ii) At the same time, the 1MDB trial proceedings had also begun while the first SRC case was still pending. Both cases above involved the use of some of the material documents that would be used in the second SRC trial. "This department emphasises that the allegations by certain parties that this department carries out "defective prosecution" are completely unfounded. This department always maintains the highest level and quality in line with the expectations of the people. "This department remains committed to upholding the rule of law and will continue to carry out its responsibilities under the Federal Constitution with integrity, fairness and respect for the judicial process," it said. Earlier, Judge K Muniandy allowed the defence's application for a DNAA over three money laundering charges involving RM27mil from SRC International Sdn Bhd, citing the prosecution's lack of preparedness to proceed with the trial, which has been postponed numerous times since 2019. The court was informed that the prosecution had yet to obtain the necessary documentary evidence. The delay, the judge noted, had denied the accused the right to a fair and timely resolution of the case. A DNAA means the accused is temporarily discharged from the charges but may still be prosecuted for the same offences in the future if the prosecution so decides.

'Inexcusable': AGC must answer for repeated DNAAs in high-profile corruption cases, says C4
PETALING JAYA: The Attorney General's Chambers (AGC) must be held accountable for its repeated failures in a number of high-profile court cases that have ended in a discharge not amounting to an acquittal (DNAA), says the Centre to Combat Corruption and Cronyism (C4). It said the recent pattern of flawed prosecutions involving political figures that ended in a DNAA showcased a possible significant deep-rooted institutional incompetence within the prosecutorial office. 'These are not normal criminal cases; they implicate corruption involving some of the most powerful political figures in the country, and as such, should be treated with the highest priority. 'It is inexcusable that DNAAs keep being granted on the basis that the AGC had failed to adhere to basic procedures, which are part of any criminal prosecution. 'Not only were they simply not prepared for this case that has been in progress for 6 years, they did not even object to the DNAA,' it said in a press statement on Friday (June 20). This comes after former prime minister Datuk Seri Najib Razak was granted a DNAA for three counts of money laundering involving RM27mil linked to SRC International Sdn Bhd by the High Court on Friday (June 20). C4 said Najib's newest DNAA joins a long list of recent similar failures by the AGC in court, including Najib and former treasury secretary-general Tan Sri Mohd Irwan Serigar Abdullah being granted a DNAA in the RM6.6bil criminal breach of trust case linked to payments to the International Petroleum Investment Company (Ipic) in November last year. Another recent high-profile case involved Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi, who was granted a DNAA for all 47 graft charges involving Yayasan Akalbudi funds on Sept 4, 2023. C4 also questioned the lack of any attempts by the AGC to publicly address its repeated failures in high-profile court cases, adding that it was sowing public distrust in the government and judiciary. 'Why have there been no public attempts to remedy this or address these prosecutorial failures? 'This lack of accountability only serves to deepen public distrust, erode confidence in the rule of law, and reinforce the perception that justice in Malaysia is neither independent nor equal,' it added. It also called on the AGC to publicly commit to refiling the charges for all cases where political figures have received a DNAA as soon as possible.

Zaid lists prosecutorial reforms needed after Najib's latest DNAA
Former law minister Zaid Ibrahim said public fatigue over flawed prosecutions is reaching a tipping point. PETALING JAYA : Former law minister Zaid Ibrahim has outlined several proposed reforms to keep the Attorney-General's Chambers accountable, after Najib Razak's discharge not amounting to an acquittal (DNAA) in his SRC International Sdn Bhd money laundering case. Zaid said the AGC has operated without being held accountable for too long, necessitating reforms to be undertaken as Malaysians become disillusioned. 'Public fatigue over flawed prosecutions is reaching a tipping point. Malaysians are watching and they are angry,' the former Kota Bharu MP said in a post on X. Zaid called again for the separation of the roles of the attorney-general and public prosecutor to be expedited to ensure the public prosecutor's independence in upholding justice. He also suggested the establishment of a prosecution oversight commission, specifically to review decisions not to prosecute cases of public interest and to recommend referrals for judicial review. He proposed that a prosecution code of ethics be enacted to make it mandatory for prosecutors to always disclose all exculpatory evidence and provide written justifications for DNAAs, NFAs (no further action) and plea bargains. This is also aimed at excluding any political influence in charging any individual of an offence. Zaid called for the AGC to be required to table annual reports on the statistics of DNAAs and NFAs as well as prosecution outcomes in Parliament, and for a select committee to oversee prosecutorial conduct. He also suggested that senior prosecutors, like judges, be appointed to fixed terms to ensure that their tenures are protected from arbitrary removal. He called for whistleblower protection laws to be reviewed to allow for disclosures to be made even if involving classified information, as long as done in public interest and good faith. Zaid said Perikatan Nasional should champion these reforms if it wanted to gain public support, instead of simply touting slogans on reforms. 'A credible, ironclad promise to clean up the prosecution – with independent oversight, transparent rules, and professional integrity – would strike a powerful chord among the rakyat,' he said. This morning, Najib was granted a DNAA in his RM27 million SRC money laundering case after the High Court found that the prosecution was not ready to proceed with the trial. Justice K Muniandy said no witness testimony had been pursued since the case was brought against Najib in 2019, only a plethora of postponements, indicating that the prosecution was not ready to prosecute the case. Najib is currently serving his reduced six-year prison term for abuse of power, money laundering and criminal breach of trust involving RM42 million in SRC funds. In November, Najib and former Treasury secretary-general Irwan Serigar Abdullah were granted a DNAA in their International Petroleum Investment Company (IPIC) case.
