[단독] "국정원, 계엄 이후 국회에 '대공수사권 복원' 요청"

[코리아헤럴드=김아린 기자] 국가정보원이 비상계엄 이후 국회를 찾아 경찰로 이관된 대공수사권을 국정원에 복원해줄 것을 요청한 것으로 알려졌다.
A 더불어민주당 의원은 25일 코리아헤럴드를 만나 국정원 고위 관계자가 지난해 12월 20일 자신을 찾아와 대공수사권을 되돌려달라고 요구했다고 밝혔다.
A 의원은 국정원 고위 관계자의 요청에 "국정원의 대공수사권을 없앤 덕분에 비상계엄 때 국정원이 적극 참여하지는 못한 것"이라며 선을 그었다고 전했다.
A 의원에 따르면, 국정원은 대공수사권을 부활해달라는 요청을 여러차례 전달했다.
A 의원은 "(국정원 관계자)가 볼 때마다 대공수사권을 돌려달라고 얘기하는데, 이미 국정원법상 업무의 범위가 상당히 포괄적으로 보장되어 있는데도 계속해서 요구하고 있다"고 했다. 그는 "국정원법 4조 3호는 국정원이 북한·외국과 연계된 내국인의 활동을 확인하고 대응조치를 취할 수 있도록 하는데, 이는 매우 모호하고 넓은 업무 범위"라고 덧붙였다.
A 의원은 "정보경찰의 규모는 국정원의 대공 수사인력보다 훨씬 많은 숫자"라며 "경찰 이관으로 오히려 우리의 대공수사 역량은 확대된 것"이라고 주장했다. 그러면서 "체포 전 단계까지는 국정원의 권한이 이미 방대한데 국정원은 경찰과 협력하기보단 지휘·통제하고 싶은 것"이라고 꼬집었다.
A 의원은 윤석열 전 대통령이 국정원의 대공수사권 회복에 대한 염원을 미끼로 삼아 홍장원 전 1차장 포섭을 시도한 것이라고 봤다. 윤 대통령 공소장을 보면, 윤 대통령은 비상계엄 선포 당일인 지난해 12월 3일 홍 전 차장에게 전화해 "국정원에도 대공수사권 줄 테니까 우선 방첩사를 도와 지원해"라고 지시했다.
A 의원은 "홍 전 차장으로선 원장이나 대공 업무를 담당하는 2차장이 아닌 자신에게 대공수사권을 준다는 대통령의 지시가 회유로 느껴졌을 수 있다"면서 "그 지시를 홍 전 차장이 이행하지 않은 것은 참 다행스러운 일"이라고 했다.
간첩 등 국가보안법 위반 범죄를 수사하는 권한인 대공수사권은 지난해 1월 국정원에서 경찰로 완전히 넘어갔다. 대공수사권 이관은 문재인 정부 때 국정원 개혁의 일환으로 추진됐다.

[Exclusive] NIS tried to lobby to regain investigative powers after Yoon's martial law
The National Intelligence Service asked the Democratic Party of Korea to restore its authority to investigate crimes of North Korean and foreign espionage, which was transferred to the police early last year, after former President Yoon Suk Yeol's botched imposition of martial law.
According to a Democratic Party lawmaker, who spoke on the condition of anonymity, a high-level NIS official visited him on Dec. 20, 2024, less than three weeks after Yoon's martial law declaration, and asked for the intelligence agency's investigative authority to be restored.
The lawmaker said that NIS officials have asked for revisions in the law to bring back the agency's investigative authority several times since.
In January last year, the authority to investigate crimes related to espionage was transferred to the police from the NIS as a part of efforts by the previous Moon Jae-in administration to reform the intelligence agency.
According to the lawmaker, the NIS is already guaranteed "a fairly vast scope" of activities for looking into espionage. "The NIS can undertake a preliminary investigation. The police only handle arrest and referral to the prosecution for indictment," the lawmaker said.
The lawmaker said Yoon appeared to have exploited the NIS' desire to regain its investigative functions when he allegedly offered Hong Jang-won, former deputy director of the NIS, the power to investigate on the night of martial law.
According to prosecutors, Yoon called Hong shortly after announcing he was imposing martial law on TV and told the then-deputy director that he would give the intelligence agency the investigative powers to follow through with his orders.
"I think it was very fortunate for the country that Hong refused to take the bait and chose not to follow Yoon's orders," the lawmaker said.

Senior diplomats of South Korea and the United States agreed Friday to work together to strengthen their countries' alliance and trilateral cooperation with Japan during their talks in Washington, according to the South Korean Embassy in the US capital. South Korean Ambassador to the US Cho Hyun-dong met with new Under Secretary of State for Political Affairs Allison Hooker at the State Department to discuss the bilateral alliance and a range of regional and global issues, the embassy said. Confirmed by the Senate earlier this month, Hooker is noted for her longtime experience in diplomacy with North Korea, including preparations for US President Donald Trump's summits with North Korean leader Kim Jong-un during his first term. "Sharing the understanding on the importance of close cooperation between South Korea and the US over North Korean issues, and of comprehensive bilateral cooperation, the two sides agreed to continue efforts to strengthen the Seoul-Washington alliance and enhance trilateral cooperation with Japan," the embassy wrote on Facebook. Cho described Hooker as a longtime expert on issues related to the Korean Peninsula and the alliance. "(Cho) asked Under Secretary Hooker -- a longtime friend of South Korea and strong backer of the South Korea-US alliance -- to continue to support efforts for the development of bilateral relations," it said The two sides agreed to closely cooperate to respond effectively to an array of global challenges, as they discussed the Israel-Iran conflict and Ukrainian issues, as well as challenges in the Indo-Pacific. Hooker previously served as senior director for Asian affairs at the National Security Council. She was deeply involved in preparations for Trump's summits with Kim in Singapore in June 2018, Hanoi in February 2019 and the inter-Korean border village of Panmunjom in June 2019. From 2001-2014, Hooker served as a senior analyst for North Korea in the Department of State's Bureau of Intelligence and Research. ‘서해피격' 유족 면담 의향 묻자 이종석 '검토하겠다'

이종석 국가정보원장 후보자는 19일 '서해 공무원 피격 사건' 유가족이 요청할 경우 면담을 검토해보겠다는 입장을 밝혔다. 이 후보자는 이날 오후 진행된 비공개 인사청문회 이후 '서해 피격' 피해자 유가족과 면담 의향을 묻는 기자들의 질의에 "필요하면 뵈어야겠다. 검토를 해보겠다"고 답했다. 2020년 9월 서해에서 북한군의 총격에 숨진 해양수산부 공무원 이대준 씨의 친형인 이래진 씨는 이 후보자의 인사청문회를 앞두고 "이종석 국정원장이 취임하면, 비공개도 좋으니 한번 뵙고 싶다"고 코리아헤럴드에 전한 바 있다. 이 후보자는 취임 후 서해 피살 공무원과 동해 귀순 어민 강제 북송 사건과 관련해 2022년 진행된 국정원 내부 감찰이 적절한지 점검하겠다는 의사도 밝혔다. 이 후보자는 당시 국정원 내부 감찰은 "전직 국정원장들에 대해 형사 문제나 권력 남용 문제가 아닌, 정책적 판단에 의해 이뤄진 것이기 때문에 굉장히 불행한 사건"이라면서, "복귀하고 천천히 정리를 해야되지 않을까 생각한다"고 했다. 이 후보자는 12.3 비상계엄 사태에 국정원이 얽힌 부분에 대해서도 들여다보겠다고 했다. 이 후보자는 "특검 과정에서 국정원에도 일부 조사가 들어올텐데, 국정원이 걸려있는 것들에 대해 당연히 살펴볼 생각이다"고 말했다. 그러면서 "다만 그것이 감찰이 될지, 어떤 성격이 될지는 예단하기 어렵다"고 덧붙였다. 앞서 같은 날 오전에 열린 공개 인사청문회에서 이기헌 더불어민주당 의원은 문재인 정부 당시 박지원·서훈 국정원장에 대한 형사 고발로 이어진 국정원 내부 감찰이 "있을 수 없는 일"이라고 목소리를 높이며, 경위를 밝힐 필요성에 대한 이 후보자의 입장을 물었다. 이에 이 후보자는 "국정원 내부 조직과 관련 돼 있고 전직 원장과 관련 돼 있는 사건이라 상당히 깊이 살펴보겠단 의사 표시를 했고, 앞으로 그렇게 하겠다"고 답했다. 이성권 국민의힘 정보위원회 간사는 이 후보자가 서해 공무원 피격 사건에 대한 입장 표명을 회피했다고 지적했다. 이 간사는 "이 후보자에게 서해 공무원 피격 관련해 물으니 '모른다'고 답했다"면서 "대북전문가인데 그 일을 하지 않아서 답변을 못 한다는 것은 말이 안 된다"고 꼬집었다. 18일 국회에 낸 인사청문 자료에서 이 후보자는 서해 피격·강제 북송 사건에 대한 입장을 묻는 질의에 "세종연구소 연구원으로 재직하던 시기에 발생한 사건으로 정확한 사실관계를 알지 못한다"면서, "국정원장으로 취임하게 된다면 관련 내용을 살펴보겠다"고 답했다. 이 후보자의 인사청문회 보고서 채택을 위한 국회 정보위 전체회의는 20일 열린다. When asked about his past public remarks opposing the introduction of THAAD, the US antiballistic missile defense system and GSOMIA, the intelligence-sharing framework with Japan, the nominee said he believes that those were "things that are already agreed upon and should be complied with." Lee said that the foundation of South Korea's security is its alliance with the US. "That is the stance of the Lee Jae Myung administration, and I believe the same," he said. In response to The Korea Herald's question after the confirmation hearing, Lee said that he would be open to meeting with the bereaved family of a South Korean fisheries official who was shot dead by North Korean troops at sea in September 2020. "I have not yet looked into the matter, but I would consider it," the nominee said. In Wednesday's prehearing brief, seen exclusively by The Korea Herald, Lee said if he is appointed as the director, he would "look into" the shooting murder of the South Korean official. He was responding to a lawmaker's question about his stance on the case. In 2022, the NIS filed a criminal complaint against its former director Park Jie-won, who is now a Democratic Party of Korea lawmaker, for allegedly destroying the spy agency's confidential materials related to the South Korean official's death. Park denies all allegations. The criminal trial for Park and other high-level officials at the time is ongoing. In the prehearing brief, Lee also denied the accusations that he was lenient toward North Korea. "I absolutely cannot agree with the claims that I am pro-North Korea only because I have studied North Korea and the Korean Peninsula in depth," he said. Lee served as minister of inter-Korean affairs under the late former liberal President Roh Moo-hyun in 2006.
