Raipur: Overruling the argument that private schools do not come under the ambit of the RTI act, the Chhattisgarh High Court directed a Ambikapur school to provide copies of a
student's transfer certificate
and admission form to the child's biological father within 15 days.
Justice Amitendra Kishore Prasad issued the order after the father, Rahul Gupta, moved court citing denial of information by the school despite multiple applications and complaints.
The school's counsel had also argued in court that the application was denied due to a dispute between the child's mother and father.
The court held that the petitioner, as the biological father, had the right to access his child's educational records and directed the Holy Cross Convent Senior Secondary School, Ambikapur, to deliver the documents to his provided address, email, and mobile number, overruling the school's objection that private schools are not covered under the RTI Act.
The order of the Single Bench of Justice Amitendra Kishore Prasad came in response to a petition filed by the father, Rahul Gupta, who sought copies of his son's Dakhil-Kharij (transfer certificate) and admission form. The petitioner stated that he applied to the CBSE-affiliated school on April 27, 2024, for the documents but received no response. Subsequently, he filed an application under Section 6(1) of the Right to Information (RTI) Act, 2005, with the district education office, Surguja, on April 29, 2024. However, this request was denied on the grounds that private schools are not covered under the RTI Act.
Aggrieved by this, the petitioner filed a first appeal to the district education officer (DEO) and first appellate authority, citing a previous letter from the office and decisions of the Central Information Commission indicating that private schools are indeed covered under Sections 2(g) and 2(h) of the RTI Act. The first appellate authority upheld the denial.
The petitioner then filed complaints with the district collector of Surguja, the chief minister, the secretary of school education, and the district collector. The DEO, acting on the chief minister's office's response, directed the petitioner to communicate with the school. On Oct 25, 2024, the petitioner reapplied to Holy Cross Convent Senior Secondary School, with an intimation to the DEO, but the school again denied the request on Oct 29, 2024.
However, the high court, considering the petitioner's right to information as the biological father, directed the school to provide the requested information within 15 days of receiving a certified copy of the order. The court also instructed the school to provide the information to the petitioner's address, email, and mobile number as listed in the petition.

The Kerala State Information Commission has brought the State Council for Open and Lifelong Education (SCOLE) Kerala and the Nirmithi Kendras functioning across the State under the ambit of the Right to Information (RTI) Act, 2005. In the first case, the applicant, Krishnan Kutty K. from Palakkad, had requested information from SCOLE Kerala, which operates under the General Education department. Denying information sought under the RTI Act, the institution claimed that it was not bound by the law. Considering the applicant's appeal, State Information Commissioner Sreekumar M. stated that SCOLE Kerala qualifies as a public institution under Section 2(h)(c) of the RTI Act. The commission also pointed out that the administration of SCOLE Kerala is governed by an Executive Council, which includes the Minister of General Education, an Additional Secretary, the Director of General Education and Finance Officer, as well as nominees from the public sector. Therefore, it was concluded that SCOLE Kerala falls under the full ownership and control of the government, as per Section 2(h)(i) of the RTI Act. Similarly, in another case, C. Pradeep Kumar from Adoor filed a petition regarding a denial of information from the Nirmithi Kendra in Thrissur. The Commission ruled that Nirmithi Kendras, which operate under government control, also fall under the RTI Act's jurisdiction. The governing body of these centres includes District Collectors, Sub-collectors, Project Officers, and other senior government officials, all of whom are responsible for overseeing the centres' administration. The Commission has instructed the authorities concerned in both cases to immediately appoint RTI officers in these institutions, and to provide the requested information to the petitioners within 15 days.

MADURAI: A response to an RTI query, regarding the state government's efforts to ensure tribal students secure admission to prominent higher educational institutions, has revealed that a G.O. passed in 2013 towards offering special coaching for such schoolchildren was not implemented. Administrative reasons were cited for the same. Responding to an RTI filed by activist S Karthik seeking information on the efforts taken by the Tamil Nadu Adi Dravidar Housing & Development Corporation (TAHDCO) to get tribal students into some of the top institutions like IIT and NIT for the past 12 years and how many benefited from that, TAHDCO's public information officer (PIO) stated that the state government passed G.O. 76 on October 15, 2013, to provide special coaching to around 50 students at a cost of Rs 2 lakh per ward for two years. Every year the government were to allocate Rs 50 lakh. However, it was not implemented due to administrative reasons, the official added. Karthik told TNIE that, like this G.O, many schemes meant for the welfare of tribals are only on paper. Compared to other community students, tribal students lag behind in education. If this G.O. had been implemented effectively, at least 600 tribal students could have joined IITs and NITs over the past 12 years, he said. He further requested the government to implement the G.O. and also allocate additional funds of Rs 2 crore as well as form a committee led by the collector to monitor the programme. While confirming there being no special scheme that provides coaching to tribal students appearing for JEE, a TAHDCO official on condition of anonymity said the department is imparting state-level skill training for them in order to make them crack competitive exams.

Ludhiana: District election officer Himanshu Jain Saturday said elaborate arrangements are in place for the smooth counting of votes polled for the Ludhiana West bypoll. At sharp 7 am on June 23, the counting of votes and postal ballots will commence in the presence of election observers, candidates, and their authorised representatives. An official statement said robust security measures, including the deployment of paramilitary forces at the counting centres to safeguard electronic voting machines (EVMs) and Voter Verifiable Paper Audit Trail (VVPAT) machines, have been implemented. The entire process is being continuously monitored through CCTV surveillance. The DEO emphasised that entry to the counting centres will be strictly regulated, allowing only candidates, their representatives, media personnel, and authorised individuals with valid identity cards issued by the ECI. Fourteen candidates are in the fray for the seat, including AAP's Sanjeev Arora, Congress' Bharat Bhushan Ashu, BJP's Jiwan Gupta, and SAD's advocate Parupkar Singh Ghuman. Chief electoral officer Sibin C Thursday said the voter turnout, as per data uploaded till 7pm on the voting day, was 51.33%. As part of a new initiative, polling data was uploaded on the ECINET app by the presiding officers at the respective polling stations. A total of 194 polling stations were set up. Besides the provision of assured minimum facilities at each polling station, for the first time, a mobile deposit facility was created at the entrance of all polling stations.
