SC reviews landmark verdict amid absences, silence and restraint

The highest court in the land on Monday waded into uncharted waters as it began hearing review petitions against its July 12 judgement - a verdict that had handed Pakistan Tehreek-e-Insaf (PTI) reserved seats in the national and provincial legislatures - but without six of the original judges, including the judgement's author.
The hearing broke new ground in more ways than one, marking several firsts in judicial history.
The review petitions, filed by the ruling PML-N and PPP alongside the Election Commission of Pakistan (ECP), are being heard by a 13-member larger bench.
Curiously, the majority of the new Supreme Court bench were not part of the original decision, and no explanation has been offered as to why the court's constitutional committee did not recommend including the six judges from the earlier ruling.
For the first time since the 26th Constitutional Amendment was passed, the Supreme Court proceedings were broadcast live, a move hailed as a step toward transparency, though the absence of key judges cast a long shadow.
Despite the high stakes, not a single judge offered observations in favour of the majority judgement under review. Even Justice Muhammad Ali Mazhar and Justice Hasan Azhar Rizvi - both signatories to the original ruling - remained unusually tight-lipped, adopting a tone of marked restraint.
In contrast, two judges who had not been part of the original bench raised a fundamental question: if the PTI was not a party in the initial case, how could it receive relief?
They wondered as to how reserved seats were given to PTI when they were not a party, neither before the ECP nor the Peshawar High Court (PHC).
Justice Aminuddin Khan observed that it was an admitted fact that all PTI-backed returned candidates had joined the Sunni Ittehad Council, which had not contested the general elections.
He pressed further, asking whether any PTI-backed returned candidate had approached any forum to declare himself as a PTI candidate.
'Should the SC shut its eyes?'
The elephant in the courtroom, however, remained the role of the ECP during the controversial February 2024 polls, with most judges sidestepping the discussion on it. Though the majority judgment had held the ECP to account, only Justice Jamal Khan Mandokhail pointed to the electoral body's failings.
Justice Mandokhail - part of the minority who believed PTI was entitled to reserved seats - said that the presiding officers and returning officers failed to perform their duties in accordance with the law and constitution during the February 2024 general election.
He challenged the opposing counsel, Makhdoom Ali Khan, by asking: "Should the Supreme Court shut its eyes?"
Commenting on the matter, lawyer Abdul Moiz Jaferii flagged what he saw as a glaring lapse in judicial due diligence.
"What I found most amazing was how some of the judges who were not part of the original proceedings had clearly not read the judgment under review. You are seated to determine an error floating on the face of the record."
"You are extraordinarily doing so without the author judge and many other judges senior to you who were part of the original proceedings. Surely you can read the judgment for yourself and not rely on the arguments of counsel to refresh the most basic principles of the case for you," he added.
Observers also noted that the government's side appeared in a rush to tie up loose ends. Counsels for the PML-N, PPP and ECP all fell in line behind the arguments presented by Makhdoom Ali Khan, despite the original verdict's criticism of the ECP's conduct.
Insiders suggest that Justice Aminuddin Khan's upcoming Hajj might be behind this urgency. There is speculation that the ruling coalition is keen to see the matter settled before his departure.
On the other side of the aisle, PTI and its allied Sunni Ittehad Council (SIC) have engaged four senior counsels to defend the majority ruling. SIC's Faisal Siddiqi is slated to present his arguments today (Tuesday).
Legal circles believe that the current impasse stems from the ECP's misreading of the Supreme Court's January 13 verdict, which declared PTI's intra-party polls illegal.
Besides, the court under former chief justice Qazi Faez Isa also came under fire for dragging its feet on PTI's review petition – a delay that many say left the political field clouded in uncertainty.
Even the majority judgment had flagged constitutional tensions at the heart of the matter.
The majority verdict had quested how the matter of intra party elections - a matter of internal governance of a party - could trump the fundamental rights of citizens to vote and of political parties to effectively participate in and contest elections by obtaining a common symbol for their candidates, guaranteed under Articles 17(2) and 19 of the Constitution.

ISLAMABAD: The counsel of Pakistan Tehreek-e-Insaf (PTI) asserted that there is no violation of time-line in the majority judgment by granting 15 days to the 41 independents to join the PTI. The judgment of eight judges in reserved seats has straight way declared that 39 independents, out of 80, were PTI candidates, while for 41 candidates laid down the mechanism for their joining the PTI. Justice Jamal Khan Mandokhail and the ex-CJP Qazi Faez also ruled that 39 independents, who in their nomination paper mentioned PTI, are the PTI MNAs. Justice Yahya Afridi also had similar view. Salman Akram Raja, representing the PTI, said that 11 judges had accepted the reality that injustice was caused to the PTI candidates in the general elections 2024. Defending the majority judgment, he argued that 15 days were given to 41 candidates to inform that on February 8, 2024 of which party they were member, and not to join a political party, adding the majority judgment did not give relief to the PTI, but to the people of Pakistan. An 11-member Constitutional Bench, headed by Justice Aminuddin Khan, on Friday, heard the review petitions of Pakistan Muslim League-Nawaz (PML-N), Pakistan Peoples' Party (PPP) and the Election Commission of Pakistan (ECP). The proceeding was live-streamed on SC's YouTube channel. During the proceeding, Justice Musarrat Hilali questioned why did Hamid Raza, who is chairman of Sunni Ittehad Council (SIC), contested election as an independent candidate. Raja clarified that Hamid Raza in his nomination form instead of independent wrote the PTI-SIC alliance. Justice Mandokhail asked Raja that if his argument is accepted then 11 judges' judgment was wrong, and review should have been filed by the SIC rather than the ECP, the PML-N and the PPP. He said the Court cannot compel anyone to join such and such political party. Justice Hilali also questioned whether voting is the fundamental rights? Her objection was that after birth a person does not have voting right automatically, rather he had to wait till the age of 18 years. Justice Baqar Ali Najafi said right of vote is subject to the law and a person can cast vote after attaining the age of 18, and he/she polls vote only when there are elections in his/her constituency. Justice Najafi observed that there had been constitution deviation and the fundamental rights were violated in the past as well. He inquired from Raja what deviation did he see in the last elections, adding if the elections were non transparent and fair then why not the entire process of general elections 2024 declared null and void. Raja responded that instead of striking down the elections the Court laid down the mechanism to rectify the wrongs committed. He submitted that in the past whenever the constitutional scheme was violated or deviated the apex court played its role to bring the situation back to normal, adding if the matter is of general public and the fundamental rights then it can invoke the jurisdiction under Article 184(3) and Article 187 of the constitution, and under these provisions it has much greater and wider power. Justice Muhammad Ali Mazhar did not agree with him and said the High Court under Article 199 has greater power than the Supreme Court as it has power of habeas corpus and quo warran to. Raja also contended that there was no issue that the election symbol was taken, but the worst thing happened was that the PTI was derecognised, the candidates were told that if they would write PTI in their nomination forms then those would not be accepted and forced them to write independent in the nomination papers. The violation was committed by the ECP under Article 51 of the constitution that a party was not recognised and its candidates were not allowed to contest election on PTI ticket. These things completely destroyed the sanctity of the elections, he added. The PTI lawyer argued that the reason for joining the SIC was that they had the precedent of Balochistan Awami Party (BAP), which neither contested elections nor had any seat in the Assemblies despite that reserved seats were allocated to it. Earlier, Raja argued that review petitions could be filed if some facts or provisions of law are overlooked, while the erroneous judgment is no ground for review. Similarly, no technical aspect comes in the way to challenge the judgment in review jurisdiction. He contended that a party has to establish that the fact or provision of law was overlooked. PTI expresses strong solidarity with Iran

ISLAMABAD: The opposition Pakistan Tehreek-e-Insaf (PTI) on Friday expressed strong solidarity with Iran, declaring that the people of Pakistan stand firmly with their Iranian brethren amid ongoing hostilities between Iran and Israel. A PTI delegation, led by the Opposition Leader in National Assembly Omar Ayub, comprising senior party leaders, visited the Iranian Embassy to convey support on behalf of the Pakistani nation. The delegation met with Iran's Ambassador to Pakistan Dr Reza Amiri Moghadam. The visit was undertaken on the instructions of PTI's incarcerated patron-in-chief and ex-prime minister Imran Khan. A message from Khan was formally delivered to the Iranian envoy during the meeting. During his meeting with the Iranian envoy, Ayub condemned the Israeli aggression, calling recent actions by Tel Aviv violations of international law. 'We stand firmly with the Iranian government and its people,' he said. 'From Gaza to Tehran, the cries of the oppressed are shaking the conscience of the world.' He urged the international community to recognise Iran's right to self-defence and called on the Muslim world to move beyond symbolic gestures and adopt practical steps. 'Israel has become a threat to global peace,' he added, reiterating PTI's support for Iran. The acting PTI chairman Barrister Gohar Ali Khan who was also part of the delegation, said that 'we extended condolences over the recent losses in Iran and assured the ambassador that the people, opposition, and government of Pakistan stand united with Iran during this challenging time.' Separately, talking to journalists outside Parliament House, Khan reaffirmed that any efforts regarding Imran Khan's release would be pursued solely through constitutional and legal means. 'There will be no deal,' Khan asserted, dismissing speculation of backdoor negotiations. 'Imran Khan has always maintained that he will not seek or accept any deal.' He also emphasised that PTI had never sought assistance from any foreign government. 'We are not relying on the new US administration or any foreign intervention,' he said.
