Walmart to pay tech company $222M over trade secret misappropriation

An Arkansas federal jury found on Wednesday that Walmart owes technology company Zest Labs more than $222 million over claims that the mass retailer stole Zest Labs' technology that extends the shelf life of produce. The jury concluded that Zest Labs proved its claim of "trade secret misappropriation" and found Walmart's misappropriation was "willful and malicious," according to court documents.Walmart vowed to appeal the verdict, which nearly doubles the amount the retailer was ordered to pay Zest Labs following a previous trial.

Walmart owes Zest Labs $72.7 million in compensation for damages caused by Walmart's trade secret misappropriation and $150 million for exemplary damages, the jury decided.
"We strongly disagree with the verdict and believe it's not supported by the facts. Zest Lab's unethical behavior has compromised the integrity of this case from the start. We expect our suppliers to uphold the highest ethical standards and will continue to advocate for fairness and justice," a Walmart spokesperson said in an emailed statement.
Zest Labs originally filed a civil lawsuit against Walmart in 2018, with a jury awarding Zest Labs $115 million in a verdict delivered three years later. An Arkansas federal judge granted Walmart's request for a new trial in late 2023 after finding that Zest Labs withheld relevant evidence in the original trial.
Zest Labs first claimed seven years ago Walmart stole its cold-chain management technology that extends produce shelf life. The company said it demonstrated the technology to Walmart executives in early 2014 and then entered into a confidentiality agreement a few months later. In early 2018, Zest Labs claimed the retailer released a solution called Eden that the company stated "looks, sounds, and functions" like its own produce shelf life solution.
The jury's decision on Wednesday was unanimous and is "one of the largest verdicts in Arkansas history and likely the highest trade secret verdict in the history of the state," according to a press release from Bartko Pavia LLP, the firm that represented Zest Labs.
"This legal victory is a small but crucial triumph for small businesses that often face exploitation by larger corporations, robbing them of the opportunity to bring their innovative solutions to the market," Zest Labs Manager Gary Metzger said in a statement.

During Associates Week — its annual gathering of thousands of employees from around the world — the company made a number of tech-focused announcements, like a new artificial intelligence assistant that it says will help customers shop online and an expansion of its drone home-delivery operation to more cities. The new 350-acre Bentonville campus has a hotel, a food hall, an amphitheater, and massive fitness and child care centers. There are electric bikes to get around. Robots cut the grass and clean the windows. Winding paths, which are open to the public, snake through it all. The idyllic grounds, with more 750,000 native plants, would not be out of place among those of the biggest tech companies in the world. The first building opened in January, and the 12th and final building is slated to open at the end of this year. Walmart (WMT) Gets Price Target Hike to $103 from RBC Capital
Walmart Inc. (NYSE:WMT) is one of the best stocks to buy. On June 9, RBC Capital maintained an Outperform rating on Walmart and increased the target price from $102 to $103. The update came after the firm took part in Walmart's Annual Associates & Shareholders Week held in Northwest Arkansas. In the event, the tone of Walmart's leadership aligned with the impressions from the Q1 earnings call in mid-May. Steven Shemesh, an RBC analyst, observed uniformity in Walmart's messaging and insights from five primary data points during the event. RBC revised its financial model for Walmart to indicate the present foreign exchange rates, while the rest of the model remained unchanged. In the future, RBC Capital forecasts a consistent increase in Walmart's net sales, projecting a 4.3% boost in 2025 and 5% in 2026. These estimates marginally top the consensus figures, which project a growth of 4% and 5% for 2025 and 2026, respectively. Niloo / RBC's expectations for adjusted EPS are also slightly higher than consensus estimates. The firm expects an adjusted EPS of $2.64 for 2025 and $3.02 for 2026, in comparison to the consensus figures of $2.60 and $2.92, respectively. The target price of $103 is derived from roughly 34x the firm's forecasted 2026 adjusted EPS of $3.02, up from the previous estimate of $3.01. The slight change in the target price represents RBC's conviction in Walmart's financial performance and growth potential over the coming years. While we acknowledge the potential of WMT as an investment, we believe certain AI stocks offer greater upside potential and carry less downside risk.
