Costa Mesa dips into ‘CAN' to fill $2.9M budget gap, next year could be worse

To fill a financial shortfall, caused by a slowdown in sales tax receipts, Costa Mesa officials Tuesday approved deferring $2.9 million in public works projects that were included in the the city's 2024-25 budget.
Using the funds earmarked for such projects brings the city out of compliance with a local capital asset needs ordinance also known as the CAN, passed in 2015, which mandates 5% of the city's general fund revenue be set aside to pay for capital improvements.
The CAN ordinance includes an exemption for 'economic downturn, natural disaster, emergency or other unforeseen circumstances,' which the Costa Mesa City Council exercised in a regular meeting Tuesday.
Officials agreed to operate below the 5% threshold to square away $2.9 million remaining from a $3.6 million 2024-25 budget gap and to pay back 'the CAN' over the next five years by building repayments into future budget plans.
But as an even worse economic forecast looms in the foreseeable future — with Costa Mesa finance staff projecting a possible $6.5-million gap between revenue and expenditures in the coming fiscal year — those who helped craft the law warn such waivers set a 'dangerous precedent' for the city's finances.
Talk in council chambers Tuesday largely focused on which improvement projects would be cut, staff having already recommended authorizing the CAN's 'Emergency Exception' clause.
City staff initially put forth a list of 10 projects that could be deferred, amounting to a collective $2,872,776 in savings, including several building and infrastructure upgrades at City Hall, a $450,000 west side restoration project, a butterfly garden and a $400,000 modernization of the Costa Mesa Country Club.
Two other alternatives featured edits offered by the city's Finance and Pension Advisory Committee (FiPAC) — which spared City Hall heating and air handler upgrades but put proposed senior center and sewer line improvements ($250,000 apiece) on the chopping block — and a modification proposed during an April 22 council study session.
Public Works Director Raja Sethuraman said even with the deferrals, this year's list of projects was more than enough to keep department staff busy.
'With the requested deferral of approximately $2.9 million we'll still have 96 projects in our capital improvement projects, with $90 million in projects to be implemented over the next two to three years,' he told the council Tuesday.
While the action taken by the council sews up an immediate fiscal hole, questions still linger about what could happen to the CAN fund next year as an even more protracted slowing down in revenue is projected.
Former Costa Mesa councilmembers and mayors Steve Mensinger and Jim Righeimer issued warnings about dipping into the CAN in a letter addressed to the council and submitted it as a public comment at Tuesday's meeting.
They said the ordinance specifies the capital fund set aside can only be canceled by a declared fiscal emergency.
'What's happening today doesn't follow that legal path,' the pair wrote. 'Instead, the council is trying to reframe a raid on the CAN fund as a 'budget adjustment' or a technical allocation change. That's not honest.
'If you're reaching into the savings account, just say it: you're declaring an emergency. Because by law, that's the only time you're allowed to do this.'
Neither Righeimer nor Mesinger appeared at Tuesday's meeting. But Mayor John Stephens challenged their interpretation of the ordinance.
'We don't need to declare an economic emergency, we just need to declare that there's an economic downturn, which I think there clearly is,' he said. '[And] the language of the CAN ordinance is not entirely clear it has to be an unforeseen economic downturn.'
In addition to proposing the $2.9-million withdrawal be replenished via budgeted payments, Stephens asked staff working on the 2025-26 operating budget to be on the lookout for cost-saving solutions — including using reserve funds, eliminating job vacancies, cutting consultant contracts and a possible repeal of the ordinance.
'We need to be very creative there,' the mayor said. 'That includes putting the CAN ordinance on the table for repealing or amending, and it includes using reserves we've built up and all the other items I mentioned.'

JB Pritzker is focusing on a few big decisions. Will he run for president? Will he seek a third term as governor? And who would his lieutenant governor running mate be if he runs again? Don't expect an answer anytime soon about a presidential run. But in the coming weeks, Pritzker will decide whether to seek re-election. What's next: Democratic candidates for statewide office in 2026 will ask for endorsements from the Cook County Democratic Party during its slating meetings July 17 and 18. As for his No. 2: Even if Pritzker announces he'll go for a third term — and all indications are that he will — we hear he wouldn't name a running mate right away. But that hasn't stopped the buzz about who might step up to the pos that Lt. Gov. Juliana Stratton has held since taking office with Pritzker in 2018. Costa Mesa inks 1-year deal with employee labor groups for $3.5M, citing uncertainty

The Costa Mesa City Council this week approved tentative agreements with its four employee unions, brokering $3.5 million in salary and benefit increases over just a one-year period, due to an uncertain fiscal future both locally and nationally. But one resident and budget hawk warned officials that what is agreed upon this year is sure to be assumed in the years ahead, potentially compounding the cumulative impact to city coffers. Human Resources Manager Kasama Lee told the council during a regular meeting Tuesday city staff had successfully reached agreements after negotiating a $1.9 million deal with employees of the city's police force, represented by the Costa Mesa Police Assn. (CMPA) and the Costa Mesa Police Managers Assn. (CMPMA). Memorandums of understanding were also reached with the Costa Mesa City Employees Assn. (CMCEA) and administrative workers represented in a confidential unit, totaling nearly $1.6 million. All employee groups' prior contracts were set to expire June 30. Employees of the Costa Mesa Police Department, which comprises 130 officers under CMPA and another nine upper-level managers, will receive 4% salary increases beginning July 1, along with a $300 hike in monthly health benefits. Police staff will also receive an additional 2.5% add-on to pre-existing longevity bonus calculations, meaning those who reach their 25-year anniversary will receive 12.5% of their base salary in incentive pay, while those hitting the 20-year mark will get 10%; awards of 7.5% and 5% will be given for employees reaching 15 and 10 years of service, respectively. As an added benefit under the new agreement, CMPD lieutenants will no longer receive holiday pay but will earn additional bonuses, ranging from 5% to 15%, for various Police Officer Standards and Training certification. Captains with the certification will receive 15%, the contract stipulates. Meanwhile, nearly 330 non-police city employees will see bumps in pay and benefits under the agreements approved Tuesday, including an additional $50 per month in health benefits starting in July and $100 increase, effective January 1, 2026. After an initial 2% salary increase, slated to take effect July 1, staff members will see another 2% raise in January and then again in April. The $3.5 million in provisions have been earmarked in Costa Mesa's 2025-26 budget, adopted earlier this month . Lee estimated the agreements would impact next year's budget by an additional $1.5 million. Ralph Taboada, a Costa Mesa resident and member of the city's Finance & Pension Advisory Committee, said Lee's estimation was misleading, since the $1.5-million impact would be compounded on top of this year's $3.5-million increase. He further warned that while the benefits conveyed are only offered for a one-year term, they will likely become a stepping stone to greater benefits, at an even greater cost, in future years. 'A year from now, when subsequent agreements are negotiated, they'll be utilizing the salary and benefits in these contracts for new [ones]. So this $3.5-million impact for 2025-26 is going to carry forward beyond 2025-26.' Mayor Pro Tem Manuel Chavez, making a motion to approve the bargained-for changes, explained the one-year term would allow the city to see how economic changes on the horizon, including declining revenue projections and promised international tariffs at the federal level, might play out. 'I think all parties agree a one-year deal was a good bet to see how everything would turn out these next couple of months,' Chavez said. Mayor John Stephens agreed, recalling contentious periods at bargaining tables of yore, when the city was embroiled in legal battles with labor groups over the outsourcing of some public roles and services. 'We're in a good place with our relationship with our bargaining units — we cannot take that for granted, because it hasn't always been that way,' he said. 'It's a good deal under the circumstances, uncertain circumstances, where we know we're going to need those police officers to keep us safe and we're going to need CMCEA non-safety employees to back them up.'
