In-N-Out former employee files $3-million lawsuit, saying he was fired over his hairstyle

In-N-Out Burger is being sued for at least $3 million by a former employee for alleged racial discrimination involving the employee's hairstyle, according to a Los Angeles County Superior Court filing.
According to the suit, 21-year-old Elijah Obeng, who is Black, said he experienced severe emotional distress after he was unfairly targeted by the burger chain's dress code. The dress code requires its employees to wear company-issued hats with their hair tucked in, and male employees must be clean-shaven, the lawsuit says.
An In-N-Out corporate representative could not immediately be reached for comment on the lawsuit.
Obeng worked at the Compton In-N-Out location for a little less than four years. As his hair grew, he began receiving orders to change his hairstyle so it could remain contained in the company-issued hat. He began wearing braids to comply, but management still took issue with Obeng's sideburns, which he considered important to his cultural identity, according to the lawsuit.
Obeng began to be treated differently at work after resisting the orders to shave, the lawsuit said. Management criticized his work more frequently than his fellow employees, and he was denied opportunities for promotions, according to the suit.
In May 2024, Obeng's supervisor sent him home to shave his sideburns and then return, according to the filing. This was done in front of his co-workers, and he felt 'publicly humiliated,' the suit said.
Obeng did not follow these orders and instead texted his supervisor that he would return for his next shift. A couple days later, he was fired, the lawsuit said.
In-N-Out said the termination was due to prior write-ups, but Obeng believed it to be a discriminatory action in retaliation to his resistance against the dress code policies, the filing said.
The suit said that In-N-Out has allegedly violated the CROWN Act, which stands for Creating a Respectful and Open Workplace for Natural Hair. This California law prohibits employers from discriminating on the basis of an employee's hairstyle or hair texture.
'This policy disproportionately burdened Black employees whose natural hair may not conform to such grooming standards,' the lawsuit said.
In-N-Out's alleged discrimination has caused Obeng 'anxiety, humiliation, and loss of dignity,' the suit said.

The announcement comes on the heels of the CIAA Board of Directors meeting, where another major deal was also finalized: keeping the storied CIAA Basketball Tournament in Baltimore through the end of the decade. For the CIAA and its member institutions, it's more than just a jersey deal. 'Under Armour continues to be a powerful partner in our journey, elevating the look, feel, and performance of our student-athletes while reinforcing our identity across the national stage,' said CIAA Commissioner Jacqie McWilliams Parker. 'We are proud to move forward together with a shared commitment to innovation and impact.' Under Armour's relationship with the CIAA began in 2018 after Russell Athletic exited the collegiate uniform space. Facilitated through BSN Sports, the deal gave CIAA programs exclusive access to UA uniforms, gear, footwear, and training equipment. It was a timely and strategic move, especially as other HBCU conferences were locking in similar partnerships. Since then, Under Armour has not just dressed athletes-they've leaned into storytelling. Their "Sisterhood in Style" campaign, launched earlier this year, spotlighted HBCU women and Black Greek life, featuring members of Alpha Kappa Alpha Sorority, Inc. on the campuses of Bowie State University and Morgan State University. With imagery by Baltimore-based photographer and activist Devin Allen, the campaign tied fashion, culture, and pride together, all wrapped in UA's pink-and-green UA Echo sneaker. This brand of authenticity isn't accidental. Under Armour's headquarters are just minutes from downtown Baltimore, and its ties to the community run deep. Morgan State, a flagship HBCU in Baltimore, has long been a partner institution. The renewed CIAA deal only strengthens the city's connection to both the brand and HBCU sports and culture. So when the CIAA announced that its hoops tournament-an economic and cultural crown jewel for the conference-would stay in Baltimore through 2029, it wasn't just a win for the city. It was synergy in action. A Baltimore-based brand. A Baltimore-hosted HBCU tournament. And a renewed focus on showcasing Black excellence, both on the court and in community storytelling. Beyond the CIAA, Under Armour also outfits HBCUs like Hampton, Howard, and Edward Waters. But this extended commitment with the nation's oldest historically Black athletic conference signals something deeper-a long-term investment in legacy, innovation, and visibility. NEW YORK — Mayoral candidate Michael Blake has secured $2 million in public matching funds approved by the city's Campaign Finance Board — a significant but belated cash infusion for the longshot campaign. With just five days left in the primary race, the new cash influx likely comes too late for Blake, a former Bronx assemblyman, to mount a competitive campaign or significantly raise his profile. Blake's campaign argued in their suit that he had, in fact, met that threshold, and that the CFB's system errors mistakenly made it seem that he hadn't. The candidate garnered some attention with a lively performance at the first debate at the start of June, and climbed onto some endorsement slates after State Sen. Jessica Ramos, another mayoral candidate all but removed herself from consideration when she endorsed Ex-Gov. Andrew Cuomo. He also cross-endorsed Zohran Mamdani earlier this week as part of a broader attempt to block Cuomo from the mayoralty. Blake received 2% of the vote in a recent Marist poll.
