NGT notes Assam's affidavit, says interference not required in Commando Battalion HQ construction

New Delhi, The National Green Tribunal has said that its interference is not required in a matter regarding the alleged illegal permission granted for construction of the second Assam Commando Battalion unit headquarters inside the inner line of reserved forest in Assam's Hailakandi district.
The tribunal disposed of the matter, saying it had received an affidavit from the state government that the project's construction would be confined to less than 20,000 square metres or around 4.94 acres and according to rules, and Environmental Clearance was not required for such construction.
The green body had taken suo motu cognisance of a media report, which alleged that top forest officials of the Assam government had illegally diverted 44 acres of protected forest land for a Commando Battalion Headquarters a project which was being executed by the Assam Police Housing Corporation.
"In the affidavit dated April 25, 2025, the state of Assam has taken the stand that it will confine its construction to 20,000 sqm . For such a construction, EC is not required," said a bench of NGT chairperson Prakash Shrivastava in an order dated May 30.
The bench also comprising judicial member Justice Sudhir Agarwal and expert member A Senthil Vel noted the state government's affidavit, according to which, "The state government is ready to dismantle all the constructions beyond 20,000 sqm and shall not undertake any further construction beyond the said limit, for which no EC is required as per the provisions of the Environmental Impact Assessment Notification of 2006."
The tribunal further noted the affidavit, saying that the state government would apply afresh for an additional 8,233 sqm, if required, and that it would strictly abide by all laws, and unless all clearances were obtained under the existing laws, it would not start any further construction.
"In the above circumstances, we are of the view that no interference in this original application is required. It is accordingly disposed of," the tribunal said.

In a major step towards enhancing transparency in electoral rolls, the Election Commission has zeroed in on plans to undertake intensive and rigorous revision of the electoral data. According to EC sources, the poll body is contemplating carrying out intensive house-to-house verification of electoral rolls for the upcoming Bihar Assembly elections. The move comes on the back of recent controversy, pertaining to the inclusion or deletion of names of electors and allegations by political parties and civil society groups about alleged manipulation and fiddling of data during the process, with an intent to benefit a certain party. The EC has, however, emphasised time and again that it is committed to ensuring that only genuine and eligible citizens are enrolled in the electoral rolls, stating that regular exercise of revision of Electoral Rolls is undertaken annually throughout the country by the EC and also before the holding of elections/by-elections by the EC. Notably, the constitutional and legal frameworks are quite clear when it comes to the addition or deletion of voters from the electoral list. Also, the provisions regarding eligibility and disqualification of any voter are clearly laid down in Article 326 of the Constitution of India and Section 16 of the Representation of the People Act. However, the need for updation (deletion/addition) of electoral rolls arises because of unavoidable reasons like death, migration of electors, addition of new electors, correctional changes for names or photos and rationalisation of polling stations. EC officials maintain that the entire process of updation of the electoral rolls is conducted as per the rules and stipulated guidelines, and also sufficient opportunity is given to political parties to file claims, objections and appeals before the final electoral roll is published. Lately, the poll body has come under attack over changes in electoral rolls, which the political parties claimed were being done arbitrarily and to benefit a certain political outfit. The EC officials have dismissed these insinuations and allegations as absurd, categorically stating that the exercise is conducted with full transparency and under constant scrutiny of political parties. Now, in a bid to reinforce its credibility and instil more confidence in the public, the poll body is reportedly in the process of making the process more robust by undertaking house-to-house verification during the upcoming electoral roll revision before the Bihar Assembly Polls. Such intensive and rigorous revision of the electoral rolls was done in the past also, with the latest being undertaken in 2004. The new drive ahead of the upcoming Bihar elections will seek to reinforce EC's commitment to maintaining electoral vibrancy while debunking false claims of parties, at the same time.

The Kerala High Court has directed the State government to consider and take an appropriate decision expeditiously on a representation given by the All Kerala Akshaya Entrepreneurs Confederation seeking to enhance charges for various online services provided by Akshaya centres, before finalising a revised agreement with the Akshaya entrepreneurs. The directive was passed by Justice N. Nagaresh recently while disposing of a writ petition filed by the federation. The court made it clear that the members of the petitioner shall execute the current agreement and this judgment will not be an excuse for not executing the current agreement. According to the petitioner, the State government has reiterated time and again that all government-to-citizen services shall only be routed through Akshaya Centres. The petitioner also pointed out that every Akshaya entrepreneur has to execute an agreement with the government. It was in 2013 that an agreement was executed with the entrepreneurs for the first time. They were compelled by the authorities to execute unilateral agreements, the petitioner alleged. In fact, various service fees have not been revised since 2018 and a majority of them find the going tough in the face of increased cost of operations. No discussion had been held with the Akshaya entrepreneurs at any point of time despite a detailed representation on this and various other issues faced by the entrepreneurs was submitted to the government.

The Election Commission of India is contemplating intensive door-to-door verification during revision of electoral rolls for upcoming Bihar assembly polls, sources in the Commission said. In past, persistent concerns have been raised often by various civil society organisations, political parties and agencies regarding the inclusion or deletion of names of the electors in the Electoral Rolls. Sanguine about its responsibility, the Election Commission has repeatedly emphasized that it is committed to ensuring that only genuine and eligible citizens are enrolled in the electoral rolls. Regular exercise of revision of the electoral rolls is undertaken annually throughout the country by the EC and also before the holding of elections/bye-polls. Constitutional and legal frameworks are also quite clear and robust in this regard. Provisions regarding eligibility to be registered as a voter and disqualifications for registration in an electoral roll are clearly laid down in Article 326 of the Constitution of India and Section 16 of the Representation of the People Act, 1950. Need for constant updation of electoral rolls arises due to various reasons. 1. A key reason is the migration/shifting of electors: The country continuously witnesses inter-state, intra-state, inter-district and intra-district migration due to marriage, job opportunities, education, family requirements etc. For instance, forms received by the commission in 2024 indicates that 46.26 lakh people shifted residence, 2.32 crore applied for corrections and 33.16 lakh requested for replacement. Thus, in a single year, nearly 3.15 crore changes were required to be made across the country. 2. Deletion of names of dead electors: Generally, number of deletions of dead voters is much lesser than the registered deaths, as families do not approach the ECI for deletion of names of their kin. 3. Addition of names of young electors attaining the age of 18 years. 4. Corrections in elector details such as names/photographs/address 5. Rationalisation of polling stations for various reasons, especially in view of the new limit set by the EC of 1,200 electors per polling station from the earlier 1500 and the Commission's commitment to ensure that no elector has to travel more than 2 km to cast their vote 6. Identification and subsequent deletion names of illegal immigrants. The entire process of updation of electoral rolls is conducted as per the law/rules/instructions of the EC and sufficient opportunity is provided to political parties to file claims, objections and appeals before the final electoral is published. ut in spite of following a detailed protocol, insinuations and allegations are often made against the EC for arbitrarily inflating the electoral roll, even though the exercise is conducted with complete transparency and under constant scrutiny of the political parties. Thus, in order to make the system completely robust and free of any kind of errors, the Commission is contemplating an intensive door-to-door verification during the upcoming electoral roll revision before Bihar assembly polls. Such intensive and rigorous revision of electoral rolls has been done in the past as well. The last such exercise was undertaken in 2004.
