This Los Angeles city official testified for four days so Karen Bass wouldn't have to

If Los Angeles Mayor Karen Bass manages to hold on to her power to oversee the city's homelessness programs, she may well have one person to thank: City Administrative Officer Matt Szabo.
Szabo, a fixture in the administrations of the past three mayors, was effectively the city's star witness in its legal battle against the L.A. Alliance for Human Rights, the nonprofit group that sued the city in 2020 over its handling of the homelessness crisis.
During a seven-day hearing that concluded Wednesday, the alliance pressed U.S. Dist. Judge David O. Carter to take authority over homeless services away from Bass and the City Council and give it to a to-be-determined third party overseen by the court.
On four of those seven days, Szabo sat in the witness chair, defending the city's decisions and occasionally offering cutting remarks about the city's critics. Above all, he insisted the city would meet its obligation to provide 12,915 additional homeless beds by June 2027, as required under a settlement agreement with the alliance.
Szabo, who reports to both Bass and the council, is well known within City Hall for his work preparing the city budget, negotiating with city unions and providing policy recommendations on homelessness and other issues. During his time in Carter's courtroom, he was also a human shield, taking the brunt of the hostile questions and helping to ensure that Bass and others would not be called to testify.
Throughout the proceedings, the city's lawyers lodged hundreds of objections to the alliance's questions, sometimes before they had been fully asked. Carter cautioned them that the rapid-fire interruptions could make things difficult for inexperienced witnesses.
He also made clear that the group did not include Szabo.
'Mr. Szabo,' the judge said, 'certainly is used to the stress.'
The alliance had placed not just Bass but also Councilmembers Monica Rodriguez and Traci Park on its witness list, saying all three had made public statements criticizing the response system. Bass herself called the system 'broken' during her State of the City address in April, a fact highlighted by Matthew Umhofer, an attorney for the alliance.
Those statements, Umhofer said, only reinforce the alliance's argument that the city's homelessness programs are beyond repair and must be placed into receivership.
'The city is not fixing that broken system,' he said during closing arguments. 'It's simply doubling down on that broken system.'
Bass spokesperson Zach Seidl, asked to explain the mayor's use of the word 'broken,' said she was referring to a number of obstacles, including 'an urge from many to return to the old way of doing things that allowed homelessness to explode.'
'But change is happening,' he said. 'Under the Mayor's leadership, we are moving forward.'
The city's newly hired legal team from Gibson Dunn, the law firm that persuaded the Supreme Court to uphold laws barring homeless encampments on public property, sought to amplify that message. They also claimed the mayor and council members were shielded by the 'apex doctrine,' which bars high-level, or apex, government officials from testifying except in extraordinary circumstances.
The city's lawyers offered up just two witnesses of their own: Szabo and Etsemaye Agonafer, Bass' deputy mayor for homelessness programs, saying they were the most familiar with the issues. The alliance initially sought 15.
Agonafer testified for about four hours, highlighting progress made by the mayor's Inside Safe program, which moves people out of encampments and into hotels and motels.
Umhofer ultimately withdrew his subpoenas targeting Bass and the others, saying he didn't want to incur additional delays. But he called Bass cowardly for failing to show up. By then, he said, his team had enough evidence to show that the city's elected officials should no longer control homeless programs.
'We have quite literally put the homelessness response system in Los Angeles on trial,' said Elizabeth Mitchell, another alliance attorney, on the final day of proceedings.
The alliance used much of the questioning to highlight problems at the Los Angeles Homeless Services Authority, also known as LAHSA. That agency, overseen by a board of appointees from the city and county, has been criticized repeatedly in audits dating back to 2001 — documents highlighted by the alliance during the proceedings.
Szabo acknowledged that LAHSA has faced issues with data collection. But he insisted that the city is closely tracking the beds required under its settlement with the alliance. 'We have taken steps to ensure that the data we are reporting is accurate,' he told the court.
Carter, who has yet to rule in the case, did not sound as confident in the city's attention to detail. On Wednesday, he demanded that the city turn over records regarding its compliance with another agreement in the case — this one known as the 'roadmap.' The roadmap agreement, which expires June 30, required the city to produce 6,700 beds.
In his order, Carter raised questions about whether city officials had double counted 'time-limited subsidies' — money used to help homeless people move into apartments and pay their rent — by applying them both to the roadmap requirements and to the obligations within the alliance settlement agreement.
Szabo said city officials are collecting the records for the judge.
Councilmember Hugo Soto-Martínez, whose district includes Hollywood, voiced confidence in Szabo. He also praised Bass for taking on the issue of homelessness, pointing out that LAHSA reported that the city had made progress last year.
'We're doing things that are showing results,' said Soto-Martínez, whose office has participated in 23 Inside Safe encampment operations. 'Is it perfect? No. But we're working through it.'
— ICE RAID OUTRAGE: L.A.'s elected officials voiced their anger on Friday over a series of federal immigration sweeps in Westlake, Cypress Park and other parts of the city. L.A. County Supervisor Hilda Solis said the individuals detained were 'hardworking Angelenos who contribute to our local economy and labor force every day.'
Bass issued her own statement, saying: 'We will not stand for this.'
'As Mayor of a proud city of immigrants, who contribute to our city in so many ways, I am deeply angered by what has taken place,' she said. 'These tactics sow terror in our communities and disrupt basic principles of safety in our city.'
— WELCOME, AECOM: Nearly five months after a firestorm laid waste to a wide swath of Pacific Palisades, Bass announced that the city has hired the global infrastructure firm AECOM to develop a plan for rebuilding the area and reconstructing utilities and other infrastructure. The firm will work alongside both the city and Hagerty Consulting, which Bass tapped as a recovery contractor in February, according to the mayor's office.
— SWITCHING HORSES? Businessman and gubernatorial candidate Stephen J. Cloobeck offered praise for L.A.'s mayor last year, commending her for her work addressing homelessness. He even said he had donated $1 million to LA4LA, an initiative promoted by Bass during her 2024 State of the City address, an event he attended. But last weekend, while making the rounds at the California Democratic Convention, he told The Times he wasn't so keen on Bass' leadership. 'I would support Rick Caruso in a heartbeat over Mayor Karen Bass, and that's a quote,' he said.
— MISSED MESSAGES: Bass has come under heavy scrutiny for deleting text messages she sent during the January firestorms. But she wasn't the only one. L.A. County Supervisor Kathryn Barger, who represents the area devastated by the Eaton fire, has an iPhone that 'auto deletes' messages every 30 days, her spokesperson said.
— ENGINE TROUBLE: Earlier this year, then-Fire Chief Kristin Crowley cited disabled engines, and a lack of mechanics, as one reason why fire officials did not dispatch more personnel to Pacific Palisades before the Jan. 7 fire. NEW YORK — A thicket of court cases and a legal strategy that silences critics will follow Andrew Cuomo into City Hall if he's elected mayor of the nation's largest city. Playing out against the backdrop of the heated New York City Democratic primary that Cuomo has dominated for months is his aggressive legal maneuvering as he continues to deny any wrongdoing in the scandals that pushed him from office. The frontrunner and former New York governor is embroiled in several lawsuits, including two filed by women — a former member of his State Police security detail and an ex-aide — who accused him of sexual harassment. Cuomo signaled his intention to file a defamation suit against a third woman, former aide and accuser Charlotte Bennett. The move came as Cuomo was preparing to enter the mayoral race last year; Bennett described it as effectively muzzling her from talking about her experience. Cuomo's legal tactics have included seeking Bennett's gynecological and therapist records, which his attorney Rita Glavin called a 'pro forma request' made at the direction of a psychiatric expert due to the damages being sought. Glavin said she'd have offered a fulsome response, but is limited by a confidentiality order enforced by Bennett's attorneys. In a separate case filed by former aide Brittany Commisso, Cuomo's attorneys subpoenaed communications with her ex-husband, an Albany politician, that her attorney argued have nothing to do with the case. The ex-governor's legal team has insisted these demands are routine and necessary to mount a robust defense. Complicating matters further for Cuomo, he is reportedly under investigation by the Trump administration after House Republicans referred him for prosecution after accusing him of lying to a Congressional panel investigating his Covid-era policies, a claim he's denied. Cuomo says he's yet to be contacted by the DOJ and has called the probe politically motivated, even though Democrats also raised concerns about his testimony. Taken together, the legal cases surrounding the former governor paint a picture of someone acclimating to the job of running New York City while defending himself in two lawsuits, pursuing a third and potentially responding to a federal investigation. It all comes as he seeks to turn the page on the scandals that led to his political downfall four years ago, with an electoral comeback that would belie the ongoing legal machinations that blossomed following his resignation. The dynamic calls to mind the legal woes of Mayor Eric Adams, whose corruption charges were dismissed after the Democrat cozied up to President Donald Trump. Adams' closeness to the Republican president further tarnished his standing with voters, leading him to forgo seeking the Democratic nomination and run as an independent in November. Cuomo critics assert the legal dramas would hinder his management of the city and create a dynamic similar to the one that has dogged Adams. 'It would take away Cuomo's ability to govern,' Assemblymember Jessica Gonzalez-Rojas said. 'It's why Eric Adams is deeply compromised. We don't need one scandal-ridden mayor replaced with another.' The ex-governor's attorneys have pounced on criticism of him as he attempts his political comeback. Lawyers have admonished their counterparts in harassment lawsuits from publicizing that Cuomo has leveraged a state law to have taxpayers cover his attorneys' fees in some cases, warning that such criticism is 'prejudicing Governor Cuomo's right to a fair trial.' Taxpayers spent $20.3 million to defend Cuomo and several former advisors in three sexual harassment lawsuits, according to a recent tally by the state comptroller's office. Efforts to suppress criticism have crossed into his mayoral bid. His campaign attorney in May sent a 'cease-and-desist' notice to a union backing one of Cuomo's rivals for making inaccurate claims in a political flyer. Some of the notice's concerns — an accusation that the ex-governor is no 'friend' of working people — are standard campaign rhetoric. Cuomo spokesperson Rich Azzopardi pointed to efforts by the Trump administration to investigate or arrest prominent Democrats, including California Gov. Gavin Newsom, New York Gov. Kathy Hochul and Senate Minority Leader Chuck Schumer while opening an investigation into New York Attorney General Letitia James. State lawmakers approved a $10 million pot of money for James' legal bills, he noted. 'Pretending like this nonsense is somehow a different situation is silly and disingenuous,' Azzopardi said. 'Trump will try this with anyone who — unlike Mayor Adams — refuses to bend the knee. These are serious times and New Yorkers know Andrew Cuomo is the only candidate who has the experience and the record of results to fix what's broken and put the city back on the right track.' The former governor has insisted as mayor he would not be beholden to Trump and is best suited to negotiate with the mercurial president given their decades of shared history. He said the allegations against him — sexually harassing 11 women as determined by the state attorney general's report — were 'all political.' The former governor during a televised debate said the allegations never translated to criminal cases, rather 'political fodder for my opponents.' 'Four years later, we've had five district attorneys — Democrat, Republicans, upstate, downstate — nothing has come of them whatsoever,' Cuomo said during the debate. 'There has been one civil case that's been resolved,' he added in reference to Bennett withdrawing her lawsuit last year. 'I was dropped from the case.' Cuomo's scandals have not dented his mayoral prospects, and his rivals have failed to capitalize on the controversies. He entered the race on March 1 and instantly became the leading candidate for the party's nomination after weeks of privately sewing the perception that his victory would be inevitable. But there is some sense his scandals are not far from voters' minds, given his otherwise high negatives, even as most polls show him winning the race. Candidate Zohran Mamdani, however, is gaining on Cuomo in polls, and early voting returns show an increase in participation from younger voters likely to back the 33-year-old democratic socialist Mamdani over the former governor. On Saturday, Cuomo foe Brad Lander appeared with Bennett and several others who accused the ex-governor of harassment, along with a man whose father, a nursing home resident, died of Covid. At least two sexual harassment lawsuits stand to follow Cuomo into City Hall. Commisso sued him in November 2023 after she alleged Cuomo groped her at the governor's mansion. Court papers show Cuomo would sit for a deposition as late as December — weeks before the inauguration of the city's next mayor. Another suit filed by a woman known as Trooper 1 is not expected to conclude this year. As he prepared to run, Cuomo's attorneys moved to sue Bennett, a former administration aide who first accused him of sexual harassment in 2021, claiming she defamed him when making her claims public. Bennett only days earlier dropped her own sexual harassment lawsuit against the ex-governor. Going on the offensive, Cuomo's legal team asserted Bennett's allegations were a key factor in his eventual downfall. 'Bennett's false allegations materially contributed to a cascade of harm to Governor Cuomo,' attorneys for the former governor wrote in an initial court filing. 'Among other things, the false accusations she publicized in the national media were a significant factor in calls for an investigation into Governor Cuomo's conduct.' Cuomo last week did not answer a reporter's questions over whether he would pursue a defamation case against Bennett if elected mayor. Bennett responded on X: 'There have been a lot of discussions about my gynecological records and yet barely any mention of the fact that I STILL am not safe to discuss this personal experience publicly.' Her attorney did not return messages seeking comment. The defamation maneuver stunned advocates for survivors and reinvigorated a push by state lawmakers to pass a law that would make it harder for people accused of sexual harassment to file such cases. The effect of a defamation suit, though, could be far-reaching for Cuomo's potential tenure in City Hall. 'It sets a highly concerning tone for what New York stands for. Imagine how terrifying that would be with him coming back — what does that do to an ordinary person who may come forward?' said Victoria Burke, a California-based privacy attorney who crafted legislation meant to limit defamation suits like the one Cuomo filed against Bennett. 'It would have a chilling effect on anyone who comes forward. He's powerful, he's back, he's not remorseful.' Glavin, the Cuomo attorney, said: 'Everyone is entitled to due process and has the right to defend themself, particularly against demonstrably false allegations.' The Bennett lawsuit, she said, 'fell apart' due to requests for text and video messages 'that disproved her claims' which investigators did not obtain. 'Bennett's claims were virtually worthless, which is why the state eventually agreed to a nuisance settlement. Commisso's lawsuit is headed in the exact same direction — like Bennett, Commisso also withheld from investigators dozens of texts that gut her allegations, which is why her lawyers are now engaged in legal maneuvering to avoid Commisso having to sit for a deposition,' Glavin said. She continued: 'Trooper 1's case — which the New York State Police are also defending against — is likewise in tatters. What you cite are nothing more than routine, pro forma discovery requests that any defendant would make. Moreover, none of these cases involve an order preventing any complainant from talking publicly. If anyone is worried about a defamation claim, it must be because they know their allegations are false. ' Cuomo initially expressed regret when Bennett first came forward in 2021 to describe how the then-governor would ask questions about her personal relationships and sex life while telling her he was lonely. Looking directly into the camera during one of his Covid briefings that shot him to national stardom, Cuomo apologized if he made anyone feel uncomfortable. Out of office, Cuomo has denied any wrongdoing. In legal filings, his attorneys are taking a forceful posture, which extends to lawyers representing the women. Less than a week after Cuomo announced his mayoral campaign, in a letter to the court, Glavin blasted Commisso lawyer Mariann Wang for calling the ex-governor 'an unrepentant sexual harasser' as 'defamatory.' Criticizing Cuomo for receiving taxpayer assistance to defend himself would hurt his chances for a fair trial, Glavin wrote. 'There is nothing improper about Governor Cuomo receiving the state funded defense to which he is entitled to under the law,' Glavin wrote. 'Yet, Ms. Wang seeks to weaponize that fact and taint public opinion by calling Governor Cuomo's appropriate and routine discovery efforts 'vindictive.'' Wang responded that Cuomo would 'surely like' to prevent accusers from speaking about him but 'unfortunately for him, the First Amendment does not allow for such prior restraints on core political speech.'

New York City is using ranked choice voting in its Democratic mayoral primary

NEW YORK -- New York City is using ranked choice voting in its Democratic mayoral primary election Tuesday, a system that takes some explaining, even for New Yorkers who have used it before. Voters' understanding of how ranked choice works could play a role in which candidate comes out on top in a race that features former Gov. Andrew Cuomo, progressive upstart Zohran Mamdani and several other current and former public officials, including City Council Speaker Adrienne Adams and City Comptroller Brad Lander, who was arrested last week at an immigration court. The system is based on a simple premise: Democracy works better if people aren't forced to make an all-or-nothing choice with their vote. Rather than pick just one candidate, voters get to rank several in order of preference. Even if a voter's top choice doesn't have enough support to win, their rankings of other candidates still play a role in determining the victor. The system is more complex than a traditional election, making it tough to forecast a winner. It could also take longer to get results. In New York City's version, voters get to rank up to five candidates, from first to last, on the ballot. If one candidate is the first choice of a majority of voters — more than 50% — that person wins the race outright, just like in a traditional election. If nobody hits that threshold, ranked choice analysis kicks in. Vote tabulation is done by computer in rounds. After the first round, the candidate in last place — the candidate ranked No. 1 by the fewest amount of people — is eliminated. The computer then looks at the ballots cast by people who ranked that candidate first, to see who they ranked second. Those people's votes are then redistributed to their second choices. That process then repeats. As more candidates are eliminated, voters' third, fourth and even fifth choices could potentially come into play. Rounds continue until there are only two candidates left. The one with the most votes wins. Eleven candidates are on the ballot in the Democratic mayoral primary. Incumbent Mayor Eric Adams isn't one of them. He's a Democrat but is running as an independent. The Republican Party has already picked its nominee, Guardian Angels founder Curtis Sliwa. The computerized process of tabulating votes takes little time, but it doesn't start right away. Polls close at 9 p.m. Tuesday. Within a few hours, preliminary results should give a picture of how the candidates are doing based on voters' first choices. The ranked choice tabulations, however, won't start until July 1 because the city needs to wait for the arrival of mail-in ballots. The July 1 tabulation could potentially give a clear picture of who won, but the result won't be official. Further rounds of ranked choice analysis will be done as additional absentee ballots come in until the board certifies the election July 15. This will be the second time New York City has used ranked choice in a mayoral primary. The first time, in 2021, things went haywire when elections officials neglected to clear test data from the tabulation program. That led to an inaccurate vote tally being reported until officials realized the error. Officials are hoping things go smoother this time. One benefit is that nobody 'wastes' their vote by picking an unpopular candidate as their first choice. Voters can rank someone they like No. 1, even if they suspect the candidate doesn't stand a chance. If that person is eliminated, voters still get a say in who wins based on their other rankings. Another benefit is that it's tough for someone to get elected without broad support. In a traditional election, it's possible for someone with fringe political views to win in a crowded field of candidates, even if they are deeply disliked by a majority of voters. That's theoretically less likely in a ranked choice system. A candidate could get the largest share of first-choice votes but still lose to someone who is the second or third choice of a large number of people. The system is tough to grasp. It requires voters to do more research. It also makes races less predictable. Transparency and trust are also potential problems. Ordinarily, candidates, the public and news organizations can see votes coming in, precinct by precinct, and know exactly who is leading and where their support comes from. Under the ranked choice system, the process of redistributing votes is done by computer. Outside groups will have a harder time evaluating whether the software sorted the ranked votes accurately. That's a challenge for news organizations, like The Associated Press, that analyze vote tallies and attempt to report a winner before the count is complete. There may be instances when candidates who seem to have a comfortable lead in first-place votes on election night lose because relatively few voters rank them as their second or third choice. That could lead to people questioning the results.

Newport News' Charter Review Committee is considering several changes to City Council, which could drastically change how city elections are conducted. The main item being considered during the committee's June 12 meeting was the idea of making City Council races partisan, which would create a partisan primary for City Council candidates. State law prohibits party designations in local elections from appearing on ballots. However, it does not prevent the city from creating a partisan primary to ensure the two final candidates that appear on the ballot are implied to be from different parties. 'We have, as it is in Newport News and other cities without partisan elections, large numbers of candidates from one ideological or partisan faction who run for office and split the vote amongst themselves,' committee member Ben Lambert said during the meeting. 'This spoiler effect has been a problem for Newport News elections for a long time.' The committee delayed the vote on whether to recommend the change to City Council to June 26, according to co-chairs Cathy Williams and Lee Vreeland. They also shot down a proposed recommendation that would shift the power to remove department heads from the city manager to the mayor. 'I feel it's overreach for City Council to be involved in that,' Williams said during the June 12 meeting. At its May 22 meeting, the committee approved a recommendation that City Council appoint school board members appointed rather than elected, and a recommendation to make the mayor a full-time position, limited to two terms. Additionally, the questions of considering ranked choice voting came up during last month's meeting. However, the committee opted not to recommend ranked choice voting. Williams declined to comment on the group's discussions surrounding potential charter changes. The committee has been working through these revisions since September, according to Williams, and has received community feedback on several of the proposed changes. The idea of appointed school board members received letters of support, along with while a full-time mayor received pushback. Feedback on ranked choice voting has also been divided.
