Sentencing of man who provided getaway cars for attempted murder deferred
A violent offender who provided the getaway cars used by an organised crime gang in the attempted murder of Dublin criminal Gary Carey went on to terrorise a family during a home invasion while out on bail, a court has heard.
Lawyers for Patrick Fitzgerald (48) – who is known as 'Mr Fishy' - asked the Central Criminal Court on Monday to consider the issue of totality when passing sentence, so as to ensure his prison term will not be 'intolerable'.
Fitzgerald, with an address at Glenties Park in Finglas, Dublin 11, was initially charged with the attempted murder of Mr Carey (35) at Ballyfermot Crescent, Ballyfermot, Dublin 10 on November 17th, 2021 but earlier this month pleaded guilty to facilitating a criminal organisation.
The court heard on Monday that Fitzgerald, who has 72 previous convictions, had issues with drug addiction in the past and had been a 'habitual user of cocaine'.

Last February he was jailed for seven and a half years after a court heard he was part of a gang that invaded a family home in the early morning, terrorising a couple in their 70s, their daughter and a six-year-old child.
In victim impact statements read to the court on Monday on their behalf, Mr Carey's family said they had been left 'devastated' by the attempt on his life.
'In one moment, these people changed our lives forever,' his daughters Shauna and Shanice said.
'From that night we lost our sense of community as we no longer felt safe anywhere,' they said. 'We got nervous when cars pulled up with tinted windows…worrying will these criminals come back? Will they hurt us?'
At a sentencing hearing on Monday, Det Sgt Ronan McDermott from Ballyfermot Garda station told prosecuting senior counsel Ronan Kennedy that on the evening of November 17th, 2021 Mr Carey was in the company of an associate at a house in Ballyfermot Crescent in Dublin.
At around 7.30pm, Mr Carey left the property and got into his car but as he attempted to leave the driveway his path was blocked by a black Opel Zafira with two unidentified occupants.
Ten shots were fired from the Zafira into the windscreen of Mr Carey's car and he sustained two gunshot wounds to his torso.
The victim managed to exit the vehicle, run back through the house and climb over a wall in the rear garden of another property where he remained until gardaí and ambulance crew arrived.
He was brought to St James' Hospital where he underwent surgery and remained in hospital until November 21st.
Having survived the attempt on his life, Mr Carey relocated his family to Spain where he lived for a period of time, the court heard.
Following his return to Ireland there was another attempt on his life on June 24th, 2022 and he died from his injuries on August 5 that year.
Det Sgt McDermott confirmed to counsel that Mr Carey was known to gardaí and it was believed he had 'fallen foul' of an Organised Crime Group (OCG) based in Ballyfermot who were involved in the large-scale sale, supply and distribution of drugs and serious firearm activity.
He said the defendant has 72 previous convictions, including aggravated burglary, false imprisonment, assault causing harm, theft, violent disorder and numerous road traffic offences.
Mr Kennedy told the court that the maximum sentence for an offence of this type is 15 years.
Bernard Condon SC, representing Fitzgerald, said his client had difficulties with drugs in the past and was brought up by his sister after both his parents died when he was a teenager.
Counsel said Fitzgerald worked as a pot washer for a while before he 'began to drift' and his difficulties with drugs began in his late 20s.
Mr Condon said Fitzgerald became a 'habitual user of cocaine' and he struggled with this addiction until 2014, when he got clean and 'life went well' for a period before he relapsed in 2020.
He said Fitzgerald has been doing in prison and was attempting to turn his life around. He said there was no doubt the plea of guilty was of value to the prosecution.
Mr Condon said there was no statutory requirement for the court to make the sentence consecutive to the term Fitzgerald is already serving. However, he said if the court did plan to go down this route, he asked that it consider the issue of totality.
'I would ask the court to substantially deduct from whatever the sentence is so the final sentence would not be intolerable,' he said.
Ms Justice Eileen Creedon adjourned the matter to July 7th.

Male pedestrian (60s) dies after being hit by tractor in Co Clare
A man in his 60s has died after he was hit by a tractor on the L7006 at Kilmurry, Sixmilebridge in Co Clare. Gardaí and emergency services responded to the crash which occurred shortly after 10.15am today. The pedestrian was pronounced dead at the scene. His body has been transferred to University Hospital Limerickand a postmortem will take place in due course. The coroner has been informed and an inquest is expected to take place at a later date. The road is currently closed to facilitate a technical examination by Garda Forensic Collision Investigators. Gardaí are appealing for any witnesses to come forward. Road users with any camera footage who were travelling in the area between 10am and 10.15am today are asked to make it available to gardaí. Man who anally raped woman jailed for five years
A man who anally raped a woman on their first date, despite her telling him repeatedly he did not have her legal consent to do so, has been jailed for five years and three months. Gary Coffey (37), formerly of Leinster Road West, Dublin, was found guilty by a jury of one count of anal rape and one count of sexually assaulting the woman at his home address in January 2023 following a Central Criminal Court trial in March this year. The court heard the victim wished to keep her anonymity and did not wish for Coffey to be named. However, he is not legally entitled to anonymity as there is no link between him and the victim that could lead to her identification. Sentencing Coffey on Thursday, Ms Justice Karen O'Connor said the aggravating factors included that the offending took place in Coffey's home, a place where the victim had been invited and should have been safe. READ MORE The judge noted it was 'important to remember' that consent to sexual activity can be withdrawn. She added the jury heard evidence during the trial that there was consent to certain sexual activity but not to anal sex. The judge set a headline sentence of seven years, which she reduced to six years, having considered the mitigation and Coffey's personal circumstances. She suspended the final nine months of the sentence on strict conditions, including that Coffey place himself under the supervision of the Probation Service for 12 months post-release, and backdated the sentence to when he entered custody in March. The court heard the pair met on an online dating site and had arranged to go for drinks on the evening in question, but Coffey asked the woman to come to his house instead as he needed to shower. Det Garda Seán Carrick told the court the pair had some drinks in Coffey's bedroom as the woman did not wish to meet his mother. They started engaging in consensual sexual activity, but Coffey said he didn't want to use a condom and instead asked the woman if he could have anal sex. The woman refused, saying she had never done this before and had no wish to do so. They had consensual vaginal sex but Coffey kept pestering the woman to let him have anal sex with her. The court heard the woman told Coffey he did not have legal consent to have anal sex with her, later telling gardaí she could not have been clearer in relation to her wishes. At one point, when Coffey went to the bathroom, she got dressed, but Coffey told her she couldn't leave and persuaded her to come back to bed. While there, he anally raped her with his finger. The woman was terrified, and Coffey had his arms around her chest to the point where she felt like she was choking. She managed to escape the bed and left the house quickly. She blocked Coffey on the dating website and WhatsApp, and when he phoned her repeatedly, she blocked his number. She contacted the rape crisis centre and gardaí shortly afterwards and was taken to a sexual assault treatment unit. When Coffey's home was searched, gardaí found five tasers and a quantity of cannabis. He was convicted of these offences and has a total of eight previous convictions, the court heard. In his plea of mitigation, Seamus Clarke SC, defending, said a psychological report prepared for the court indicated that Coffey potentially had a form of autism and attention deficit hyperactivity disorder in addition to mental health issues. Mr Clarke told the court Coffey now accepts he was wrong and didn't have the woman's consent, despite the fact that the probation report concluded that while he accepts the jury's verdict, he is not accepting responsibility for the rape.
