Not a whistleblower if complicit, says MACC of third man to be charged in Sabah mining scandal

Malay Maila day ago

KUALA LUMPUR, June 19 — The Malaysian Anti-Corruption Commission (MACC) has confirmed that the individual set to be charged alongside two Sabah assemblymen in connection with a corruption case involving mineral mining licences is not protected under the Whistleblower Protection Act 2010.
Its Legal and Prosecution senior director, Datuk Wan Shaharuddin Wan Ladin, said Section 11(1) of the Act clearly states that anyone involved in the offence they report is not eligible for protection.
'If a person is involved in the wrongdoing, they are not protected under the Act and therefore cannot be considered a whistleblower,' he told Bernama yesterday.
He said to qualify for protection, a report must be made in good faith to a recognised enforcement agency such as the MACC, the Royal Malaysia Police (PDRM), or other authorised government bodies.
'Reports made with malicious intent, such as to seek revenge or defame others, do not meet the criteria for protection,' he added.
Wan Shaharuddin also stressed that a key requirement under Section 11(1) is that the whistleblower must not be complicit in the wrongdoing being reported. If found otherwise, any protection granted may be revoked.
'This is to preserve the integrity of the whistleblower framework and prevent it from being misused as a 'shield' by those trying to escape accountability,' he said.
Earlier, the individual's lawyer claimed his client was a whistleblower who had cooperated with authorities but was later informed he would be charged in court on June 30.
Recently, several video clips allegedly featuring conversations involving certain individuals and Sabah elected representatives discussing corrupt practices linked to mineral mining activities went viral on social media.
Previously, MACC chief commissioner Tan Sri Azam Baki confirmed that two Sabah assemblymen and another individual are expected to be charged in court this month in connection with the scandal. — Bernama

Former Masterchef finalist, ex-husband jailed 34 years for maid's murder

Ambree Yunos and his lawyer, Ram Singh, at the Kota Kinabalu High Court. PETALING JAYA : A Masterchef Malaysia finalist and her former husband have been sentenced to 34 years in jail after they were found guilty by the Kota Kinabalu High Court of killing their domestic worker in 2021. Etiqah Siti Noorashikeen Sulang's former husband, Ambree Yunos, was also sentenced to 12 strokes of the rotan while she was exempted because of her gender, Sabah Media reported. Etiqah Siti Noorashikeen Sulang. Justice Lim Hock Leng ordered their prison sentence to commence today. Ambree, a contractor, and Etiqah were charged with killing Nur Afiyah Daeng Damin, 28, at their condominium unit in Penampang between Dec 8 and Dec 11, 2021. They were charged under Section 302 of the Penal Code, which provides for the death penalty, or 30 to 40 years' jail, and no fewer than 12 strokes of the cane, upon conviction. Lim said the defence had failed to raise reasonable doubt against the prosecution's case. He said the prosecution had proven three key elements – that the victim died from her injuries, that the injuries were caused by the two accused with intent, and that the pair had acted with a common intention. During sentencing, deputy public prosecutor Dacia Jane Romanus sought the death sentence, saying the case had shocked both Sabah and the nation, and that it warranted the heaviest penalty possible. Dacia said the deceased was a young woman who had left her hometown for honest work amid the pandemic, but ended up losing her life at her workplace. She said the victim suffered daily and was denied her basic human rights. Ambree and Etiqah, who were represented by lawyers Ram Singh and Rakhbir Singh, were previously out on bail.

Sungai Kapar Kechil pollution caused by lorry dumping waste, says exco

The water at Sungai Kapar Kechil in Kapar, Klang, has turned dark blue after a lorry dumped waste into it, said the Selangor government. (Facebook pic) PETALING JAYA : Waste dumped into Sungai Kapar Kechil in Kapar, Klang, is believed to have caused the pollution which has turned the water dark blue. Jamaliah Jamaluddin, who heads the public health and environment committee, said checks by the state's water management authority (Luas) at the river mouth and upstream showed no source of water pollutants. 'Based on information by the complainant and an inspection carried out, we suspect the river was polluted by a lorry dumping waste into it,' she said in a statement, adding that it was a 'one-off' occurrence. She said Luas has since taken samples at the site as well as at the river mouth and upstream, which will be sent to the chemistry department for analysis. 'But we will be monitoring the site from time to time to ensure no recurrence,' she said. Jamaliah advised the people to be alert and report any suspicious activities to the authorities. 'We need everyone to play their part to ensure that Selangor's rivers and water sources remain clean, safe and sustainable,' she said.
