
LLM degree holder fails bar test, HC sends notice to BCI

AHMEDABAD: Gujarat high court Tuesday issued notice to the Bar Council of India (BCI) after a master's degree holder in law failed the All India Bar Examination (AIBE), which is essential for a law graduate to clear in order to become a lawyer.
The AIBE follows an open book format designed to evaluate fundamental legal knowledge and establish a minimum competency benchmark for entry into the legal profession, alongside assessing candidates' analytical abilities.
HC issued the notice after the candidate alleged lack of transparency in AIBE, as the body did not provide any justification for her failure, even after re-checking.
The petition was filed by Urvi Acharya, who holds an LLM degree in criminal law.
She appeared in the AIBE in Dec 2024 and was declared failed. She refused to accept the result and requested a re-checking. Even after re-checking, the department in BCI that conducts the AIBE conveyed that she failed the test.
Acharya's counsel, advocate Pratik Jasani, told the court that seven of the 100 multiple-choice questions were officially withdrawn post-exam, which should have reduced the total score to 93, with the passing marks revised from 45 to 42.
Jasani contended that the petitioner was a bright student and she passed her LLM in criminal law with first class. She attempted all 100 questions, and with seven of them being withdrawn, she ought to have been awarded grace marks. However, the authority did not make this clear.

HC initiates PIL on ‘tree felling' by a realtor in Gurugram
The Punjab and Haryana high court has initiated suo motu public interest litigation (PIL) on a news report about environmentalists and locals opposing reported felling of trees in Gurugram by a realtor. The report carried on June 12 by an English daily had stated that residents and environmentalists have launched protests over allegations of the process of felling of nearly 2,000 trees on an estimated 40 acre of land in DLF Phase 5 in Gurugram. The report said representatives of the Aravali Bachao Citizen's Movement also staged a protest outside a Haryana minister's residence and have also written to chief minister Nayab Singh Saini and union minister for environment for their intervention. The report had also quoted a senior officer of forest department of Haryana government claiming that it was not a forest land and was owned by the DLF for years. The HC vacation bench of justice Anil Kshetarpal and justice Aman Chaudhary while issuing notice for June 26, said that the issue raised in the petition was being taken up as PIL and listed it for June 26 for responses from the commissioner, municipal corporation, Gurugram and managing director, DLF Limited.

Court rejects journalist Gautam Navlakha's plea, says he can't permanently stay in Delhi
MUMBAI: Observing that "permanently residing outside the court's jurisdiction is a completely separate matter from merely travelling beyond it", a special NIA court on Thursday rejected a plea by journalist Gautam Navlakha, an accused in the Elgar Parishad case, seeking permission to permanently reside in Delhi. Citing financial strain, unemployment, and an ailing 86-year-old sister, Navlakha moved the plea in April. "Since HC has not granted such liberty either to the accused or to this court as well, this unnecessary application deserves to be rejected," the judge said. Court said Bombay HC, while imposing conditions on the accused and releasing him on bail, directed him "not to travel outside the jurisdiction of the court without prior permission of the trial court." Navlakha, who was initially granted bail in 2023 but released from custody in 2024, is residing in Bandra (West). The plea said the 72-year-old and his partner, Sahba Hussain (73), are permanent residents of Delhi, where they have their home, employment, and social connections. Prosecution strongly opposed the plea. "Over time, it has become uneconomical and burdensome for him to cope with the increasing finances. He has been struggling to meet up with the basic necessities such as house rent, bread and butter, travel, etc. Both of them are surviving out of their savings," the plea said. Navlakha was arrested in Delhi on April 14, 2020, and has been living in Mumbai since release. Court directed NIA to submit its reply.

Day after rapping Tamil Nadu, Supreme Court says ADGP's suspension is in order
Representative Image NEW DELHI: A day after intensely questioning Tamil Nadu's decision to suspend additional DGP H M Jayaram being probed for his role in an alleged kidnapping of a youth, Supreme Court Thursday found M K Stalin govt's administrative step well couched in All-India Service Rules that governs IPS officers. On behalf of TN, senior advocate Siddharth Dave told a bench of Justices Ujjal Bhuyan & Manmohan that Jayaram's suspension was not influenced by Madras HC's order to arrest him in the alleged kidnapping case, in which it was alleged that his vehicle was used to whisk away the teen from his home after his brother married a woman of another caste and her parents lodged a complaint. Dave said AIS empowers a state govt to place an IAS or IPS officer under suspension if he is being investigated or facing trial in a criminal case. "We did not want to give the impression that the law will be applied differently to high-ranked officers. Once the probe is complete, and depending on its outcome, a decision will be taken on whether to continue the suspension or revoke it," he said. While staying the HC order for action against Jayaram, the bench said though it would not interfere with the suspension order, it was open to the IPS officer to challenge its legality in an appropriate forum. It also requested the Madras HC chief justice to assign hearing of the cases related to the kidnapping incident to a judge other than the one who had passed orders for action against Jayaram. On Monday, HC's Justice P Velmurugan directed police to arrest Jayaram saying "a strong message should go to public that no one is above law". This order was passed during the hearing of an anticipatory bail plea of MLA K V Kuppam, who is also an accused in the case. HC had refused relief to the MLA and ordered him to cooperate with the investigation into the kidnapping case.
