15-day trial set for Vivy Yusof, husband over RM8mil CBT charge
KUALA LUMPUR: FashionValet Sdn Bhd founders Datin Vivy Sofinas Yusof and her husband Datuk Fadzarudin Shah Anuar, are set to go on a 15-day trial next year on charges of criminal breach of trust (CBT) involving RM8 million in investment funds from Khazanah Nasional Bhd and Permodalan Nasional Bhd (PNB).
Sessions Court judge Rosli Ahmad today granted to the mutually agreed dates set between deputy public prosecutor Datuk Wan Shaharuddin Wan Ladin and the couple's lawyer, M. Athimulan.
The trial dates are from April 13 to 17; May 18 to 22 and June 8 to 12.
Wan Shaharuddin said about 26 prosecution witnesses are set to testify.
Athimulan requested a later mention date to enable them to prepare for their defence and to get further instructions from the couple after going through forensic reports.
Both Vivy Yusof, 38, and Fadzarudin, 37, were not present in court as their attendance had been exempted.
Rosli set Oct 27 for mention.
In December last year, the couple claimed trial to a charge of having the common intention to commit CBT as directors of FashionValet Sdn Bhd, entrusted with investment funds from government-linked investment companies, Khazanah Nasional Berhad (Khazanah) and Permodalan Nasional Berhad (PNB), totalling RM8 million.
They are alleged to have fraudulently made an RM8 million payment from FashionValet's bank account to 30 Maple Sdn Bhd without approval from FashionValet's board of directors.
30 Maple, which runs the luxury headscarf brand, dUCK, is owned by the couple.
The alleged offence took place at the Public Bank Berhad branch in Bukit Damansara on Aug 21, 2018.
If convicted under Section 409 of the Penal Code read with Section 34, the couple faces a jail term or not less than two years and up to 20 years; with whipping and a fine.
In January this year, the couple claimed trial to an alternative charge of jointly and dishonestly misappropriating RM8 million of FashionValet's investment funds from Khazanah and PNB at the same bank and date.
The charge under Section 403 of the same code read with Section 34, carries a jail term of between six months and five years, whipping and a fine upon conviction.

Marang police arrest six in drug raids across district
MARANG: Police have arrested six men suspected of being involved in drug trafficking during four separate raids across the district last week. District police chief Superintendent Mohd Sofian Redzuan said the first arrest involved three men who were detained on June 16 at a house in Kampung Gunung Kasim, Merchang. "All three suspects, aged between 30 and 36, tested positive for methamphetamine. Two of them have prior drug-related records. Police seized 57.1g of amphetamine pills worth RM3,500 and confiscated a Honda Wave motorcycle valued at RM10,000," he said. The third raid took place on June 21 in a forested area of Kampung Batangan, resulting in the arrest of a 34-year-old man. "The suspect, who has three prior drug-related records and also tested positive for methamphetamine, was found in possession of 219.36g of drugs worth approximately RM8,000. "Police also seized a Honda EX5 motorcycle worth RM3,000. He has been remanded from June 22 to 28," said Mohd Sofian. The most recent arrest was made on June 22 in Kampung Wakaf Dua, Bukit Payung, involving a 36-year-old man. "Urine tests confirmed he was positive for methamphetamine. Police confiscated 51.59g of amphetamine pills and 4.62g of heroin, valued at RM1,400," he said. All cases are being investigated under Section 39B of the Dangerous Drugs Act 1952. "The total value of drugs seized across the four raids is estimated at RM16,400, while the vehicles confiscated are worth RM23,000. "All suspects are either self-employed or manual labourers. For the record, from Jan 1 to June 22, Marang police have seized drugs worth RM483,417," he added.

The sentence was handed down at the Kota Kinabalu High Court by Judge Datuk Dr Lim Hock Leng, who in his judgment stated that both accused were found guilty of murdering Nur Afiyah Daeng Damin, 28, who worked as their domestic helper at a condominium in Penampang between 8 and 11 December 2021. Lim stated that the prosecution had proven the case beyond a reasonable doubt, while the defence failed to raise any doubt regarding the charges. He also said the prosecution successfully proved the important elements, including that the victim died as a result of injuries; the injuries were inflicted by the accused with intent under Section 300(c) of the Penal Code; and both acted with common intention. Court's Sentencing Rationale In passing sentence, the court emphasised that although both defence lawyers made earnest appeals, the cruelty experienced by the victim could not be ignored. The court also took into account the type of injuries and how they were inflicted over an extended period of time. Earlier, both accused were convicted under Section 302 of the Penal Code, which provides for the death penalty or imprisonment of not less than 30 years and not more than 40 years, and if not sentenced to death, shall be punished with caning of not less than 12 strokes.
