A two-judge vacation bench of the Allahabad High Court has come down on the Uttar Pradesh government over a delay in disbursing ex-gratia compensation to the families of those who died in a stampede at the Maha Kumbh in Prayagraj on January 29.Hearing a petition filed by one Uday Pratap Singh, a bench of Justices Saumitra Dayal Singh and Sandeep Jain said once the government had announced compensation, it was its "bounden duty" to ensure timely and dignified payment.advertisementThe court also expressed concerns over the body of a stampede victim being handed over to her family without any autopsy or postmortem conducted in a state-run medical college.
"It is alarming that the state authorities appear to have handed over the body of the wife of the petitioner to his son on February 5, 2025. Four months have passed and no part of the ex-gratia compensation announced by the state has been offered to the petitioner," the court said.The chief standing counsel submitted that since the petitioner has not raised that claim, the stage has not arrived for it to be considered.The court said, "Prima facie, we find the stand taken to be untenable and smacking of apathy to the plight of the citizen. It was the bounden duty of the State to pay compensation to the aggrieved families with the utmost grace and dignity."advertisement"Once the identity of the family of the deceased was known to the state, it appears to be a pretence and an excuse on part of the state to ask the aggrieved family who had come from far-off places to beg for money from the state for the irreversible loss suffered by the petitioner, certainly not on account of any fault committed by the deceased," the court added."The state remains the trustee of its citizens. It is not only obligated to protect their lives and keep them safe from avoidable losses, it remains obligated and duty-bound to offer remedies and care where such unintended loss may be suffered. It is undisputed that the management of the Kumbh Mela was in the hands of the state and no other authority," the bench said.In its order passed on Friday, the court directed the state authorities to file an affidavit disclosing full details of the total number of claims received for the payment of ex-gratia compensation; the number of claims decided and pending, together with the dates of receipt of such claims with minimal details of the claimants as also the date of their disposal.The court directed for the impleadment of multiple medical institutions and authorities in Prayagraj as parties to the petition and asked them to file affidavits disclosing all deaths and the details of the medical handling of victims between January 28 and the conclusion of the Maha Kumbh.advertisementAccording to the facts of the case, the petitioner's wife was injured in the stampede and was initially believed to be missing. Later, her body was handed over to her son from the mortuary of the Motilal Nehru Medical College in Prayagraj on February 5.The inquest report and the post-mortem or autopsy report were not prepared at that stage. The Supreme Court has concluded that the use of the Uttar Pradesh Gangsters Act — a law meant to counter organised crime — in a solitary case of communal disturbance caused by an 'incendiary' social media post, amounts to a misuse of the stringent penal law. The recent judgment, authored by Justice Sandeep Mehta, came after the court heard an appeal filed by people accused under the State law for mobbing and vandalising the business establishment of a man who posted content derogatory to a particular religion on social media. 'When juxtaposed with the object and intent of the U.P. Gangsters Act, which was enacted to combat organised gang-based crime and dismantle criminal syndicates that pose a persistent threat to public order, the application of the Act to the appellants based on a single incident of communal violence flaring up from an incendiary post made against a particular religion represents a significant departure from its legislative purpose,' Justice Mehta wrote. 'Colourable exercise of power' The judgment said the application of the Gangsters Act in the current case bore the 'hallmark of colourable exercise of power for purposes extraneous to the Act's legitimate objectives'. The court reminded the State government of Article 21 of the Constitution that 'no person shall be deprived of life or personal liberty except according to procedure established by law'. Justice Mehta observed that the procedure prescribed by law must be fair, just, reasonable, and not arbitrary, presumptive, or oppressive. The constitutional guarantee of personal liberty acquired even greater significance when an 'extraordinary legislation with stringent provisions' like the U.P. Gangsters Act was invoked by the State, he said. 'The power conferred upon the State cannot be wielded as an instrument of harassment or intimidation, particularly where political motivations may be at play,' Justice Mehta emphasised. 'Need solid evidence' Extraordinary penal provisions, particularly those that substantially abridge regular procedural safeguards like the U.P. Gangsters Act, must be invoked only if the evidence met a threshold of credibility and substantiality. 'The materials relied upon must establish a reasonable nexus between the accused and the alleged criminal activity… When a statute creates serious fetters on personal liberty, the evidentiary foundation for its invocation must be commensurately strong, supported by concrete, verifiable facts rather than vague assertions,' the top court held. Quashing the FIR and allowing the appeal, the court said the case failed to meet the 'essential threshold' required to invoke the Gangsters Act. It had rested 'largely on presumptive theories rather than presenting tangible material to establish the probability that the appellants were engaged in organised criminal activity,' the court said.

A 29-year-old man was arrested for allegedly misbehaving with a woman on board a State-run bus in Thrissur, the police said on Saturday. The accused Savad, a native of Vadakara in neighbouring Kozhikode, was taken into custody from Tamil Nadu on Friday and his arrest was recorded, the East Police here said. Savad was arrested and jailed in a similar case two years ago for allegedly flashing and misbehaving with a woman passenger on board a moving bus in Ernakulam district. The fresh incident happened on June 14 on board a Malappuram-bound Kerala State Road Transport Corporation (KSRTC) bus. The police said, as per the woman's complaint, the accused had touched her with sexual intension and behaved in an inappropriate manner. As she protested, Savad alighted the bus midway and escaped. The victim later lodged a complaint with the East police, which launched a man-hunt to trace him. The arrest was recorded under various sections of the BNS, including Section 75 (sexual harassment), police added. In the earlier incident, Savad had been accorded a reception by the All Kerala Men's Association when he was released on bail, which had invited widespread criticism two years ago.
