Bombay HC stays interim order in domestic violence case, subject to ex-minister depositing 50% maintenance amount
The Bombay High Court on Thursday granted an interim stay on a trial court order that directed a Nationalist Congress Party (NCP) leader and former minister to pay monthly interim maintenance to his estranged partner in a domestic violence case. However, the high court said that the stay is subject to his depositing the 50 per cent amount awarded in favour of the estranged partner in the court.
The high court will hear the leader's plea after eight weeks.
A single-judge bench of Justice Manjusha A Deshpande was hearing the NCP leader's plea, argued through advocates Shardul Singh and Sayali Sawant, that challenged an April 5 sessions court order that rejected his appeal against an interim order by a magistrate directing him to pay Rs 1.25 lakh to his estranged partner and Rs 75, 000 to their daughter.
On February 4, a magistrate court in Bandra had partly allowed the woman's plea and ordered interim maintenance. The magistrate had observed that there was a prima facie proof of domestic violence against the former minister.
However, the ex-minister approached the sessions court, challenging the magistrate's order. He claimed that he had never married the woman, and as the domestic relationship between them had ceased to exist, she could not file a plea under the Protection of Women from Domestic Violence Act.
The sessions court, while rejecting the leader's appeal, had noted that he and his estranged partner and their daughter 'are entitled for the same lifestyle which is being enjoyed by the appellant. Even if it is presumed that respondent (estranged partner) is earning, she is also entitled for maintenance to maintain their lifestyle as of the appellant (NCP leader)'.
Aggrieved by the same, the NCP leader approached the high court, claiming that documents relied upon by the respondent woman were 'fabricated and forged', and he had filed a police complaint regarding the same, and therefore the trial court order based on the same was 'erroneous'.
The petitioner further claimed that the woman had a substantial income, which is reflected in her earlier election affidavit, which the trial court failed to consider. He added that he was not contesting the maintenance amount granted in favour of the daughter.

Criminal wanted in double murder case shot dead in encounter: Police
The Firozabad police on Friday gunned down a criminal wanted in connection with a double murder case. Police said the accused carried a bounty of Rs 50,000 on his head. Police identified the deceased as Raju Khan, a resident of Shahganj in Agra. A pistol and several cartridges were recovered from his possession, police claimed. Superintendent of Police, Firozabad, Saurabh Dixit, said the accused was a 'habitual offender who often targeted vulnerable persons.' According to the police, they got a tip-off about the accused's presence at an under-construction house on Puratan Road, where he was reportedly hiding and planning a dacoity. A team was dispatched and the area was cordoned off. Police claimed that Khan was urged to surrender but he opened fire at the team. The police retaliated and he suffered bullet injuries. He was taken to a hospital, where he died during treatment, said police. Khan had been accused of barging into the house of one Munna Lal Yadav in Bansinagar with the intention to loot. Munna Lal and his wife Mithlesh were asleep at an open plot located next to their house. According to the police, Khan murdered Lal and his wife before fleeing with valuables. In another incident on the intervening night of June 14 and 15, a group of persons allegedly attacked and injured an elderly woman, Suraj Mukhi, at her residence during a robbery attempt. Police examined CCTV footage from near both crime scenes and found that the modus operandi in both cases was similar. Based on this and other evidence, the accused was identified as Khan. Investigations revealed that he used to travel from Agra to Shikohabad in Firozabad using rented vehicles. After committing the crimes, he would return to his residence, police said.

Delhi govt considers studying Dharavi model for slum redevelopment
New Delhi: Chief minister Rekha Gupta on Friday said Delhi govt is considering studying Mumbai's Dharavi model for slum redevelopment in the national capital. Gupta also claimed that some people were spreading misinformation regarding the demolition of slum clusters in Delhi. "If you construct a house near a railway line, the chief minister will not save you. I urge people to think about safety and security. If a railway accident happens or someone dies on railway tracks, who will be responsible?" she said. Gupta said that demolishing houses was not her govt's aim. "But it should not happen that we keep on giving homes and people do not vacate slums," she added. The CM said her govt is likely to study the Dharavi model for the redevelopment of 675 slum clusters in Delhi. When asked about the anti-corruption branch's summons to former Delhi minister Manish Sisodia in the classroom construction case, she said: "Everyone will have to face the music. The chief minister said that drainage, sewer, road and green infrastructure work are under way in various parts of the constituency, including Haiderpur, Ambedkar Colony and Shalimar village. Notably, these include the construction of central verge crash barriers from Prembari Bridge to Kasturba Polytechnic, Pitampura, as well as the construction of boundary walls from Singhpur Canal to Ring Road, at the vacant land adjacent to Kasturba Polytechnic, and near Singalpur village. These border infrastructure projects have a combined estimated cost of Rs 30 lakh. The boundary wall from Shalimar Chowk to near Fortis Hospital in BB Block is being raised at a cost of Rs 12 lakh.
