Batu Kawa carwash worker who misappropriated customer's SUV gets jail, caning

KUCHING (June 13): The Magistrates' Court here today sentenced a carwash employee to 15 months in jail and one stroke of the rotan for dishonestly converting a vehicle entrusted to his care for his own use.
Magistrate Mason Jaro Lenya Barayan convicted Muhammad Hafis Sulaiman, 27, on his own guilty plea to the offence punishable under Section 406 of the Penal Code.
The Section stipulates for a prison sentence of up to 10 years, and with caning, as well as a fine, upon conviction.
Muhammad Hafis committed the offence at a carwash in MJC Batu Kawa here on May 31.
According to the facts of the case, the car owner sent his sports utility vehicle (SUV) to the carwash for a thorough interior and exterior cleaning.
Muhammad Hafis told the complainant to leave the SUV for about a week at the shop.
Upon returning a week later, the owner discovered the SUV was missing.
The carwash manager then informed the complainant that Muhammad Hafis had driven the vehicle away and failed to show up for work for three consecutive days.
Further investigation revealed that Muhammad Hafis had driven the SUV to Kampung Sibakar, Jalan Puncak Borneo, Padawan, which is near the Sarawak-Indonesia border.
He also admitted to advertising the vehicle on WhatsApp for RM3,000, but later removed the message.
A police line-up confirmed that Muhammad Hafis was the individual who had driven the vehicle away.
He was not represented by legal counsel.

Investigations by the district police headquarters' Criminal Investigation Department found that the victim had been involved in an altercation in front of a fast-food outlet in Bandar Baru Nilai. "The victim is believed to have been attacked with a parang and a wooden stick by several unidentified individuals. "He is currently in stable condition, with injuries to his head and legs," he said. Preliminary investigations found that the fight did not involve elements of gangsterism, personal vendettas or previous conflicts. "It is believed to have been triggered by a spontaneous altercation while all parties involved were intoxicated. "This led to a misunderstanding, provocation and a physical fight," he said. He said the case is being investigated under Section 148 of the Penal Code for rioting with weapons, Section 427 for mischief and causing damage, and Section 326 for voluntarily causing grievous hurt with a weapon.

The Malaysian Border Control and Protection Agency (AKPS) said in a statement today that the animals were found inside the 34-year-old suspect's luggage. He was a passenger on a Batik Air flight bound for Mumbai, India, scheduled to depart Friday night. 'The suspect was detained on the spot and taken to the Aeropolis police headquarters for further action,' the statement said. AKPS said the gibbons have been handed over to the Department of Wildlife and National Parks of Peninsular Malaysia (Perhilitan) for investigation and further action. The case is being investigated under the Wildlife Conservation Act 2010 and the International Trade in Endangered Species Act 2008.
