MACC secures RM4.5mil forfeiture linked to 1MDB from Swiss bank account

PETALING JAYA : The Malaysian Anti-Corruption Commission has secured the forfeiture of US$954,299.58 (RM4.5 million) from a Swiss bank account linked to the misappropriation of 1MDB funds.
MACC said the Kuala Lumpur High Court allowed the forfeiture today after the deputy public prosecutor informed the court that there were no objections or claims made by any party during the proceedings.
'Justice K Muniandy granted the application to forfeit the funds held in a BSI Bank account in Switzerland under the name of Derivale Ltd, whose beneficiary is Azlin Alias,' it said in a statement.
The forfeiture was carried out under Section 56 of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
According to MACC, this marks the first successful forfeiture of overseas assets without involving prosecution.
It said the funds will now be transferred to the government as part of ongoing recovery efforts related to the 1MDB scandal.
Last month, MACC chief Azam Baki said repatriating assets linked to 1MDB remained a difficult process as many of these stolen assets were located overseas.
He said the complex nature of the case made international cooperation crucial, especially when it came to tracing and retrieving funds that were siphoned into multiple countries.
Azam also said Malaysia lost an estimated RM277 billion to corruption between 2018 and 2023 – an average of RM55 billion a year – describing the amount as 'very alarming'.

AGC Rejects Claims Of 'Flawed Prosecution' After Najib's DNAA In Second SRC Case
KUALA LUMPUR, June 20 (Bernama) -- The Attorney General's Chambers (AGC) has dismissed as baseless allegations that it carried out a 'flawed prosecution' in the second SRC International Sdn Bhd case involving Datuk Seri Najib Tun Razak. In a statement, the AGC reiterated its firm commitment to upholding the rule of law and stated that it would continue to fulfill its responsibilities under the Federal Constitution with integrity, fairness and respect for the judicial process. However, the AGC acknowledged the decision by High Court Judge K Muniandy to grant Najib a discharge not amounting to an acquittal (DNAA) on three charges of money laundering involving RM27 million in funds from the company. 'The case was registered in the High Court on Feb 7, 2019, and scheduled for trial on five occasions: June 2020, July to August 2021, March to April 2022, September 2024 and April to May 2025. 'However, all trial dates were postponed due to the Movement Control Order caused by the COVID-19 pandemic, requests by the defence, or applications by the prosecution itself,' the statement read. According to the statement, the prosecution's requests for postponement were due to the ongoing trial of the first SRC case, which proceeded at the High Court, Court of Appeal and Federal Court until its completion on March 31, 2023. At the same time, the trial proceedings for the 1Malaysia Development Berhad (1MDB) case had also begun while the first SRC case was still ongoing. 'Both cases involved overlapping material documents required for the second SRC trial. 'As these documents were critical to the second SRC case, the prosecution had no choice but to wait until they were available, which was until the 1MDB trial proceedings were completed. 'It must be emphasised that the material documents are available but are currently being used as evidence in the ongoing 1MDB trial,' the AGC said.

Govt Procurement Bill to bolster anti-graft measures
PUTRAJAYA: The Government Procurement Bill, scheduled to be tabled in Parliament this year, is expected to strengthen punitive legal action against parties found guilty of offences related to government procurement. The bill also aims to establish a specific legal framework to regulate the government procurement process, in addition to detailing the powers of stakeholders and enhancing check-and-balance mechanisms to ensure good governance in line with international best practices. The proposal and draft structure of the bill were presented by the Government Procurement Division of the Ministry of Finance, led by its secretary Datuk Norison Ramli, during an engagement session with Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Tan Sri Azam Baki at the MACC headquarters here today. Norison said the MOF welcomes views and suggestions from the MACC, particularly on enforcement and the application of existing laws under the commission's jurisdiction. Azam expressed his support for the key points of the proposed bill, which he said align with the ongoing National Anti-Corruption Strategy (NACS). 'NACS is the best platform for the MACC to address weaknesses in the government procurement system, and we fully support this initiative,' he said.
