TMC (M) moves Madras High Court to condone delay in filing monetary contribution reports before Election Commission

Tamil Maanila Congress (Moopanar) has moved Madras High Court seeking a direction to Election Commission of India (ECI) to condone the delay on the part of the party in filing reports regarding monetary contributions received by it during the financial years 2018-19 and 2019-20.
A summer vacation Bench of Justices Senthilkumar Ramamoorthy and Justice T.V. Thamilselvi on Wednesday permitted ECI standing counsel Niranjan Rajagopalan to take notice on behalf of the commission and obtain necessary instructions by June 18, 2025.
Making his preliminary submissions on Wednesday, the counsel said there was no provision in the Representation of the People Act of 1951 empowering the ECI to condone the delay in filing the contribution report and hence the commission had on May 13, 2025 rejected the petitioner's plea.
He also said the failure to submit the contribution reports on time does not entail consequences such as the party not being able to contest elections. The only consequence of such failure was that the contribution would become taxable and the party would have pay tax with penalty, he added.
Filing an affidavit on behalf of TMC(M), its president G.K. Vasan said the party was unable to file the contribution report for the financial year 2018-19 on time due to confusion in the place where it had to be filed and the 2019-20 report could not be filed on time because of COVID-19.
The belated filing of the reports and ECI's refusal to condone the delay in filing the reports had led to the Income Tax department denying tax exemption for the contributions and consequently raising a demand for ₹66.76 lakh for 2018-19 and ₹1.07 crore for 2019-20, the petitioner said.
Claiming that the delay in filing the contribution reports was neither intentional nor deliberate, the petitioner sought a direction to the ECI to condone the delay in filing the contribution reports as mandated under Section 29C(3) of the Representation of the Poeple Act of 1951.

ECI has deployed a dedicated IT module on the ECINet platform, integrated with India Post's Application Programming Interface, to replace the older manual workflow which would take 30-45 days to deliver voter ID cards. State election officials said new the system enables real-time tracking and SMS alerts at each stage — from generation by the Electoral Registration Officer to doorstep delivery by the postal department. This re-engineered, secure, and efficient digital process aims to improve transparency, reduce delays, and ensure better data security. "All EPIC-related applications will now be processed through ECINet, allowing for faster and more efficient delivery," said an official from the Chief Electoral Officer's office. Patna/New Delhi: With the Bihar assembly elections scheduled for Oct-Nov this year, the Election Commission of India (ECI) is considering launching an intensive house-to-house verification drive as part of the upcoming special summary revision of electoral rolls. The move comes in response to persistent concerns from political parties, civil society organisations and other agencies over alleged arbitrary inclusion and deletion of voters. "In order to make the system completely robust and free of any kind of errors, the ECI is contemplating an intensive house-to-house verification during the upcoming electoral roll revision to purify the rolls," an ECI official said on Sunday. The last such rigorous revision took place in 2004. The verification drive is expected to focus not only on adding eligible citizens but also on removing ineligible entries, including deceased voters, those who have migrated and foreign illegal immigrants who may have been enrolled based on inconclusive documentation. As per Article 326 of the Constitution and Section 16 of the Representation of the People Act, 1950, Indian citizens aged 18 or above — unless disqualified on grounds such as non-citizenship or criminal conviction — are eligible to be enrolled as voters. The ECI emphasised that despite annual revisions and extensive procedural checks, allegations of roll inflation continue to surface. "The entire process is conducted as per legal norms and under scrutiny by political parties, with adequate opportunity for filing claims, objections and appeals," a source said. House-to-house verification will also aid in enrolling new voters who have turned 18, correcting errors in voter details such as names and addresses and rationalising polling stations. This is particularly important as the cap on electors per polling station has been raised from 1,200 to 1,500. Highlighting the scale of electoral mobility, ECI data from 2024 shows that around 46.3 lakh voters changed residence, 2.3 crore applied for corrections, and 33.2 lakh sought replacements, amounting to over 3.2 crore voter record changes nationwide in a single year. A senior EC functionary said, "We are committed to ensuring that only genuine and eligible citizens are enrolled in the electoral rolls." If successful, the Bihar model could be replicated in the next national roll revision.
