Aaditya Thackeray demands probe into scrapped MMRDA tenders

Aaditya Thackeray, who represents the Worli constituency in the State Legislative Assembly, on Saturday (May 31, 2025) called upon Maharashtra Chief Minister Devendra Fadnavis to initiate a probe against Deputy Chief Minister Eknath Shinde, following the Mumbai Metropolitan Region Development Authority's (MMRDA) decision to cancel the tender process for two major infrastructure projects in Mumbai.
The two projects in question are the ₹6,000-crore Mumbai Elevated Road Project, involving a 9.8-kilometre bridge along the Vasai Creek, and the ₹8,000-crore Road Tunnel Project, which includes the construction of five-kilometre twin tunnels from Gaimukh to the Fountain Hotel Junction on Thane's Ghodbunder Road.
'Why should the government back down? No contractor goes against the government for one tender. This is only a scam. Cancelling the tender does not mean everything is clean. You [the MMRDA] had a hanging sword which is why you had to cancel the tender,' Mr. Thackeray said.
'Will CM Fadnavis get the matter probed by EOW, IT or ED? The CM should himself take charge of the MMRDA,' he continued. 'Shinde's corruption is proved. Will you sack him from the cabinet till the probe gets over? He has to face action,' Mr. Thackeray added.
The statement gains significance as the MMRDA, which operates under the Urban Development Department led by Mr. Shinde, informed the Supreme Court that it was cancelling two tenders linked to the Gaimukh-Ghodbunder-Bhayander project. The authority said it would issue fresh tenders 'to safeguard larger public interest'.
Further, the MMRDA stated that it was actively considering a downward revision of the base cost by ₹3,000 crore, based on financial bids disclosed during ongoing litigation.
The Supreme Court, while hearing a petition filed by infrastructure major Larsen & Toubro (L&T) challenging its disqualification from the tender process, also expressed criticism over the MMRDA's handling of the matter.
Mr. Thackeray noted that the original tender was floated on September 13, 2024, with a bid submission deadline of October 3, 2024 — a window typically reserved for emergency projects. 'Such short notice is not appropriate for large-scale infrastructure works,' he said, adding that the deadline was only extended to 60 days after he raised objections.
He further alleged that the terms of the tender were crafted in a manner that would favour 'preferred contractors.'

Thackeray accused the government of sidelining Marathi identity and questioned whether the project's cancellation was politically motivated or linked to commercial interests. In a strongly worded post on X (formerly Twitter), Aaditya accused the BJP of pursuing an 'anti-Marathi agenda' by quietly scrapping the Marathi theatre museum project at Girgaum Chowpatty. 'We have no opposition to any language, but we will always oppose linguistic imposition,' he wrote. Referring to ongoing protests around Marathi language, Thackeray alleged that the BJP government was systematically trying to dilute Marathi cultural identity — first by cancelling the 'Marathi Rangbhoomi Dalan' announced by former CM Uddhav Thackeray, and then by attempting to shift unrelated offices into the Marathi Language Bhavan, delaying its completion in the process. 'Who exactly is opposing Marathi at Girgaum Chowpatty?' he asked, suggesting that neither locals nor the Marathi-speaking public had raised objections. 'Was it the local BJP MLA? Or is the land being earmarked for a builder friend?' questioned Aaditya, demanding answers from what he called the 'Maharashtra-hating BJP.' Thackeray ended the post with a call to Mumbaikars to recognize what he termed the BJP's ongoing attempts to sideline Marathi identity through bureaucratic and political manoeuvres. The plan, announced by Uddhav Thackeray, involved revamping the defunct Birla Krida Kendra into a museum chronicling the history of Marathi theatre, with an auditorium, amphitheatre and exhibition space showcasing rare memorabilia and archival footage. Spread across 7,000 square metres, the Kendra has remained shut since 2000.

The Supreme Court has concluded that the use of the Uttar Pradesh Gangsters Act — a law meant to counter organised crime — in a solitary case of communal disturbance caused by an 'incendiary' social media post, amounts to a misuse of the stringent penal law. The recent judgment, authored by Justice Sandeep Mehta, came after the court heard an appeal filed by people accused under the State law for mobbing and vandalising the business establishment of a man who posted content derogatory to a particular religion on social media. 'When juxtaposed with the object and intent of the U.P. Gangsters Act, which was enacted to combat organised gang-based crime and dismantle criminal syndicates that pose a persistent threat to public order, the application of the Act to the appellants based on a single incident of communal violence flaring up from an incendiary post made against a particular religion represents a significant departure from its legislative purpose,' Justice Mehta wrote. 'Colourable exercise of power' The judgment said the application of the Gangsters Act in the current case bore the 'hallmark of colourable exercise of power for purposes extraneous to the Act's legitimate objectives'. The court reminded the State government of Article 21 of the Constitution that 'no person shall be deprived of life or personal liberty except according to procedure established by law'. Justice Mehta observed that the procedure prescribed by law must be fair, just, reasonable, and not arbitrary, presumptive, or oppressive. The constitutional guarantee of personal liberty acquired even greater significance when an 'extraordinary legislation with stringent provisions' like the U.P. Gangsters Act was invoked by the State, he said. 'The power conferred upon the State cannot be wielded as an instrument of harassment or intimidation, particularly where political motivations may be at play,' Justice Mehta emphasised. 'Need solid evidence' Extraordinary penal provisions, particularly those that substantially abridge regular procedural safeguards like the U.P. Gangsters Act, must be invoked only if the evidence met a threshold of credibility and substantiality. 'The materials relied upon must establish a reasonable nexus between the accused and the alleged criminal activity… When a statute creates serious fetters on personal liberty, the evidentiary foundation for its invocation must be commensurately strong, supported by concrete, verifiable facts rather than vague assertions,' the top court held. Quashing the FIR and allowing the appeal, the court said the case failed to meet the 'essential threshold' required to invoke the Gangsters Act. It had rested 'largely on presumptive theories rather than presenting tangible material to establish the probability that the appellants were engaged in organised criminal activity,' the court said.
