Rail firms taking ‘disproportionate action' against passengers over ticket rules

The regulator, the Office of Rail and Road (ORR), published a report that found travellers face 'inconsistent treatment and outcomes' for similar ticketing issues across the railway.
It was commissioned by then-transport secretary Louise Haigh in November last year to review how the industry handles revenue protection and fare evasion, after cases where passengers were being prosecuted over small amounts of money were highlighted in the media.
The ORR noted one case where a passenger was threatened with prosecution for accidentally selecting a 16-25 railcard discount when they held a 26-30 railcard, which provides the same discount.
The case was eventually dropped after their MP became involved.
The ORR found there are 'a range of circumstances' in which passengers may innocently travel without a valid ticket, such as forgetting their railcard or simply making a mistake.
But the regulator warned the same reasons can be used by passengers who 'deliberately choose' to underpay or avoid their fare, and it can to difficult for rail staff to determine their intent and decide how to handle the situation.
The report stated: 'Making this more challenging is the railway's complex fares and ticketing framework.
'This has grown more complicated over time.'
The inquiry found that rail staff described how 'fare evasion is becoming normalised among certain passenger groups', and it is becoming 'increasingly more challenging to tackle'.
The ORR noted that under railway byelaws, it is an offence not to be able to present a valid ticket for a journey, regardless of the passenger's intent, which means 'disproportionate action can end up being taken against some passengers'.
The inquiry made a series of recommendations to Transport Secretary Heidi Alexander and the Department for Transport, such as ensuring passengers have 'clearer information' about tickets, and creating consistency in how passengers are treated when ticket issues arise, particularly in relation to prosecutions.
ORR director of strategy, policy and reform Stephanie Tobyn said: 'Effective revenue protection is essential for a sustainable railway, but it must be fair and proportionate for passengers.
'Our recommendations aim to protect both industry revenue and support passenger confidence.
'Our evidence shows a system that has evolved over time where the legal framework and enforcement processes are increasingly complex and appear weighted towards industry, leaving some passengers who make innocent errors vulnerable to disproportionate outcomes.
'But meanwhile, fare evasion remains a significant problem, and rigorous action should be taken against those who intentionally seek to defraud the railway.'
Rail minister Lord Hendy said: 'This report shows that decades of failed privatisation have created a mess of deep-rooted issues across our railways, which have been left unchallenged and are now causing chaos and frustration for passengers.
'Through the creation of Great British Railways, we're bringing operators together to establish oversight and better standardise practices, putting an end to inconsistent prosecutions and making sure passengers are treated fairly.
'Deliberate fare-dodging costs the taxpayer up to £400 million annually – money which could be better spent on improving passenger experience – and must be dealt with, but ham-fisted prosecutions that punish people who have made an innocent mistake is not the way to do this.
'We will look at this report in detail and set out what we'll be doing to address the issues raised in due course.'
A spokesperson for Rail Delivery Group, which represents operators, said it welcomed the ORR's 'sensible recommendations'.
She continued: 'The rail industry will work on implementing the recommendations in line with our plans to create a simpler, better-value fares system.
'We need to strike the right balance addressing genuine, honest mistakes made by customers and taking firm action against those who deliberately and persistently seek to exploit the system.'
Last week, shadow justice secretary Robert Jenrick posted a widely-viewed video on social media in which he confronted people who forced their way through the ticket barriers at Stratford station in east London.

The former chief of HS2 took home £4.5 million of taxpayers' money while presiding over an 'appalling mess' of a project that wasted billions. Mark Thurston was at the helm of the disgraced scheme for six and a half years before leaving in September 2023 and then becoming chief executive of Anglian Water. He has been banned by ministers from receiving a bonus at the water company for the last financial year because it was found to have polluted our rivers. While at HS2, Thurston's pay ranged from £585,000 to £676,000 a year including bonuses and other taxable benefits. During his time at the government-owned company he took home £4,449,977. He joined HS2 in 2017, shortly after parliament signed off the building of the project's first phase. He previously worked on the 2012 London Olympics and Crossrail, now the Elizabeth Line, the heavily delayed new railway through central London. Thurston's oversight of HS2 was put under the spotlight this week when his successor's initial findings into the failures of the project were published. Heidi Alexander, the transport secretary, told the Commons on Wednesday that the scheme had become an 'appalling mess' after years of mismanagement. She said: 'It gives me no pleasure to deliver news like this. Billions of pounds of taxpayers' money has been wasted by constant scope changes, ineffective contracts and bad management.' Mark Wild, who took over the running of HS2 in December last year, has been carrying out a root and branch review of the scheme in an bid to stem ballooning costs and restore proper oversight. Wild's salary will be declared in accounts published this summer although his base salary is said to be lower than Thurston's. The project was originally due to cost £32.7 billion — in 2011 prices — with the first leg between London and the Midlands opening in late 2026. The pared-back scheme could now cost more than £100 billion. In a letter to Alexander, published on Wednesday, Wild said: 'The position I have inherited in HS2 Ltd is unacceptable; the organisation has failed in its mission to control costs and deliver to schedule.' It was announced that Thurston, 58, was leaving HS2 in July 2023. He said the project was the 'highlight of my career', adding: 'I have agreed with the board that someone else should lead the organisation and programme through what will be another defining period for HS2.' His appointment to Anglian Water, which he joined in July last year, caused much comment, not least because of government criticisms of the financial stewardship of HS2. Responding in November last year, he told The Times: 'If customers want to challenge my appointment, all I can say is that it was a very thorough and comprehensive process. 'The board clearly thought I was a good fit. They have to account for that and only time will tell whether it was a good appointment.' Transport bosses are traditionally the highest paid public servants in the country, with those in the rail industry in particular receiving the biggest remuneration packages. The last time the Cabinet Office reported on senior civil service pay was in 2023 with figures for the previous year. The list was not updated in 2024 by the Conservatives before the election. It revealed that the 45 highest paid staff at HS2 had a combined pay packet of £8.9 million. Of the top 20 best paid, only six still work at the company three years later. It is understood that many senior executives left the company after Rishi Sunak cancelled the northern leg of the project in October 2023. A spokesman for HS2 Ltd said: ' Mark Wild is leading a comprehensive reset of HS2 to ensure the project can be delivered for the lowest reasonable cost. This includes reviewing and simplifying the structure of HS2 Ltd itself — putting more focus on front-line delivery of the railway and bearing down on unnecessary costs. 'This year, we have frozen pay and withheld all bonuses for staff in the highest grades at HS2 Ltd.'

Trainline has sued Labour's Transport Secretary Heidi Alexander over allegations she snubbed them by offering a £32million contract elsewhere. State-owned London North Eastern Railway (LNER), which has been run by the Department for Transport (DfT) since 2018, was said to have recently extended a ticketing sales platform contract. But the company did not offer rivals like Trainline the chance to bid for the 10-year-deal, it is claimed. Trainline has alleged the failure to seek alternative bids means due process was ignored - as were the best interests of passengers and the taxpayer. LNER reportedly awarded the contract for the central booking engine that supports its digital ticket sales to Australia's Vix Technology. Trainline also alleges the publication of the award on the Government's website on December 23 was too opaque as it buried the news during Christmas week, limiting the ability of other parties to respond. It comes as Trainline, who would have expected to compete for the work, has its own rival division which provides a similar 'white label' service to train operators. The company is understood to be claiming that a direct award of the contract was not permissible under procurement law because the terms were varied in scope, duration and beneficiaries. Given the terms of the award, the ticketing platform used by LNER, which operates between London Kings Cross and Scotland via Leeds and Newcastle, could be extended across the rail network. However, both LNER and the DfT have denied a new contract exists saying the allegations are 'categorically untrue'. Rail Unions have previously raised concerns about third party ticket operators like Trainline, accusing the company of being engaged in 'relentless profiteering'. Despite the government's plans for simplification through the nationalisation of its railway, it has maintained there would still be a need for 'an innovative and competitive third-party retail market'. Labour also ruled out establishing a national website and app to promote to promote cheaper fares in competition with the firm. But in guidance from January it said a plan to bring together ticket websites of individual operators was now in the pipeline. An LNER spokesman said of Trainline's allegations: 'This is unequivocally untrue. No such contract exists. Trainline is aware this is the case as we explicitly advised them as much earlier this month.' A DfT spokesman added: 'This is completely and categorically untrue – not least because no such contract exists, which Trainline is well aware after being explicitly told as much by LNER earlier this month. 'The Department has been clear we are working industry to simplify ticketing for customers, as part of the biggest overhaul of our railways in a generation.' Trainline has suggested it is challenging the lack of opportunity for alternative providers to bid, regardless of whether a contract has been entered into at this point in time. The company has filed a claim at the Technology and Construction Court.

'Once again, Labour has forced inflation-busting fare rises on Londoners, humiliating Mayor Khan by yet again removing his fare-setting power,' he said. 'All while he pretends they're on our side and supporting devolution – ridiculous.' The retail price index (RPI) measure of inflation stood at 4.3 per cent in May. The Government prefers referring to the lower CPI measure of inflation, which economists say is a more reliable measure of inflation. Yet RPI is widely used across the public and private sectors alike to maximise financial returns from things, such as rental contracts. 'Offers no comfort to Londoners' Sir Sadiq increased most TfL fares – including for the Elizabeth line and London Overground – by about 4.6pc in March, but froze bus fares at £1.75. Main line rail fares are set by the Department for Transport (DfT), which has traditionally used RPI-plus-1 per cent. Last year that increase was also 4.6pc. The next TfL fare increase is not due until March 2026, but may be announced before Christmas, the London Standard reported. London TravelWatch chief executive Michael Roberts said the above-inflation rises 'offers no comfort to Londoners who continue to feel the pinch of the ongoing cost of living crisis and some of the most expensive public transport fares in Europe.' He added: 'In previous years, the blow has been softened by freezing London bus fares. We look forward to seeing how TfL plans to keep fares affordable for those who need it most while ensuring at the same time that there is enough investment to maintain and renew the capital's existing transport network.' 'More complex than expected' In a second blow for London commuters on Friday, TfL also announced that new trains for the Piccadilly Line will not enter service for another year. Air-conditioned 2024 stock units were meant to be rolled out later this year, but will now not do so until the second half of 2026. TfL said that tests of the Austrian-made prototype train in London had proved 'more complex than expected', adding that 'mitigations or design alterations' might result. Stuart Harvey, TfL's Chief Capital Officer, said: 'It will obviously be disappointing for customers that they will have to wait a bit longer for the new trains, and I regret that. 'But I would like to assure Londoners and visitors to our city that we are working extremely closely with Siemens to ensure that the new trains can be introduced as soon as possible in the second half of next year.' Sambit Banerjee, the joint chief executive of Siemens Mobility, which is building the new trains, said: 'Any project like this is complicated – we're bringing state-of-the-art, air-conditioned, walk-through trains into tunnels that were built 120 years ago.' Sir Sadiq's spokesman said: 'The Mayor will confirm plans for future fares in due course. However, the Government has been clear that the funding settlement assumes TfL fares will increase each year by RPI+1 for each year of the settlement.'
