A Dunbar flat owner who claimed the majority of her guests were 'professional' and letting her property was good for the local economy has lost her appeal to carry on renting.
Leanne Montgomery appealed to Scottish Ministers after East Lothian Council refused to grant a change of use for her second floor flat on the High Street to a short term let.
She told them use of the holiday flat 'helped the economy', however the Scottish Government Reporter ruled its local impact was irrelevant.
And they said the flat owner had provided no evidence that it was mainly used by professionals, as had been claimed.
Dismissing the appeal, they said: " In assessing the appeal I am only able to consider whether or not the use as a short term holiday let represents a material change from the legitimate established use of the property as a flat.
"Any assessment which considers the merits of the use would need to take place through an application for planning permission."
East Lothian Council refused the application for a certificate of lawfulness, which would mean planning permission was not needed, to operate the holiday flat, because they said a shared stairwell with other residents in the block meant it was a material change of use.
And the Reporter agreed with their position saying the frequent arrival and departure of guests in the flat would impact on residents who used the same hallway.
They also dismissed claims that the majority of guests at the flat were 'professionals' who were there to work in the town.
They said: "The appellant contends that most visitors are professionals who visit the area to work a nine to five job for a the very short period of time they are in the area.
"I have been provided with no specific reasoning as to why the property would appeal to professionals in particular and I have been provided with no evidence to substantiate this claim.."
The Reporter ruled the impact of guests at the short term let was a material change of use and the council had been correct to reject the application for the certificate.

A spokesperson for Farmfoods previously said: "I can confirm we have commenced development with the intention of opening a new shop at Market Place, Codnor at the junction with Nottingham Road and Heanor Road. "The land was formerly occupied by the French Horn public house. Festivals given £3m in Government funding
The events will receive a share of the £2.8 million Festivals Expo Fund, and Festivals Edinburgh will get £200,000 from Creative Scotland for branding and marketing support for the events in the capital. The Expo Fund spending has increased from £1.7 million last year. The Edinburgh Festival Fringe will receive £670,000, while the Edinburgh International Book Festival will be given £200,000, the same amount as for the Scottish International Storytelling Festival. Culture Secretary Angus Robertson said: 'Scotland's festivals are our cultural shopfront to the rest of the world. 'As well as offering performers and creatives an unrivalled international platform, they also deliver an annual economic uplift to businesses, jobs and livelihoods right across the country. 'This year's funding increase for the existing Expo festivals cohort represents an increase of £1 million across the 14 festivals in Glasgow and Edinburgh, the first in 10 years. 'It recognises the success of festivals in shaping and supporting hundreds of commissions, enhancing the ambitions of thousands of Scottish artists and attracting audiences in the millions for Expo-supported work since the fund's creation in 2007. 'From this foundation we will expand the reach of the Expo fund across the whole of Scotland, and I am working with festivals across the country through the strategic festivals partnership to realise this commitment.' Dana MacLeod, executive director of arts, communities and inclusion at Creative Scotland, welcomed the funding, saying it will enable festivals to 'commission bold ideas, develop creative collaborations and present high-quality programmes for audiences in Scotland and internationally'. Lori Anderson, director of Festivals Edinburgh, said: 'Today's announcement is welcome news for our festivals and for Scotland's cultural sector, ensuring that the guiding principle of the Scottish Government's Festivals Expo Fund – to showcase Scottish talent to the world on the country's premier festival platforms – continues to successfully support creative careers.'
