R19,000 fine for man who ignored tax returns for 16 years

A man has been fined for failing to submit his tax returns for 16 years.

The Rustenburg Magistrate's Court has fined a 48-year-old man R19,000 for failing to submit tax returns.
This is despite the South African Revenue Service's (SARS) attempts to remind him to do so between 2007 and 2023.
Paulo Silvino Dos Santos appeared before the court, facing 19 counts of contravening Sections 234(d) and 234(i) of the Tax Administration Act 28 of 2011 for failing to submit Personal Income Tax returns.
His offences relate to the period from 2007 and 2008, during which he failed to comply with statutory obligations and directives issued by SARS.

The National Prosecuting Authority (NPA) spokesperson in the North West Division, Sivenathi Gunya, said despite numerous telephonic reminders and written notices, Dos Santos failed to comply.
Gunya said the court appearance of Dos Santos was a result of the diligent work of the NPA's Specialised Tax Unit, which is tasked with promoting accountability and compliance by taking legal action against individuals and entities who wilfully disregard tax obligations.
'The NPA welcomes this outcome, as it underscores the importance of tax compliance in ensuring effective revenue collection and upholding public confidence in SARS's enforcement capabilities,' Gunya added.
The Director of Public Prosecutions in the North West, Dr Rachel Makhari, emphasised the critical role of enforcing South Africa's tax laws in maintaining a fair and functional tax system.
She said the NPA, in collaboration with SARS and the Directorate for Priority Crime Investigation (DPCI), remains committed to combating tax non-compliance under the Honey Badger Project.
'The hefty fine imposed on Dos Santos for failing to submit tax returns sends a strong message that such offences will not be tolerated,' Dr Makhari said.
Additionally, she said the outcome underscores the seriousness with which the state treats tax non-compliance and reaffirms the legal obligation of all taxpayers to submit returns, an essential function that enables effective revenue collection to fund vital public services.
Meanwhile, SARS has announced the official start of the 2025 filing season, which would effectively start from July 07, 2025, to October 20, 2025.
In its statement, SARS said taxpayers who are automatically assessed would receive a notification from them from July 7-20.
'Taxpayers who do not receive an auto assessment notification from SARS and are required to file a tax return can do so from July 21,' read the statement.
Additionally, SARS urged all taxpayers to prepare their documentation early to check their assessments and to avoid last-minute delays when submitting an income tax return.

The Salanha Bay girl's disappearance has sparked a national, and even international, rescue effort. Her mother, Kelly Smith, and two others – Jacquin 'Boeta' Appollis and Steveno van Rhyn – have since been convicted and sentenced for kidnapping and child trafficking. Speaking in a webinar this week, NPA prosecutor Zelda Swanepoel shared her beliefs about Joslin Smith. Earlier this month, Swapepoel helped the state to convict Joslin's mother, Kelly Smith, the latter's boyfriend, Jacquin 'Boeta' Appollis, and their pal, Steveno van Rhyn. A life sentence for trafficking and kidnapping was handed down by Western Cape High Court judge, Nathan Erasmus. She said of the search for the missing girl: 'We have done a comprehensive search in Saldanha of all the exhibits. 'Everything that was found in all of those dunes, all the bones, all the clothing, was analysed, there were no positive DNA results found on anything. She added that much of the case hung on the state witness Lourentia Lombaard. The NPA was also banking on the possibility that Joslin's mother would testify. 'We were always hopeful during the trial that the accused would come and testify in the main trial. The plan was to destroy their credibility and demonstrate the improbabilities in their versions. Yes, their decision to remain silent, especially Kelly, was very disappointing,' she added. Meanwhile, Joslin's mother Kelly Smith as well as Appollis and van Rhyn have filed their notices this week for leave to appeal their convictions and sentences. The NPA are also awaiting the fate of the state witness Lourentia Lombaard, whose verdict will be announced by Judge Erasmus at an appointed date. A 204 inquiry will determine if Lombaard will be granted indemnity based on her testimony. If the court does find that Lombaard did not testify truthfully, she could face prosecution for perjury and related charges. JOHANNESBURG - A bogus tax practitioner linked to alleged underworld boss Nafiz Modack will spend three years behind bars for defrauding the South African Revenue Service (SARS) out of R60,000. Faried van der Schyff, who is also a co-accused in Modack's organised crime trial, was sentenced in the Cape Town Regional Court on Friday. It's understood that the 59-year-old posed as a registered tax consultant and illegally submitted documents to SARS, deceiving clients and pocketing the money. He was convicted on five charges, including income tax fraud, violations of the Tax Administration Act, and contravention of the Correctional Services Act. Hawks spokesperson Zinzi Hani said, 'It was reported that van der Schyff committed fraud from 2016 to 2019 by operating illegally as a tax practitioner, without being registered with the South African Revenue Service.' Van der Schyff remains a co-accused in the Western Cape High Court trial involving Modack and 14 others, a case with nearly 3,000 charges, including murder, extortion and racketeering.

Katlego Bereng's body was planted in the cell as part of the rapist and murderer's elaborate escape. The NPA dropped charges of murder against the accused in the Bester escape due to insufficient evidence. But Bereng's mother is convinced those in the dock killed her son. The state is alleging that Nandipha Magudumana claimed Bereng's body under false pretences, with the help of Zimbabwean Zanda Moyo. A post-mortem report said Bereng died of unnatural causes.
