Allahabad HC Slams Family For Opposing Woman's Right To Marry, Cites ‘Value Gap' In Society

Emphasising the constitutional autonomy of adults, the Allahabad High Court recently observed that an adult woman has every right under Article 21 to marry a man of her choice. Court stressed that so long as there is this gap between the values fostered by the Constitution and those cherished by society, the attempt to forcefully stop an adult from marrying the person of choice would continue to happen.
However, reaffirming its role, the bench stated, 'It is our duty to uphold the Constitution".
A bench comprising Justices JJ Munir and Praveen Kumar Giri passed remaked thus in a plea filed by Amarnath Yadav and three others, who sought protection from arrest in a case lodged by a woman — in the case — under Sections 140(3), 62, and 352 of the Bharatiya Nyaya Sanhita (BNS) at Chilh police station, Mirzapur.
The woman, aged 27, alleged that her father and brother (the first two petitioners) were trying to kidnap or abduct her to stop her from marrying the man of her choice. While the court refrained from pronouncing on the truth of the allegations at this stage, it found it 'despicable" that her family would object to her exercising a fundamental right guaranteed under Article 21 of the Constitution.
'We do not know if the first and the second petitioner or the other petitioners acting at their behest really intend to abduct the fourth respondent but it is despicable that the petitioners should object to the decision of an adult member of the family, a woman 27 years of age, from marrying a man of her choice," the court observed.
It described the incident as a symptom of the 'value gap" between society's conservative norms and the liberal spirit of the Constitution.
However, court found no reason to believe prima facie that the petitioners had so far committed an offence.
Accordingly, granting interim protection from arrest, court simultaneously issued a strict order restraining the petitioners from interfering in the woman's life.
They have also been barred from contacting her through any medium — including phone, internet, or through intermediaries — and are specifically prohibited from threatening her or the man she wishes to marry.
The police, too, were instructed not to interfere with the woman's personal liberty and autonomy in any manner. Court directed that the order be communicated urgently to the Superintendent of Police, Mirzapur, through the Chief Judicial Magistrate.
The matter has been listed for further hearing and admission on July 18, 2025.

Noida: Haridwar man arrested over ₹1 crore cyber fraud
Noida: A 54-year-old man from Haridwar has been arrested for being allegedly involved in a ₹ 1 crore cyber fraud case in which a Noida resident was duped on the pretext of stock trading between April and August 2024, police said on Sunday. The case was reported at the Cybercrime Branch police station on this April 7. Police said suspect Sharma's bank accounts had been flagged by six states over 13 cyber fraud cases. (Representational image) The suspect has been identified as Rajendra Sharma, a resident of Ranipur, Haridwar, police said on Sunday. 'After months of extensive technical investigation, we arrested Sharma from his hometown in Haridwar on Saturday. The investigation revealed that Sharma allegedly provided his bank accounts to cybercriminals, who used them to receive fraudulent money. He received a commission for providing his accounts,' said deputy commissioner of police (DCP) (cybercrime branch) Preeti Yadav. ' ₹ 5.5 lakh was transferred into Sharma's account. It also came to light that some of his acquaintances too provided their bank accounts to the fraudsters. Efforts are underway to nab them too,' the DCP added. Police said Sharma's bank accounts had been flagged by six states over 13 cyber fraud cases. The victim is a resident of Sector 77, Noida. On April 7, 2025, he informed the cybercrime branch police station, that on April 23, 2024, he was lured into stock market trading for huge profits after being sent a WhatsApp message from an unidentified number. 'The fraudsters claimed their company was a parent company of an American multinational investment bank and duped the victim of ₹ 1 crore. When he insisted on meeting them in person, he was asked to come to Mumbai. There, he learned from the multinational investment bank that no such associated company existed. He then filed a complaint. After investigation, a case of cheating and personation under the Bharatiya Nyaya Sanhita (BNS) was registered on April 7,' police said.

Ludhiana: Man thrown into canal, FIR against 19-yr-old woman, aide
A 19-year-old woman, with the help of a male accomplice, allegedly kidnapped and attacked her former friend before throwing him—unconscious—into a canal in Ludhiana's Jodhan area. Fortunately, two local farmers—Jagpal Singh and Tejpal Singh—who were working in the nearby fields, saw him floating in the water body. They pulled him out in an unconscious state and informed his mother. He was first taken to the civil hospital in Pakhowal and later referred to a hospital in Ludhiana due to the critical nature of his condition. Eyewitnesses said Harkirat was wearing only his pants when rescued, indicating that he was violently attacked. Station house officer (SHO) Sahibmeet Singh of Jodhan police station confirmed the case, stating that FIR has been registered under relevant sections of the Bharatiya Nyaya Sanhita (BNS). 'It appears to be a pre-planned attack. We have raided multiple locations but both accused are absconding. They will be arrested soon and dealt with strictly under the law,' he said.
