New Delhi, Jun 9 (PTI) A Delhi court has granted bail to a youth held in an attempt to murder case observing he was no longer required for investigation.
The CCTV footage, the June 6 order noted, did not show that the complainant's car parked behind the white sedan of the accused whereas it showed the complainant arguing with the co-passenger of the white sedan when the accused returned from a shop.
Arora was booked by Ranjit Nagar Police Station on charges of causing grievous hurt and attempt to murder.
During the intervening night of May 25-26 May, complainant Tarun Kumar and his friends got into a heated altercation over honking with Arora, who allegedly rammed his car into Kumar and escaped from the spot.
The court observed the submissions of Arora's counsel Prashant Diwan who disputed the chain of events in the FIR, and argued his client was 'consciously engaged' by the complainant in a scuffle, and he had only exercised his right of self-defence.
Arora's conduct, prima facie, did not appear aggressive the CCTV footage showed Arora trying to escape the scene by reversing his car, the court said.
This, the judge observed, was explained by his counsel as leaving the spot to protect himself from Kumar and his associates.
'The CCTV footage further shows that the complainant and his associates charged towards the car of the accused in the middle of the road and purportedly tried to stop the accused. When the accused was trying to escape from the spot, the complainant landed on the bonnet of the accused's car,' the judge said.
The court observed there was neither CCTV footage to establish Kumar was dragged for a considerable distance, nor did the prosecution explain why Kumar was stopping Arora when the accused did not cause any accident or assault the complainant.
'All these issues will have to be considered during the trial. Whether the incident took place in the purported exercise of the right of self-defence by the applicant accused, or it was a rash and negligent act, or simply an accident which occurred because the accused was trying to escape from the spot, will again be considered during the trial,' the judge said.
The accused was observed to have been in custody since May 25 and found to be a 'young boy' who had no criminal history.
'The applicant or accused Krish Arora is ordered to be admitted to regular bail on furnishing a bail bond of Rs 30,000 with one surety in the like amount,' the court held. PTI MNR MNR AMK AMK

Property Dealer, Security Guard Arrested In Honeymoon Murder Case

Guwahati: A property dealer and a security guard have been arrested in connection with Meghalaya's honeymoon murder -- the murder of Indore transporter Raja Raghuvanshi, allegedly by his wife Sonam. Sources said the Meghalaya police had kept them on their scanner for long. Property dealer Silome James had rented out a flat at Indore's Hirabagh locality to alleged hitman Vishal alias Vicky. Vicky was arrested along with two other hitmen - Akash and Anand - and Sonam Raghuvanshi and her allege boyfriend and mastermind of the crime Raj Kushwaha. Police sources said Sonam Rahuvanshi had stayed in the flat from May 26 to June 8, before she was detained from a eatery on the highway in Gazipur, Uttar Pradesh. The security guard -- Balbir Ahirbar, alias 'Ballu' -- had gone missing since the arrest of Sonam Raghuvanshi and four others, police sources said. He was arrested today from Indore, where he was hiding. The police suspect he holds vital information on the movement of the accused and other developments within the premises. Raja Raghuvanshi was killed on May 23 - the police said Sonam Raghuvanshi had given the signal for the attack. The police said after the murder, Sonam Raghuvanshi had fled via Guwahati. James, who has been interrogated twice before by Meghalaya Special Investigation Team, has been arrested for tampering with evidence. Sonam Raghuvanshi had told the police that she left the bag in the flat on June 8 and left for Gazipur in a rented cab as soon as they heard Akash and Anand were arrested. Two days later, Silome James went to the rented flat, opened it with the master key and removed the bag and other items, police sources said. Silome James was allegedly seen in one of the many CCTV footage of that area that Indore Crime Branch collected for Meghalaya SIT, sources further added. Markets regulator Sebi has barred two individuals from the securities markets for three years and impounded illegal gains of over Rs 4.83 crore made by them for orchestrating a fraudulent scheme using out of the money (OTM) stock options to misappropriate funds from investors. Apart from the securities market ban, the regulator also slapped a penalty of Rs 25 lakh each on Shivprasad Pattiya and Alkesh Narware and directed them them to pay the fine within 45 days, Sebi said in the order passed on Friday. Further, Sebi directed Pattiya and Narware to disgorge unlawful gains worth Rs 4.83 crore with an interest of 12 per cent per annum jointly and severally from February 2022. In the final order, Sebi found that the front entities had opened the trading accounts under the instructions of the operator group (Shivprasad Pattiya and Alkesh Narware) and these trading accounts and bank accounts were under the control of the operator group. Sebi observed that the caller group had identified prospective investors (complainants) which had credit balance in their ledger and obtained their credentials in the name of Algo/software trades and the same were also under the control of the Shivprasad Pattiya and Alkesh Narware. The trades executed through the mobile in the accounts of the complainants and the front entities were also under the control of the Pattiya and Narware, Sebi said. "...it is established that the entire fraudulent scheme is attributable solely and squarely to the noticees (operator group) and they were the controlling minds and beneficiaries of the fraudulent arrangement. "The acts of the noticee amounts to manipulative, deceptive device and artifice to defraud while dealing in securities," Sebi's Quasi Judicial Authority N Murugan said in the order. Pattiya and Narware were found to have violated the provisions of PFUTP (Prohibition of Fraudulent and Unfair Trade Practices) rules. The order came after the Securities and Exchange Board of India (Sebi) received alerts on suspicious trades in illiquid 'Out of the Money' stock options with unusual price variations. NSE also got complaints from investors who suffered losses after sharing trading credentials for Algo-based trading via WhatsApp groups. Thereafter, Sebi conducted a probe to look into the role of a group of entities led Shivprasad Pattiya and Alkesh Narware allegedly misused online trading kits, promised guaranteed returns, and executed manipulative trades. The investigation covered the period from January 2021 to February 2022.
