Alan Kelly asks why it was left to him to give Justice Minister details on Carlow shooter
Mr Fitzgerald (22) entered the Fairgreen Shopping Centre in Carlow town on June 1 and discharged a number of rounds from a shotgun before taking his own life.
He had been facing 13 charges for possessing military-grade guns, ammunition and explosive substances following a garda investigation into the purchase of firearms on the dark web.
Last week Mr Kelly queried the manner of the garda operation leading to Mr Fitzgerald's arrest, including deploying undercover detectives to carry out a 'controlled delivery' of decommissioned weapons.
Separately, Independent senator Michael McDowell told the Seanad that the events in Carlow 'could have been avoided' through diversion rather than 'entrapment' or prosecution by gardaí.
Today, Mr Kelly said Mr Fitzgerald had "tragically and very publicly" taken his own life after getting bail following an undercover garda operation and being charged.
"I'm asking why the Garda Commissioner didn't inform and brief the Minister for Justice of the details of this case," Mr Kelly said, citing legislation requiring that this be done.
The details the Minister should have been briefed on, Mr Kelly argued, included "the fact that it was undercover and the guns were supplied by An Garda Síochána."
He added: "Is it right that I, as a member of the opposition, had to ring the Minister for Justice in relation to this and inform him of that?
"I had to go and tell him to go to the Garda Commissioner to ask him about the full details in relation to this case.
"Would we have ever known about the full details relation to this case, considering what was said in court, if I hadn't contacted the Minister for Justice on June 3 in relation to this?"
Tánaiste Simon Harris expressed sympathy with Mr Fitzgerald's family, saying he was "a county man of mine, and I know it's been a great shock in the local community in Wicklow as well."
The Fine Gael leader suggested that it was "a complex case."
He added: "I'm obviously not privy - nor should I be - to when the Garda Commissioner does and doesn't use that provision in the Act [to inform the Minister for Justice].
"That's a matter between himself and the minister. But I do understand that the Minister for Justice has sought further information from the Garda Commissioner on the case.
"I also not the comments of the Taoiseach last week in relation to this issue and a need for a review.

It's suspected he continued on a crime rampage - until Thursday - when a number armed gardai from Dublin discovered him in an AirBnB in the midlands. A BMW, suspected of being stolen from outside a property in Mayo, was also discovered outside the property. Three men arrested following €400,000 worth of damage at Castletown House in Co Kildare
They were arrested by gardaí attached to the Crime Hub in Kildare North following a search operation carried out this morning. The damage was caused to property during a number of separate incidents between April 22 and May 4 of this year. Property and vehicles belonging to the Office of Public Works (OPW) parked on the grounds were badly damaged, with several vehicles being turned over. CCTV cameras were also put out of action with wires cut. One adult in his 30s, and two juveniles are currently being detained at Garda stations in Kildare as investigations are ongoing. 'Gardaí attached to the Crime Hub, Kildare North have arrested three individuals this morning Friday, June 20 following a search operation that took place at a number of residential properties in Kildare,' a spokesperson for An Garda Síochána said. 'The three arrests relate to a number of separate incidents of criminal damage that was caused to property between the dates of April 22 to May 4. 'The estimated cost of the damage is believed to be in the region of €400,000. 'The three males, one adult male aged in his 30s and two juveniles, are currently detained under Section 4 of the Criminal Justice Act, 1984 at Garda stations in the Kildare Division.'

Wicklow man who drove with Lidl manager on car bonnet after checkout row escapes jail term
A RETIRED TRADESMAN has avoided prison over an incident in a supermarket car park in Wicklow Town in which he drove a short distance with a store manager on the bonnet of his vehicle following a row at a checkout. Thomas O'Connor (67) of Two Mile House, Ballinteskin, Co Wicklow pleaded guilty to a charge of endangerment over the incident at the Lidl supermarket on Rathnew Road, Co Wicklow on 3 July, 2023 contrary to Section 13 of the Non-Fatal Offences Against the Person Act 1997. Garda James Downey told a sitting of Wicklow Circuit Criminal Court that there had been an issue between the store's assistant manager and the accused in relation to the payment for a small item. CCTV footage played in court showed that the manager attempted to place a shopping trolley in front of O'Connor's vehicle in order to speak further with him as the accused was driving out of the car park. Video images show the supermarket employee was briefly pushed onto the bonnet of the vehicle which was travelling at a slow speed before O'Connor drove away, cutting inside a van coming into the car park on the wrong side as he made his exit. Garda Downey said O'Connor was arrested in December 2023 and identified himself on the CCTV footage and accepted responsibility for his driving. The court heard he told gardaí: 'What can I say? At least no-one was hurt. I was panicked.' O'Connor also added that he was 'deeply sorry'. Garda Downey confirmed to prosecution counsel, James Kelly BL, that the accused had no previous convictions. Cross-examined by defence counsel, Edmund Sweetman BL, Garda Downey agreed that the incident arose from a dispute over what items were paid for. The court heard there was an issue about whether the customer had given the cashier a €5 or €10 note which resulted in O'Connor leaving the store with two packs of hash browns and leaving another behind at the checkout. Garda Downey said the accused had taken offence at being challenged by Lidl staff. Mr Kelly observed that O'Connor had 'left in high dudgeon and took off.' Mr Sweetman said there was no justification for the defendant's 'most irrational behaviour.' Pleading for leniency, the barrister said O'Connor had a previously unblemished character and had recently retired from a career working as a plasterer. He said the accused had brought €1,000 to court for his victim as an expression of his remorse. Sentencing O'Connor to three months in prison, Judge Terence O'Sullivan said he would fully suspend the term of imprisonment for a period of six months on condition that he keep the peace for that period and not come to Garda attention. The judge said the accused's driving was reckless and it was lucky that no harm had come to the Lidl manager. He said O'Connor knew there was some sort of row with the supermarket's staff and there was no justification for endangering the store official, although the judge acknowledged the accused was assessed as being at a low risk of reoffending. Judge O'Sullivan said he accepted that the defendant 'simply panicked in temper'. 'It was one of those occasions where the red mist descended when it shouldn't have,' the judge remarked. Having heard that O'Connor lives in an area with poor public transport and has a wife with health issues, Judge O'Sullivan said he would not impose any driving disqualification on him.
