Sibal questions Dhankhar's 'inaction' after SC drops probe into Allahabad HC judge
NEW DELHI: Amid reports that the Supreme Court dropped its investigation against Allahabad HC judge Shekhar Kumar Yadav following an intervention from the Rajya Sabha, Upper House MP Kapil Sibal on Tuesday questioned why Chairman Jagdeep Dhankhar has not taken any action on the notice seeking an impeachment motion against the judge.
Addressing media in the capital, Sibal, who is also a senior advocate and SCBA president, said the whole incident smacks of 'discrimination.' He alleged that the government is attempting to save the judge after he made 'entirely communal' remarks last year.
'On one hand the Rajya Sabha secretary general wrote to the Chief Justice of India to not go ahead with an in-house inquiry against Yadav as a petition was pending against him before the Upper House, which was not done in the case of Justice Yashwant Varma,' he said.
'Why did you not write a letter over in-house inquiry against Justice Varma. So does this government want to protect Shekhar Yadav, we think they want to save him,' he said.
Speaking on the Uniform Civil Code, Justice Yadav of Allahabad HC on December 8, 2024 reportedly said that Hindus did not expect Muslims to follow their culture but only wanted them not to disrespect the same.
Speaking at a VHP event, he had stated that the country would run as per the wishes of the 'Bahusankhayak' (majority) and that the Uniform Civil Code would soon become a reality.

Patna, Jun 21 (UNI) Dubbing Bihar Chief Minister Nitish Kumar a "copycat" for imitating his promises regarding social security pension, the leader of opposition in Bihar assembly Tejaswi Prasad Yadav said that scared of the possible return of the Grand Alliance (GA) to power Nitesh government increased the social "security pension in tension". He questioned from where the enhanced pension would be given to 1 crore 9 lakh 69 thousand 255 beneficiaries? An additional Rs 767 crore would be spent monthly for providing the increased pension. Dubbing the Nitish government as "inefficient", Yadav reiterated that he had provided 5 lakh jobs in a short span of 17 months of his tenure and 3.5 lakh appointments were under process. Taking pot shots at the Prime Minister's Bihar visit, Yadav alleged that over Rs 100 crore public money is spent on his every visit and added that in the last five elections, the Prime Minister has held more than 200 rallies and over Rs 20 thousand crore of hard-earned money of the people was spent by the government in the promotion of its party. Yadav further said that Union Home Minister Amit Shah has told a group of journalists of Bihar that Nitish was on the post only till the elections, because JDU's Bhunja party ( evening snacks) people were running the party. Nagpur: Organised crime is not limited by borders and has a devastating impact on the country's economy and internal security by enabling , Nagpur bench of Bombay High Court observed while overturning a lower court order that denied police custody of a member of a crime syndicate. Tired of too many ads? go ad free now Justice Urmila Joshi-Phalke, while granting seven-day police custody to , 33, under the stringent Maharashtra Control of Organised Crime Act (MCOCA), said, "organised crime is a serious threat to society and is fuelled by illegal wealth generated by contract killing, extortion, narcotics trade, ransom kidnappings, money laundering, and protection rackets." The court rejected the special MCOCA court's May 3 ruling, which denied police custody on the limited ground that the probe was focused on tracing bank accounts and property. Justice Joshi-Phalke said the special court failed to consider crucial aspects of the investigation, including the accused's ongoing role in a larger organised crime syndicate. "MCOCA can be invoked even if direct crime involvement is absent, but syndicate nexus is established," the judge said. "Black money generated by organised crime has had a serious adverse effect on our economy. These syndicates have made a common cause with terrorist gangs," the court said, while affirming that MCOCA empowers agencies to intercept communications and pursue complex networks that threaten national security. The court was hearing a revision plea filed by the state against the lower court's refusal to grant police custody. Yadav was arrested in a March 14 assault case registered in Yerla, Kalmeshwar, where he and a co-accused allegedly attacked a man with a sickle. Though the case was initially registered under Bhartiya Nagrik Suraksha Sanhita (BNSS), further investigation revealed a pattern of serious, repeat offences allegedly committed for pecuniary gain — prompting the application of MCOCA. "He is a repeat offender operating for economic gain. His actions fit the definition of continuing unlawful activity under MCOCA," the state counsel contended, while urging custodial interrogation to investigate deeper links within the crime syndicate. The high court agreed, stressing that even if an individual may not have committed a particular act of organised crime directly, their nexus with a syndicate or with repeated unlawful acts could still justify invoking MCOCA. "A nexus with the crime syndicate is enough to attract the Act," Justice Joshi-Phalke said, citing Supreme Court's precedent in the Ranjitsing Brahmajeetsing Sharma case. She ruled that police must be given a fair opportunity to probe syndicate structures, pecuniary trails, and unlawful activities under the wider framework of MCOCA. "In light of the legislative intent, denial of custody would amount to frustrating the purpose of the law," the court said while quashing the lower court's orders.
