£5m cocaine ‘sombrero' drugs trafficker wins appeal against his sentence

A DRUG smuggler who was caught with more than £5 million worth of cocaine after claiming that all he brought back from Mexico was four sombreros has won an appeal against his jail sentence.
Kristopher Purvis was stopped by a Border Force officer in the 'nothing to declare' customs channel at Edinburgh airport with a friend and a haul of 45 kilos of the Class A drug was recovered.

Purvis, 35, was jailed for 10 years in April this year after admitting being concerned in the supply of cocaine and being concerned in the fraudulent evasion of the ban on importing controlled drugs on July 24 last year at the airport.
But lawyers acting for the drug smuggler challenged the sentence imposed on him before criminal appeal judges in Edinburgh claiming that the penalty imposed on him was excessive.
Lady Wise, who heard the appeal with Lord Doherty, said: 'In the whole circumstances we consider that a sentence of eight years and six months was appropriate.'
She said they would allow the appeal and quash the ten-year jail term imposed by Lord Summers and substitute imprisonment for eight and a half years.

Lord Summers selected a starting point for his sentence as 15 years but then reduced it by a third as he said Purvis pled guilty at the earliest opportunity.
The appeal judges said the headline sentence should have been lower but disagreed that the plea came at the earliest possible time.
Purvis, of Mann Crescent, Murton, in County Durham, tendered his guilty pleas to the charge in March this year at the High Court in Edinburgh.
The court heard that he arrived at Edinburgh airport after flying from Mexico via Paris before he was stopped.

He and his companion each had a large black suitcase and Purvis was also carrying a bag with four multi-coloured sombreros.
Prosecutor Brian Gill KC told the court: 'He said that the only thing that he had acquired in Mexico was the sombreros.'

But a search of the cases found 15 vacuum-sealed packages covered in mustard to put off sniffer dogs, with each package containing three kilos of cocaine.
The maximum street value of the drugs was in excess of pounds 5.6 million.

Purvis was told he was going to be questioned and responded: 'It's all mine, my mate has nothing to do with it. I put it in his case.'
He was arrested and replied: 'Yeah, alright I understand. I'm useless and f***ing stupid and I'm f***ed anyway.'
The court heard that Purvis stood to have a pounds 5000 debt wiped out and to be paid pounds 20,000 to bring the drugs into the UK.
Defence solicitor advocate Simon Collins argued that the sentence imposed on the first offender was excessive and said he had 'a limited involvement' in what would have been a very lucrative transaction for others with more significant roles in the drugs trade.

He said that his father "won't speak to me because of this security stuff." ‌ Since speaking out, Duncan - who is the author of Prince Harry: The Inside Story - has told the Mirror that he had no doubt that Harry wishes "he'd done things differently", but their family ties still seem to be a very long way from being resolved. He said: "Harry is a sensitive soul and always wore his heart on his sleeve, so whether he'd admit it publicly or not, I'm sure he's full of regrets and wishes he'd done things differently. "With Trooping the Colour and Father's Day falling on the same weekend, it was bound to make him look back at the happy relationships he once had with his brother and dad, and I'm sure he'd love to be able to rebuild those." Last month, the Duke was unable to overturn the decision that denies himself, his Meghan Markle and their two children, Archie and Lilibet, state-funded, high level security when in the UK, which is provided for senior royals. In response to this decision, Harry said that he "couldn't see a world" where he would be able to take Meghan and his kids back to the UK. ‌ Duncan added: "By saying he can't bring them here because of the court ruling, Harry has nailed his colours to the mast. "Meghan is probably quite reluctant to come to the UK anyway because they'd have to be deaf, dumb and blind not to realise just how much criticism they've had for their betrayals and truth bombs. But more importantly, there are real and genuine threats." ‌ The expert says that these threats would most likely come from "lunatics and radical protesters" who may be wanting to make a name for themselves. Additionally, these threats wouldn't only be directed at Harry and Meghan, but also their two children who are aged six and four. He adds that this would make any trip to the UK incredibly difficult without the high level security. "At big royal events, the security you actually see is the tip of the iceberg. There are a lot of undercover officers and agents working, too. ‌ "Without the official support and security, Harry and Meghan are left with two or three bodyguards who are pretty blind to what the potential threats are," says Duncan. While Meghan seems to be thriving back in the US with the launch of her As Ever lifestyle brand and Netflix series, With Love, Meghan, the mum of two is still hugely worried about her nearest and dearest. ‌ A source said: "In some ways she's feeling stronger and she wants to share that. But she's still terrified of putting her kids at risk by coming back to the UK – any parent would panic if they were in Meghan's shoes. "So even though Harry is really feeling the absence of his dad, especially after Trooping the Colour and Father's Day, the security stuff will probably always be an issue. "He knows that things could've been so different if things had gone another way, but it's been five years since they left the UK and the chances of them coming back, even for a visit, seem slim to none. Border Force is struggling to keep up with the increasing number of migrants entering the country by yacht, a leading union has claimed. People smugglers are coming up with new ways to get migrants across the English Channel into the UK ahead of a change to the maritime rules in France that will allow border police and gendarmes to stop boats from leaving waters within 300 metres of their coastline. Private boats and trawlers are growing in popularity as an ' easy and low-risk' route for bringing illegal migrants to the UK. Some 17,817 migrants have arrived so far this year, up 40 per cent on last year and the highest to this point in the year since the first arrivals in 2018. Lucy Moreton, from the ISU, which represents Border Force staff, said there simply is not enough resources to keep up with demand. 'It is a growing issue as the small-boat route becomes more challenged. It's something we have started monitoring more, but we simply do not have the staff to do everything,' she added. 'Most of the ports in the UK do not have a Border Force officer working at them so it comes down to the local police and the public. The system of boat ownership is very hard to monitor.' In April, Border Force officials intercepted a yacht off the Cornish coast and discovered 20 people hiding below deck. The 19 men and one woman, all thought to be Albanian nationals, were trying to enter the UK illegally. They were detained pending deportation, the Home Office said, and three men were arrested. About 437 migrants crossed the Channel on Friday in seven small boats, Home Office figures revealed. The number of migrants who have crossed the Channel this year now far surpasses that of previous years. By June 20 2024, 12,313 migrants had made the journey, compared to 10,518 in 2023 and 11,690 in 2022. The figures come after The Telegraph reported migrants had vowed they would 'never give up' trying to reach Britain, despite the stricter measures set to come into force in France. Jamal, a 24-year-old Sudanese man, said: 'If the police stop us in the water when we try to reach the boats, then we will go back to the beach the next day or the next week. We'll never give up.' Until now, the French have refused to intervene in the water because they claim maritime laws prevent them from taking action that could put lives at sea at risk. But the new strategy will see 'taxi boats' packed with migrants intercepted in shallow waters off Channel beaches. When The Telegraph visited Calais on Friday, there were signs that French police were taking a more interventionist approach in the migrant crisis, in response to criticism by the British Government. On Tuesday, No 10 admitted that the migrant crisis was 'deteriorating'. A spokesman said: 'Migration should be a key focus given the deteriorating situation in the Channel, they confirmed, adding that they should continue to work closely with other partners to find innovative ways to drive forward progress.'
