Dangerous Drumnadrochit dog's owner loses appeal against conviction

A woman who claimed her German Shepherd was a 'good-natured' pet after it bit a delivery driver has lost a bid to overturn her conviction.

Inverness Sheriff Court heard how the man needed stitches after the incident. She was charged with having a dog dangerously out of control following proceedings in September 2024.
Sheriff Sara Matheson ordered Diego to be muzzled and kept on a lead and muzzled when in a public place – she also ordered MacFarlane to pay Diego's victim £600.
The conviction prompted MacFarlane's legal team to go to the Sheriff Appeal Court in Edinburgh, where they argued that the judge failed to follow the correct legal tests in her decision to convict MacFarlane.
The Sheriff Appeal Court heard that if Sheriff Matheson had followed the correct interpretation of the law, MacFarlane would have been acquitted.
But in a written judgement issued by the court on Wednesday, Sheriff Principal Aisha Anwar KC, rejected defence arguments and upheld the conviction.
Sheriff Principal Anwar, who sat with colleagues Appeal Sheriff Iain Fleming and Appeal Sheriff David Young KC, said their colleague had acted correctly.
She added: 'We shall… refuse the appeal.'
During proceedings, the delivery driver, who wasn't named in the judgement, told the court that when he arrived at the property the dog was initially called away by MacFarlane's husband.
He said he did not notice the dog returning as he passed the parcel over to MacFarlane – but it was at this point that he was bitten through a gap in the gate.
In evidence, the man recalled: 'I said to the lady: 'Your dog had just bitten me and she shrugged and walked away.''
The court heard that the entrance to MacFarlane's property featured three signs warning visitors about the four-legged residents, including one that said: 'Beware of the dog, it may bite, you have been warned.'
She said six-year-old Diego was a 'beautiful, good-natured dog' who had 'never bitten anybody'.
'He is a more laying on his back with his belly getting tickled kind of dog,' she added.
MacFarlane confirmed she had installed wire to block the gaps in the fence since the incident.

Jay Emmanuel-Thomas was arrested after officers from the National Crime Agency seized an estimated £600,000 of cannabis as it was being brought through Stansted Airport by two women he had recruited – his girlfriend and her friend. An earlier hearing at Chelmsford Crown Court in Essex was told the women believed they were importing gold. But Border Force officers detected roughly 60kg (132lb) of the drug in two suitcases, which had arrived in the UK from Bangkok, Thailand, via Dubai. James Potter fought with the man, repeatedly punching him in the head and body, and pushing him to the ground. He also pushed his victim against railings and pinned him against trolleys during the incident at Morrisons supermarket in Millburn Road, Inverness. Potter, 30, appeared for sentencing at Inverness Sheriff Court having previously admitted the assault under provocation. A rapist who attacked a woman in her own Peterhead home four times over 90 minutes has been caged for eight years. Giedrius Urbonavicius, from Lithuania, was convicted by majority verdict following a week-long trial at the High Court in Aberdeen two months ago. The 54-year-old, who still maintains his innocence, will now be on the sex offenders register indefinitely and faces another three years of being on licence when he is eventually released back into the community. He was sentenced for the crime at the High Court in Aberdeen on Wednesday. An Inverness teenager has been given the opportunity to change her criminal behaviour to avoid going to jail. Rebecca Tuthill, 19, appeared by video link from HMP Stirling at Elgin Sheriff Court on Thursday for sentencing after admitting to a series of charges involving threatening and abusive behaviour, breaching her bail conditions, and even attacking two police constables. Sheriff Robert Frazer, overseeing the case, said she now needed to prove she could 'change'. Ryan, 32, appeared at Inverness Sheriff Court to be sentenced having previously admitted three counts of theft by shoplifting, two of assaulting retail workers, one of threatening behaviour and one of breaching a bail condition to stay away from a certain store.

Upper Eden man fined for aggressive dog's attack on gardener

A man whose German Shepherd repeatedly bit a gardener working at his home has been Holroyd thought his pet Rebel was locked in his house, but it managed to push up a door latch and attack Jilly Sandams on 23 June 2024. Appearing at Carlisle Crown Court, the 60-year-old of Upper Eden, near Kirkby Stephen, Cumbria, admitted having a dog which caused injury while dangerously out of Michael Fanning fined Holroyd £150 and made a contingent destruction order, meaning the dog must be kept under strict control including being locked away from visitors and wearing a muzzle in public. Holroyd was also ordered to pay £2,000 compensation to his victim. The court heard Ms Sandams had decided to accept the landscape work even though she knew the dog was aggressive, because she knew it was kept inside. However, the court heard that while she was working, the dog would throw itself against a patio Tim Evans said Ms Sandams became so concerned she texted the dog's owner saying it was "going to take the door out" with its "intense thrusting against it". 'Going to die' On the day of the attack, she let herself into the garden and could hear the dog "barking and being aggressive", but thought it was locked the dog escaped and attacked her as she lay on the ground, leaving her with six bite marks and 12 puncture wounds to her arm. Ms Sandams eventually managed to get up and escape through a gate. In an impact statement, she said she thought she was "going to die". 'Integral part of family' The court heard that Holroyd, a former highways worker, was left paralysed and a co-worker killed in 2016 when they were struck by a dangerous driver on the M6 near Smith, defending, said there had been no further incidents and a dog expert had concluded Rebel did not pose a threat if kept under control."The dog is an integral part of their family, notwithstanding what has happened," Mr Smith said. The judge told Holroyd: "You were badly injured in the course of your employment, helping the public. "The last thing you would want to do is cause harm to anybody else." The former glamour model, 47, took to Instagram on Monday to share a glimpse at her new Sphynx cats which she calls her 'babies'. The mum-of-five posted a picture of four cats and alongside it wrote: "My bald babies" - referring to the fact that Sphynx cats famously don't have any hair. ‌ The former model has never shied away from sharing her love of animal s and has had dozens of pets in recent years. In 2020, a petition was made to put a ban in place to stop her from owning animals. The petition launched on has since had over 37,000 signatures following some heartbreaking revelations about Katie's pets. ‌ Her beloved German Shepherd dog was killed on the A24 close to her home, seven months after another of her dogs was killed on the same road. Her horse was also killed on the same road after breaking free from Katie's fields. In 2020, her French Bulldog puppy Rolo suffocated after becoming trapped under a chair. A spokesman for JRC Bullies - who 'gifted' to dog to the Loose Women star - stated to the Mirror at the time: 'We are heartbroken that this has happened as we told Katie not to leave a small puppy on its own. We can't believe that the puppy was left unattended as we had left strict instructions.' ‌ In the petition, the writer states: 'A puppy has died in the last 24 hours in Katie Price's care she bought this puppy for her 13 year old child 3 weeks ago. Which was killed in a accident no one witnessed.' They allege: 'In the last 5 years more animals have died from lack of care. Horses. lizards hedgehogs. This isn't a single family tragedy. It's a common thing in Katie Price's home. ‌ "2 dogs have been ran over. Puppies were found dead drowning in a neglected swimming pool. A horse was run over on a motorway. Animals just go missing in her home never to been seen again.' Katie's care of her animals - and last year even offered to give her £5000 cash if she signs a legal agreement promising not to buy another pet. Reports indicate that at least eight of Katie's animals have passed away under her care in a variety of different ways, including five dogs, a horse, and a chameleon.
