SC orders status quo on Bhushan Power liquidation, allows JSW Steel to file review
The Supreme Court on Monday ordered a status quo on the liquidation proceedings of Bhushan Power and Steel Ltd (BPSL), granting relief to JSW Steel Ltd and allowing the company to file a review petition against the court's 2 May verdict that had quashed its ₹ 19,300 crore resolution plan.
A bench comprising Justices B.V. Nagarathna and Satish Chandra Sharma directed the National Company Law Tribunal (NCLT) to keep the matter pending until the apex court decides on JSW Steel's review plea.
'Without expressing any opinion at this juncture, we find that the interest of justice will be served if status quo is maintained in the proceedings pending before the NCLT,' Justice Nagarathna said. 'We clarify that this order of status quo will operate until the consideration of the review petition.'
The court asked JSW Steel to file the petition within the prescribed limitation period, which is 30 days.
The court's decision came in response to a plea filed by JSW Steel seeking a stay on the liquidation process initiated by Bhushan Power and Steel's former promoter Sanjay Singhal.
Singhal had approached the NCLT urging immediate commencement of liquidation proceedings following the Supreme Court's 2 May judgment cancelling JSW Steel's resolution plan and directing BPSL's liquidation.
JSW Steel, in its application, had requested the Supreme Court to defer the liquidation process for 60 days to give it time to file a review petition.
The top court's interim relief now enables the steelmaker to approach the court with a review plea without parallel liquidation proceedings continuing before the NCLT.
The Supreme Court indicated that the matter will likely be heard after the court's summer vacation, and after JSW Steel files its review petition challenging the court's earlier judgment.
The Supreme Court's 2 May ruling was a major setback for JSW, which acquired BPSL through the corporate insolvency resolution process more than five years ago and has since made substantial investments in the company.
The apex court had set aside the resolution plan on grounds of non-compliance with key provisions of the Insolvency and Bankruptcy Code, particularly the failure to adhere strictly to the plan's approved timeline.
The review petition is significant for JSW Steel, not just from a legal standpoint but also due to the financial and strategic importance of Bhushan Power and Steel to its domestic operations.
As of 31 March 2024, JSW Steel carried net assets worth ₹ 14,091 crore related to BPSL on its consolidated balance sheet. BPSL's Odisha-based plant has a capacity of 4.5 million tonnes per annum (MTPA), forming a key part of JSW Steel's total domestic capacity of 34.2 MTPA—the highest in India.
Appearing for JSW Steel before the Supreme Court on Monday, senior advocate Neeraj Kishan Kaul questioned the locus standi of Singhal, pointing out that he is under investigation by the Enforcement Directorate for alleged malpractices.
Solicitor General of India, Tushar Mehta, appearing for BPSL's committee of creditors, also questioned Singhal's locus standi in the case. 'They are already under a chargesheet. Having left the company years ago, they are now pressuring the NCLT. You are the creator of the problem,' Mehta said.
Senior advocate Dhruv Mehta, appearing for Singhal, opposed JSW Steel's plea, arguing that the steelmaker's petition against the NCLT order was not maintainable since the appellate remedy had not been availed.
He added that the Supreme Court had in its 2 May judgment acknowledged Singhal's locus standi and highlighted several faults of BPSL's committee of creditors.
Solicitor General Tushar Mehta suggested deferring the NCLT proceedings until 10 June, emphasizing the need to avoid further complications.
'This was a resolution plan implemented five years back. We have taken the money. Now, to reverse everything… they have taken money from other banks. Some of them are foreign banks. It will be difficult for them to deal with foreign banks. So some way will have to be found out,' Mehta said.
Bhushan Power and Steel was among the first 12 large defaulters identified by the Reserve Bank of India in 2017 for resolution under the Insolvency and Bankruptcy Code, with total dues of over ₹ 47,200 crore. At the time of its insolvency admission, the company owed more than ₹ 45,000 crore.
JSW Steel's ₹ 19,300 crore resolution plan was the highest bid received and was approved by the NCLT in September 2019, and later upheld by the National Company Law Appellate Tribunal (NCLAT) in February 2020.
Despite ongoing litigation, including legal challenges mounted by Sanjay Singhal, JSW Steel went ahead with the resolution plan, making substantial payments and taking operational control of the BPSL plant in Odisha.
In a post-earnings call last week, JSW Steel's joint managing director Jayant Acharya said the company had 'implemented the resolution plan of BPSL in compliance with the law and taken steps to successfully revive the company to its present state today'.
He added that JSW Steel expected its compensation rights to be upheld following the Supreme Court 2 May decision.
JSW Steel has also issued demand notices to a group of banks, seeking refunds of the funds disbursed as part of the now-invalidated resolution plan.

Adani commissions India's first off-grid 5 MW green hydrogen plant in Gujarat
The Adani Group has announced the successful commissioning of India's first off-grid 5 megawatt green hydrogen pilot plant in Kutch, Gujarat. Developed by Adani New Industries Limited (ANIL), the clean energy arm of Adani Enterprises Ltd. , the plant represents a significant advancement in the country's pursuit of clean and self-reliant energy solutions. An off-grid green hydrogen plant generates hydrogen through electrolysis powered solely by renewable energy—such as solar or wind—without any connection to the conventional power grid. This means the plant operates independently, relying fully on its own renewable energy infrastructure. Describing the development as a key milestone supporting India's National Green Hydrogen Mission, the Adani Group said the project establishes technical feasibility and sets new standards for off-grid, renewable-powered applications of green hydrogen in high-emission sectors. "The state-of-the-art plant is 100 per cent green-powered by solar energy and integrated with a Battery Energy Storage System (BESS), enabling it to operate completely off-grid. This represents a new paradigm in decentralised, renewable-powered hydrogen production," the company said in a statement. Hydrogen, the most abundant element in the universe, is also one of the cleanest fuels—emitting only water vapour when used. Its environmental impact varies based on production methods. Hydrogen made from fossil fuels is classified as grey, while green hydrogen is produced using electricity from renewable sources to split water molecules into hydrogen and oxygen. Live Events ANIL is building an end-to-end ecosystem for large-scale green hydrogen production and its derivatives. This includes green ammonia, green methanol, sustainable aviation fuel, as well as the manufacturing of solar cells, ingots and wafers, solar modules, wind turbine generators, and electrolysers at its facility in Mundra, Gujarat, aimed at meeting both domestic and global demand. The Kutch-based pilot facility is also India's first of its kind to feature a fully automated, closed-loop electrolyser system that adjusts dynamically to real-time renewable energy inputs. This allows for enhanced operational flexibility to address the inherent variability in solar power generation while ensuring safety, efficiency, and high performance. "This breakthrough reinforces the Adani Group's commitment to innovation, sustainability, and leadership in the emerging green hydrogen economy . It supports India's ambition to become a global hub for green hydrogen production and sets a benchmark for renewable-powered industrial applications across hard-to-abate sectors," the statement added. The pilot plant also acts as a proof of concept for ANIL's upcoming Green Hydrogen Hub in Mundra—an ambitious project expected to significantly contribute to India's low-carbon transition. Green hydrogen is seen as a critical tool for decarbonising challenging sectors such as fertilisers, oil refining, and heavy transport, and plays a central role in achieving global net-zero targets.

Gujarat Electronics Component Manufacturing Policy aims to reduce import dependency
Ahmedabad: Incentives for projects approved by MeitY , quick disbursal of assistance and reducing import dependency by attracting over ₹35,000 crore in new investments are among the prominent features of the Gujarat Electronics Component Manufacturing Policy-2025. The policy, which aims to transform Gujarat into a global hub for electronics manufacturing , was unveiled by Chief Minister Bhupendra Patel on Sunday. The policy states that projects approved and supported by the Union Ministry of Electronics and Information Technology (MeitY) will be eligible for 100 per cent Central assistance when established in Gujarat. Projects approved by the MeitY will receive incentives from both the Centre and the state government through a single approval and incentive assistance will disbursed within 30 days, a government release stated. "This means MeitY-approved projects set up in the state will receive dual incentive benefits from the Central and Gujarat governments," it said. Aligned with the Union government's Electronics Component Manufacturing Scheme (ECMS), the policy ensures "a 100 per cent top-up on Central support while guaranteeing timely disbursement of assistance. "Once a project is approved under the ECMS from MeitY, it will automatically become eligible for the same grant-in-aid in Gujarat. The state government will disburse its incentive within 30 days of the Centre releasing the assistance," the release said. The policy aims to reduce dependence on imports and improve technological resilience by attracting over ₹35,000 crore in new investments. It aims to create substantial high-skilled employment opportunities within the state's electronics component manufacturing sector. The policy hopes to boost investment in key segments, such as multi-layer and HDI printed circuit boards, lithium-ion cells, SMD passive components, display and camera modules, electronic parts, and the additional machinery for their production. "The policy's core focus is to bridge the talent gap, promote innovation, and offer support for research and development initiatives, with the recognised Gujarat-based institutions being eligible for assistance of up to ₹12.5 crore to establish centres of excellence, finishing schools, or applied research laboratories," the release stated. The policy aims to establish Gujarat as a prominent player in global electronics supply chains by promoting the manufacturing of local electronic components and sub-assembly production, reducing import dependency, and boosting exports, which will drive product value growth in global electronics value chains (GVCs). The Government of India (GoI) guidelines mandate the submission of applications to avail of the benefits of this policy by July 31, 2025. All MeitY-approved projects operating in Gujarat will automatically become eligible for availing of the policy benefits along with developing or proposed projects for incentives. The government said only the units other than those receiving assistance under Gujarat Electronics Policy 2022-28 will be eligible for benefits under this policy, and those availing benefits under this policy will not qualify under the Gujarat Electronics Policy.
