Motorist awarded R26. 6m after pothole accident leaves her paraplegic
A North West Province woman who is left a paraplegic after her car hit a pothole and overturned, is set to receive R26.6m in damages from the province's roads department.

A pothole in the North West Province will cost the MEC of the Department of Public Works, Roads and Transport more than R26.6 million after a motorist was involved in an accident when she drove through the pothole, which left her a paraplegic.
The North West High Court, sitting in Mahikeng, ordered the department about three months ago to pay this amount to the plaintiff, only identified as Beauty. However, the department has to date not yet paid up.
Her attorney, Righardt Bezuidenhout, said the department promised that it would pay by Wednesday. However, by the time of publication, she had not yet been paid.
Bezuidenhout had obtained an order to attach the assets of the provincial department, to sell at auction in a bid to receive payment. The department, in the meantime, promised to make the payment to avoid its assets being sold at public auction.
Bezuidenhout earlier managed to secure an order against the provincial department after proving that the pothole was the cause of the accident, in which Beauty was left a paraplegic. She lost control of her car in 2014 when she hit the massive pothole on a public road, and her vehicle overturned.
The provincial department was held responsible as it was proved to have been negligent for not fixing the pothole earlier. The court was told that the pothole had been there for some time and that it was fixed a few days after the accident.

The provincial department was held 100% liable for the damages she could prove she had suffered as a result of the accident. Beauty was a highly functional nurse prior to the accident, but she is now left helpless and needs around-the-clock assistance.
During the second leg of the court case earlier this year, a host of experts were called in a bid to determine how much compensation Beauty should receive. The damages claimed by her were for past medical expenses, future medical expenses, loss of earnings, and general damages.
In determining her damages, Deputy Judge President Tebogo Djaje considered the fact that Beauty was employed as a professional nurse at the time of the accident. She had been in service for approximately 25 years.
Since the accident, she has not been employed and was medically boarded in 2016. She will not be able to return to work as she presents with a physical impairment of 77%, according to the orthopaedic surgeon.
Apart from being wheelchair-bound, she uses an indwelling catheter as well as nappies and is completely dependent on her daughter for assistance. The only physical activity that she can do is gardening to a limited degree.
According to the experts, the plaintiff will require extensive future treatment. Apart from spinal injuries, she also suffered a hip fracture, as well as shoulder and rib fractures. Her injuries further left her with several scars, and she lost four of her front teeth.

Image: EFF EFF leader Julius Malema and the top leadership of the party are expected to return to KwaZulu-Natal to attend the mass funeral of the party members that died in a bus accident. Ten party supporters died and scores of others were injured when their bus collided with a long-haul truck near Vryheid, north of the province, on Monday night. They were returning from the party's Youth Day commemoration rally, which was held at King Zwelithini Stadium in Umlazi, south of Durban, on Monday. Malema's return to the province was confirmed by the party provincial secretary, Vukani Ndlovu, on Thursday. According to Ndlovu, the party's top leadership would attend the mass funeral over the weekend in remembrance of the fallen heroes and heroines. 'We are expecting our Commander-In-Chief, Julius Malema, and the top national leadership to come back to the province to honour the funeral of our tragically departed fighters.' He said the funeral will take place on Saturday in Vryheid, but the venue still needs to be confirmed, adding that the party is finalising the preparations, including securing a ground or an open space to erect marquees. The party will also carry all funeral costs. Ndlovu said 37 injured people have been discharged, except four who are still in the hospital. Provincial Transport MEC Siboniso Duma visited the scene with department officials, visiting the hospital to see the injured passengers as well as the families of the deceased. Although police are still investigating the cause of the accident, it is believed it was caused by poor visibility in the early hours of darkness, which may have led the bus driver to not be able to see the truck. The MEC said both the SAPS and Road Traffic Management Cooperation will conduct a comprehensive investigation to establish the cause of the accident; however, he received conflicting versions about what happened from the survivors. 'There are allegations that the bus driver tried to overtake. Other survivors have alleged that the bus driver fell asleep at the steering wheel. We do not want to speculate at this stage. We are confident that the investigation will shed light. Critically, we have in the past expressed our concerns about accidents involving trucks,' said Duma. The MEC said trucks are not supposed to be on this road in the first place and should be using the N2, adding that many innocent lives have been lost due to a huge number of trucks on the roads. The truck was believed to be headed to the Richards Bay port to offload coal for export. Over 303,000 trucks, or almost 6,000 trucks every week on average, used the Richards Bay port in the 2024 fiscal year, according to Transnet, Duma stated. He said it has been stated that the port's infrastructure was originally designed for a much smaller volume of trucks, approximately 200 per day. Picture: Supplied DURBAN - The KwaZulu-Natal Transport Department has kicked off an investigation into a bus crash which claimed the lives of 12 Economic Freedom Fighters (EFF) supporters. The group was travelling from the party's Youth Day rally in Umlazi on Monday. A truck struck a bus that the supporters were travelling in on the R34 near Vryheid on Monday night. The crash has left a devastating impact on the R34, forcing the closure of the road. And as emergency services work on the scene of the crash, an EFF-branded hat from one of the victims lies on the floor. READ: 12 EFF members killed in vehicle collision near Vryheid While 12 people are confirmed dead, 10 others sustained serious injuries, 22 were slightly injured, whole 6 passengers escaped unharmed. "The victims were dismembered. The body parts were actually all over and some body parts are missing," said the spokesperson for the KZN transport MEC, Ndabezinhle Sibiya. MEC Siboniso Duma is also visiting the accident scene.
