Portions of seven structures near airport removed for height violations, action will continue: State to HC

The state government on Wednesday informed the Bombay High Court that portions of seven structures in the vicinity of the Mumbai International Airport that flouted height norms have been removed and the suburban district collector has complied with the court orders.
The government reply stated that the Mumbai Suburban Collector's office will coordinate with the BMC and Mumbai Metropolitan Region Development Authority (MMRDA) for 'any action as may be required to be carried out in the future.'
A bench of Chief Justice Alok Aradhe and Justice Sandeep V Marne was hearing a PIL filed by advocate Yeshwanth Shenoy, in 2019, raising concerns about airport safety.
The plea had sought actions against the owners or developers of high-rise buildings/structures around Mumbai airport, that created 'obstacles' and caused threats to take-off and landing of flights. In July 2022, the HC had directed the collector to take steps to remove 48 structures consisting of unauthorised portions of buildings near Mumbai Airport flouting height norms and are in the way of approach surfaces of runaways.
On March 26 and May 6, the bench had asked the collector to remove the concerned portions from the seven structures including the portions at Faiz CHSL, Allwin Apartments CHSL, Fazal House CHSL and Farzaan Apartment CHS in Kurla. The offending portions also included those from two structures at Rizwi Nagar Co-operative Housing Society Wing C and E and an offending portion at Dheeraj Heritage Premises in Santacruz (West).
The compliance affidavit filed through the Collector's office stated that all of the owners have removed the portions including water tanks, antenna, iron pipes and have also made changes in respect of the concrete structures. The affidavit further stated that the removal of structures was confirmed by Mumbai International Airport Limited (MIAL) after an inspection.
The affidavit further stated that in addition to compliance of HC directions, it has directed the Brihanmumbai Municipal Corporation (BMC), the planning authority, to issue notices under Maharashtra Regional Town Planning (MRTP) Act to remove unauthorised structures.
The bench took the affidavit submitted by Government Pleader Neha Bhide on record and posted further hearing after four weeks to be heard by an appropriate bench not consisting of Justice Marne, as he recused from hearing the matter.

'You have to take action to ensure that this should not happen in the future. This should not happen,' said Chief Justice Aradhe during the hearing. Additional Solicitor General (ASG) Anil Singh, representing the Railways, informed the court that a multidisciplinary committee headed by a senior divisional safety officer has been constituted to investigate the incident. The report from this committee is awaited."Apart from this, looking into the concerns about the safety of daily commuters, the railway has set up a high level committee, which is a separate committee from the Mumbra incident, and the entire object of the committee is 'zero death mission'. This is on the entire Central and Western Railway. That committee is already working and a number of steps have already been taken,' Singh told the the bench expressed grave concern over the continuing accidents. 'No, but obviously, these steps taken by you are clearly not sufficient. What should be done?' the Chief Justice Marne cited railway data from 2024, which recorded 3,580 deaths — an average of 10 fatalities per day. 'This is an alarming situation. Ten deaths every day! This is your own data,' he said. He acknowledged a 46 per cent reduction compared to 2009 but emphasised that the numbers remain Justice Aradhe underlined the need for immediate and effective action. 'What is required to be done, do it. This can't be accepted. The doors should not be open and you should ensure that there is no scope for falling,' he Singh then told the court that the railways are working towards that and have already undertaken work like fencing of railway tracks so that trespassing can be curtailed. 'Construction of fencing between two railway tracks is also being looked into. Four men from Maharashtra were arrested by the Special Operations Team (SOT) of the LB Nagar Zone and the Hayathnagar police for smuggling 166 kilograms of ganja worth ₹50 lakh through Hyderabad. The accused were identified as Vikas Baban Salve, 30, a painter from Sangamner, Ahmednagar; Ranganath Yurajn Sadve, 36 and Amol Narayan Borde, 26, both farmers from Aurangabad; and Sagar Gajanan Khandebharad, 29, a Railway employee from Buldhana. Amol was driving the goods carrier vehicle used in the smuggling operation. According to police, Vikas was the main link to the supply source. Struggling financially, he came into contact with a man known as Maik alias Rahul alias Dass, a resident of Kurumanur village in Kalimela tehsil of Odisha's Malkangiri district. Observing the strong demand for ganja among labourers in Maharashtra, Vikas decided to capitalise on it and roped in his three acquaintances to assist in the operation, promising quick profits. On June 19, the group travelled to Odisha, procured the ganja from Maik, and began their return journey. However, acting on a tip-off, the police intercepted their vehicle on Friday and took all four into custody. Alongside the ganja, officials recovered four mobile phones and ₹6,200 in cash. Police investigations revealed that Vikas is already facing a non-bailable warrant in an earlier ganja case registered by Alair police, while Ranganath has a pending warrant in an Narcotics Drugs and Psychotropic Substances (NDPS) Act case in Badrachalam dating back two years. Efforts are underway to trace the main supplier, Maik.

Bombay HC discharges CA of Chhagan Bhujbal, family in money laundering case by ED

The Bombay High Court Monday discharged the chartered accountant (CA) of NCP leader and minister Chhagan Bhujbal and his family from a money laundering case registered by the Enforcement Directorate (ED) in 2015. The high court, while hearing the criminal revision application by CA Shyam Radhakrishna Malpani, noted that the special court committed an error in rejecting the discharge plea in March 2021. A single-judge bench of Justice Rajesh N Laddha observed that 'mere absence of due diligence by applicant does not amount to the commission or omission of an offence under Section 3 (money laundering) of the Prevention of Money Laundering Act (PMLA).' The ED had lodged a case against Chhagan Bhujbal and others based on a complaint filed by the state Anti-Corruption Bureau (ACB) in 2015. It was alleged that land belonging to the Regional Transport Office (RTO) in Andheri was handed over to a developer firm when Chhagan Bhujbal was the deputy chief minister and the state Public Works Department (PWD) minister of Maharashtra from 2004 to 2014. As per the agency, the said project was awarded to the developer in lieu of the construction of Maharashtra Sadan in Delhi and the RTO building in Tardeo. The ED had arrested Chhagan Bhujbal in 2015 for alleged money laundering, and he remained in custody until 2018, when the Bombay High Court granted him bail. Chhagan Bhujbal, his son Pankaj Bhujbal, nephew and former MP Sameer Bhujbal and five others were discharged by a special court in 2021 from the ACB case. In the case of Malpani, the ED had alleged that he actively participated in the offence of money laundering while serving as the CA for the entities controlled by the Bhujbals. As per the central agency, Malpani was responsible for auditing financial records and was aware of the suspicious transactions and sham arrangements carried out by these entities. Advocate Hiten Venegaonkar for ED argued that the applicant conducted audits of companies controlled by Bhujbals and, in doing so, camouflaged illicit transactions and concealed the unlawful flow of proceeds of crime generated by the Bhujbals. However, senior advocate Pranav Badheka for Malpani submitted that Chhagan Bhujbal and his family members were discharged by the special court in two predicate offences on which ED had lodged its case. Badheka argued that Malpani, who was a statutory auditor, had a limited role to form an opinion on whether company accounts are properly maintained or not and the auditor is not expected to function as an investigator. The plea claimed that Malpani audited financial accounts only for a period from the financial year ending March 2012 to 2015, and alleged proceeds of crime are claimed to have originated around 2007-08. Badheka argued that there was no evidence or material on record or in complaint to show that Malpani failed in his duties as auditor, and so he should be discharged from the case. Justice Laddha, in his order, observed that 'the role of the auditor is inherently distinct from that of the investigating agency.' 'The complaint lacks material to establish a nexus between the applicant and the alleged criminal conspiracy or money laundering activities. Moreover, the applicant has neither been named nor charge-sheeted in the related crimes, which further reinforces the absence of any direct or indirect involvement in the purported criminal conduct,' the high court held and set aside a special court order, discharging Malpani from the money laundering case.
