Oil firm detects theft from pipeline, lodges FIR in Buxar

(IOC) officials on Thursday lodged an FIR against unidentified persons for oil theft from the IOC's Barauni-Kanpur pipeline at Nuawan village under Krishna Brahm police station area of Buxar district.
Krishna Brahm SHO Chanchal Kumar said, "We have received a complaint regarding the oil theft and initiated an investigation into the matter. Charges have been filed under the Petroleum and Minerals Pipelines Act, Explosives Act, Prevention of Damage to Public Property Act, and the relevant sections of the Indian Penal Code."
According to Indian Oil engineer, Vishal Kumar, the illegal activity came to light during a routine inspection on June 16 around 7.30am.
Security guard Pramod Kumar observed signs of fresh excavation and disturbed soil above the pipeline, and promptly alerted the authorities. A joint team from Indian Oil and the local police reached the spot and found that a 2-inch illegal valve had been installed on the pipeline for stealing oil, resulting in the leakage.
"This act not only damaged national infrastructure, but also posed a serious safety hazard due to the highly flammable nature of the product," said Kumar, adding that the disruption in supply triggered a temporary fuel crisis in the surrounding areas.

Assam court frames charges against IPS officer in 2019 sexual harassment case
A Special Court in Assam's Karbi Anglong recently framed charges under the Protection of Children from Sexual Offences Act (POCSO) and for sexual harassment against IPS officer Gaurav Upadhyay in a six-year-old case from the time when he was the Superintendent of Police (SP) of the district. In an order issued on June 18, R. Lal., the Special Judge, POCSO of Karbi Anglong framed charges under section 354 and 354A of the Indian Penal Code – provisions that pertain to criminal force to a woman 'with intent to outrage her modesty' and sexual harassment – and Section 10 of the Protection of Children from Sexual Offences Act against Upadhyay and set July 21 as the next date of hearing. On that day, the court is scheduled to inquire whether he pleads guilty or intends to face trial. The incident, involving a minor girl, allegedly took place in 2019 and a police case was registered in January 2020. The Criminal Investigation Department (CID) had probed the case and subsequently submitted its chargesheet against the IPS officer in 2021. The court has recorded that there are two alleged incidents from 2019. In its order, the court noted that the case has been in the pre-trial for several years. On the June 18 hearing as well, the counsel for the accused had sought directions of the court to call for the investigating officer to produce statements of 13 witnesses not relied upon at the time of submitting the chargesheet. 'The chargesheet is for an offence under the Protection of Children from Sexual Offences Act. The legislature has mandated a time-bound completion of trial in such cases. Judicial precedents also direct the trial courts to expedite such cases, placing them on the fastest track possible. It is noted that this case has remained at the pre-trial stage for several years and further adjournment runs the risk of infringing Article 21 of the Constitution, a right available to the victim with equal vigour,' states the order. Upadhyay, is an IPS officer of the 2012 batch. He is currently the additional secretary of the state transport department, the state project director of the Assam Inland Water Transport Development Society, and the project officer of Assam Integrated River Basin Management. Bringing on record the statement of the victim, the court stated, 'The court has perused all relevant materials furnished by the prosecution side, including the statement of the victim. This court has also heard both sides. Based on the materials, there is ground for presuming, under section 288 CRPC, that the accused has committed an offence under Section 10 of the POCSO Act. IT is pertinent to mention here that there were two incidents of sexual assault on the victim. The first assault occurred in SP Bungalow in Diphu. The second assault took place in the hotel room where the victim was staying with her mother and brother'.

Man, son get double life imprisonment for double murder case
The Second Additional District Court in Tiruchi on Saturday sentenced two men to double life imprisonment in connection with a revenge double murder committed in 2020. The court imposed a fine of ₹2,000 on each of the convicts, according to the police. The case dates back to a 2005 land dispute in Nadu Irungalur village, where A. Rokkuraaj, 68, was convicted of murdering Arokiyasamy. Rokkuraaj served a life sentence and was released from prison in 2018. In what was believed to be an act of retaliation, Jesuraj, 61, — Arokiyasamy's son — along with his son Prince Fernandes, 28, and daughter-in-law Gnanasundari, 28, allegedly murdered Rokkuraaj and his son John David, 33, in 2020 using logs and knives. Following a complaint lodged by Irudhayamary, wife of Rokkuraaj, Samayapuram Police registered a case under Sections 34, 341, and 302 of the Indian Penal Code. After trial proceedings, the court convicted Jesuraj and Prince Fernandes, while acquitting Gnanasundari.

Special court in Assam orders framing of charges under POCSO, IPC against IPS officer
A special court in Assam has ordered the framing of charges under the POCSO Act and other sections of the IPC against IPS officer Gaurav Upadhyay in a six-year-old alleged sexual molestation case. The special judge, Protection of Children from Sexual Offences (POCSO) court, Karbi Anglong, R. Lal, in the order, said that there were "two incidents of sexual assault on the survivor" by the accused, who was the superintendent of police of that district at the time of the incident. "The first assault occurred in the SP Bungalow at Diphu. The second assault took place in the hotel room where the survivor was staying with her mother and brother," it said. A copy of the order, which was passed on Wednesday, was made available to PTI on Saturday. The incident, involving a 14-year-old girl, took place in December 2019 and a police case was registered in January 2020. The Criminal Investigation Department (CID) had probed the case and submitted its charge-sheet against the IPS officer subsequently. An IPS officer of 2012 batch hailing from Uttar Pradesh, Upadhyay is currently the Additional Secretary of the State Transport Department; State Project Director, Assam Inland Water Transport Development Society; and Project Officer, Assam Integrated River Basin Management. The judge noted that as Upadhyay was the Karbi Anglong SP at the time of the incident, it occurred within the limits of his jurisdiction and control as a police officer, attracting clauses (i) and (l) of Section 9 of the POCSO Act and punishable under Section 10 of the same law. Use of "criminal force to kiss" the victim and "physical contact and advances" by touching her private parts, as stated specifically by the minor in her statement, leads to charges under Sections 354 and 354A of the Indian Penal Code (IPC), the order said. It also said that the case has remained at the pre-trial stage for several years, whereas judicial precedents direct trial courts to expedite such cases with the legislature also mandating a time-bound completion of trial in POCSO Act cases. "In the circumstances, charges under Section 10 of the POCSO Act and Sections 354, 354A of the IPC are hereby framed," the special judge ruled. Section 10 of the POCSO Act deals with the punishment for aggravated sexual assault, while Sections 354 and 354A of IPC are for offences related to assault or criminal force on a woman with the intent to outrage her modesty or sexual harassment. The special judge has fixed August 21 as the date for recording the accused's plea concerning the charge and necessary order.
