Mpumalanga man claims R2 million for police assault, awarded R130,000
A man claimed R2 million form the police after he was locked-up for two days in a police cell. He also claimed he was severely assaulted by the SAPS

A damages claim of R2 million by a Mpumalanga man against the police for unlawful arrest and detention and 'severe' assault resulted in the court only granting him compensation of R130,000.
This, after the Mbombela High Court found that Lwazi Mdluli exaggerated somewhat about the injuries he had suffered at the hands of the police.
Mdluli claimed R1 million from the police for his suffering in being locked up in a police cell for two days, as well as another R1 million for the assault he said he endured.
He told the court that in January 2023, near Newscom Trust in Mpumalanga, he was travelling in his car with his wife and daughter. He was stopped by the SAPS at Kabokweni Police Station on allegations that he had committed robbery and attempted murder.
Mdluli testified that the officers blocked his car, and when he got out, he was pushed to the ground. He said he was assaulted several times on the face with open hands by four police officers and was trampled upon with booted feet.
He said he was taken to the police vehicle, where he was instructed to touch a firearm in the vehicle. When he refused, the officers continued to assault him.
Mdluli described how, at one point, his hands were cuffed behind his back along with his feet. His face was covered with a plastic bag. When the bag was eventually removed, water was poured into one of his ears, and he was slapped several times with an open hand on the ear.

He claimed his nightmare ordeal did not end here, as he was taken to the police cells, where he was accused of breaking into the house of a police officer and stealing his firearm. He was taken to court, but he never appeared before a magistrate, as he was told he could go home.
Mdluli testified that it humiliated him to have been assaulted in the presence of his wife and 15-year-old daughter. The assault took place in public, and members of the community gathered and took pictures and videos of the incident. Those pictures were posted on Facebook, thus injuring his dignity.
On the conditions of the cells, he testified that, whilst in custody, he had to take a cold shower, and he did not have toiletries. The cells were filthy, and he was detained with five other inmates. They had no privacy in using the ablution facilities.
Although he was provided with two meals a day, they were not of the same standard that he was used to at home. Mdluli said he was used to having three meals per day.
The court commented that his evidence was riddled with exaggerations, and if regard is had to his injuries, it cannot be found that the assault was grievous to the extent testified to by Mdluli.
He was awarded R80,000 in damages for being detained for two days and R30,000 for the assault he had to endure.

Williams drove the hitmen to the property and they gained access via a security gate at about 4am and entered the couple's flatlet. '[Kulsoem Dennis] heard the voice of an intruder asking where the money was in Afrikaans before brutally attacking her. The intruder hit her on the head, neck and chest with a gun. She chanted, 'Allahu-Akbar' [God is Great] until she hit the floor. Severely injured and in shock, she lay on the floor, pretending to be dead as her [headscarf] fell softly over her face and she kept her eyes closed,' said Ntabazalila. Her husband was attacked as he came out the bathroom and died after being stabbed 15 times. Ibtisaam Dennis called the police, whose investigation confirmed her husband was the mastermind behind the attack.

These were the sentiments of Judge Gayaat Salie-Da Silva of the Western Cape High Court when she handed down two life sentences plus 15 years imprisonment to Reagan Davids for the brutal murder of 75-year-old Hashim Ahmed Dennis, and the attempted murder of his 70-year-old wife, Kulsoem Dennis. Davids faced charges of housebreaking with intent to commit murder, robbery with aggravating circumstances, attempted murder of Kulsoem, attempted murder of Ibtisaam Dennis, and premeditated murder of Hashim Ahmed. The main accused in the matter, Brent Williams, died on February 10 shortly before the conclusion of the murder trial. Williams was the son-in-law of the Muslim couple who were attacked in their Northpine home near Brackenfell, Cape Town. The elderly couple was getting ready for their morning prayer when the vicious attack occurred, and the now-widowed wife, Ibtisaam, barely survived the assault. According to details that emerged during the trial, Williams had arranged the contract hit to 'neutralise' his marital problems he had been experiencing with Ibtisaam. National Prosecuting Authority spokesperson, Eric Ntabazalila, said the two life sentences would run concurrently. The court heard that in the early hours of January 31, 2020, Williams was observed through CCTV footage driving with the two co-perpetrators in his red maroon bakkie to the vicinity of 6 Conifer Close. He dropped them and drove off to wait until they finished the job. They gained access to the property through a security gate, which was not forced open. The early hours of the morning, around 4am, are the time the devout Muslim worshippers prepare for Fajr - a sunrise prayer. During the attack, Hashim suffered multiple stab wounds, while Kulsoem faked being dead after being hit on the head, neck, and chest with a gun before dropping to the floor, where her burka covered her face. Ibtisaam heard a noise and noticed the bright light from her parents' flatlet. She went to investigate and met a knife-wielding intruder who charged at her. She quickly turned around and closed the sliding door to the main house, saving herself and her two children. Moments after the attack, CCTV footage captured the two attackers running back to Williams, getting in the bakkie, then driving off. Judge Salie-Da Silva in judgment said: 'These offences are marked by exceptional brutality, targeting vulnerable elderly victims in a sanctified setting. The level of violence, disregard for human life, and the psychological terror inflicted upon the surviving victims and, so too, the surrounding community, warrant the imposition of a long period of direct imprisonment… 'The proverbial saying that fact is stranger than fiction is a startling and disturbing feature of the events which took place in the early morning hours of Friday, 31 January 2020, and at the home of the victims. Elsies River parents fear for children's safety after deadly daytime shootings
A 27-year-old man was gunned down in an alleged gang-related shooting. Elsies River parents are concerned about the safety of their children after two separate shooting incidents in the middle of the day left three people dead on Wednesday. Communities such as Eureka Estate, Clarke Estate, Uitsig, Ravensmead and surrounding areas have been under siege from continuous gun violence. School learners had to scramble to safety when a 27-year-old man was gunned down in an alleged gang-related shooting in Gladiola Street at 2.10pm when returning from the shop. Earlier in the day, two people aged 30 and 40 years were also gunned down in a drive-by shooting in Eureka Estate around 12.30pm on the corner of 40th and 42nd Avenue. Residents are fearing for their lives and one parent is hoping that her kids will stay indoors during the school holidays as the gangsters run riot on the streets. The parent said: 'I am a bit relieved that the schools are closing, but we still have people who need to go to work early and come back safe. 'When they are not shooting, they are targeting the cars, smash-and-grab and throwing cars with stones.' Another added: 'They shoot at any time. I have to fetch my children from school and be vigilant always because they don't care if it is children or adults, they shoot. 'We stay in the house but we are still not safe because bullets travel and we need to go to the shop and they like standing on the corners.' Police say that additional boots on the ground have been deployed in the Ravensmead policing precinct. Police spokesman Warrant Officer Joseph Swartbooi reported: 'Ravensmead police responded to a complaint on Wednesday June 18 2025. Upon their arrival in Gladiola Street at about 2.10pm, they found the body of a man who sustained a gunshot wound. 'The victim was declared deceased on the scene by the medical personnel. Reports suggested that the victim returned from a local spaza shop when an unknown gunman opened fire, fatally wounding the 27-year-old man. 'The motive for this attack is believed to be gang-related. The unknown suspect fled the scene and is yet to be arrested.' Of the drive-by shooting, Sergeant Wesley Twigg said that SAPS detectives are investigating two counts of murder. He confirmed: 'Police members responded to a complaint of a shooting and upon arrival on the scene they found the victims with gunshot wounds to their bodies. Both victims were declared deceased on the scene...' According to reports a white Toyota Corolla drove up to the victims and opened fire. Cape Argus
