They keep getting busted, but it's the cops who are handcuffed.
The pint-sized migrant punks who ganged up on an autistic teenager on Staten Island this month continue to run amok in the Big Apple — because the state's lax laws are putting up barriers for the NYPD.
The cowardly baby-faced goons in 'Diablos de la 42,' an underage offshoot of the Venezuelan gang Tren de Aragua, have racked up dozens of felony busts over the past three years, but continue to roam the streets because they're too young to be locked up under the law.

'We're not talking petty larceny, and he's not stealing a stick of gum,' NYPD Chief of Detectives Joseph Kenny told The Post this week. 'We're talking robberies, we're talking felonies, we're talking stabbings. And there's really no recourse.
'You know, there's no consequences,' the chief said.
One teen terror has been so mischievous that he's been dubbed the poster boy for the gang, whose name translates to 'Devils of 42nd Street' for their reign of terror in Midtown Manhattan.
The troublesome 15-year-old has more than a dozen busts on his rap sheet — and it took the May 5 attack on the disabled teen at the Staten Island Mall to finally get him locked up on Wednesday.

Yet, he had been loose on the streets for months despite repeated busts for robbery and assault — the uncomfortable norm for dozens of other underage migrant marauders who know they're gonna walk, law enforcement sources said.
One cocky Diablo bunch nabbed for ganging up on cops in Times Square this month was so brazen that they flashed gang signs from inside an NYPD stationhouse on pics posted to social media.
And cops were investigating an armed robbery in Lower Manhattan shortly before 4 p.m. Thursday — with the 15- and 17-year-old suspects, believed to be part of the gang, snatching a sneaker at gunpoint from another teenager before running off.
The crew, which law enforcement sources said now consists of about 40 minors, are largely migrants from Venezuela who were part of a wave of asylum seekers who began flooding the five boroughs in 2022, sources said.
Cops have busted Diablos as young as 11 for a rash of assaults and robberies in Manhattan, Brooklyn, Queens and Staten Island, the sources said — with the crimes typically involving groups of young migrants who gang up on vulnerable victims like the 16-year-old autistic boy at the mall.

'It makes me sick these kids are still here,' the victim's mother said Wednesday. 'They should have been deported a long time ago. I had to keep my son home for a week because he was so scared.'
The Diablos identify with their 'older brothers' in TdA, a violent gang that established a criminal foothold in the city by recruiting new members from inside tax-funded migrant shelters.
Crews from both gangs have specialized in violent robberies, including grab-and-run scooter and moped robberies and armed robberies of retailers in the city.
According to police stats, TdA and Diablos together have accounted for more than 400 arrests since the start of 2022 through the end of April this year — including nearly 120 busts for robbery, 82 for grand larceny and more than 50 for petty larceny.

Most of the crimes involved some form of assault, the data shows.
'You know, this goes for their older brothers, TdA as well,' Kenny said. 'Don't think that it's just a juvenile problem.'
Albany's Raise the Age initiative was part of the sweeping criminal justice reforms that critics contend has led to a spike in crime in the Empire State.
The statute, which was implemented in two stages in 2017 and 2018, raised the age of criminal responsibility in the state to 18, and allowed for criminal defendants to remain in juvenile facilities as old as the age of 21.
Before, suspects as young as 16 could be automatically tried in adult criminal court.
On the heels of Raise the Age, state lawmakers also adopted measures that prohibited judges from setting bail on nearly all criminal cases, save for the most violent felonies.

Despite several tweaks spearheaded by Gov. Kathy Hochul, most crimes remain ineligible for bail.
For New York's Finest, that means many of the migrant gangbangers they pick up are released without bail because their crimes don't qualify for bail under the statutes.
For underage migrants, the ride is even sweeter.
The teens are typically released to their parents with a future family court date — where the most they can get is a reprimand and a slap on the wrist.

"When you look at the rising rape numbers, it's because of the sweeping changes that went into effect to the rape laws," NYPD Special Victims Unit Director Kathleen Baer said. In 2024, the "Rape is Rape" bill was signed into law by Gov. Kathy Hochul, expanding the definition of rape to include all forms of non-consensual sexual contact. But CBS News New York learned even without the changes, there's still a 1-3% increase of reported rapes in the city. "One is absolutely too many ... We don't control the survivors, when they're ready to come forward to report," Baer said Baer said another reason for the increased reports is NYPD outreach. "We're out in the communities we serve. We're doing outreach. We're in schools. We're in hospitals. We're in community centers," she said. CBS News New York Baer says detectives have been taking reports at the city's five Family Justice Centers, too, where survivors go seeking legal and social services. "Those advocates can also accompany the survivor at each part of the investigation," she said. Survivors are also connected to counselors and advocates from Safe Horizon, a victim service organization that has been providing support to survivors for 40 years. "Sometimes police precincts might be a little intimidating ... They can share with us freely," said Victoria Maiello, with Safe Horizon's crime victim assistance program. "When someone's sex assaulted, their power is essentially taken away from them." Former New Yorker speaks out after attempted rape In the Bronx back in 2018, a walk home from work to decompress dissolved into a nightmare for Pritvi Sammy when a predator sprang from the shadows. "His masculine hand was over my mouth and my nose at the same time, and then he took the other hand that was free and he had the blade on my neck," Sammy said. "My heart was beating out of my chest. My mind was racing. My legs kind of turned like a jelly." Sammy said she was so terrified she couldn't even scream. "He's about to drop his pants, and I'm shaking at this point," she said. "I said, 'Please, let me say my last prayer.' And at this point, I dropped to my knees." Sammy said by some miracle, her attacker ran and she escaped being raped. She reported it right away, and police say surveillance video helped lead them to her attacker within 48 hours. "After that attack, I could never see the Bronx the same way again," Sammy said. She moved out of New York City but is bravely sharing her story to encourage others to come forward if they were ever sexually violated. "I'm at a place where I've come to peace with that, and I want to use my voice now to help others," she said. Sadly, advocates say there are still many victims too afraid to come forward. A callous pair of home invaders choked and punched a 70-year-old woman and 65-year-old man during a heist inside a Flushing home that netted them several hundred dollars this week, cops said. The duo broke the front door of the apartment at Sanford Avenue and College Point Boulevard in Flushing around 3 a.m. Wednesday, police said. Zohran Mamdani Responds to Car Bomb Death Threats: ‘Not Surprising'
New York Assemblyman Zohran Mamdani, who is running in the Democratic primary for mayor in New York City, issued a statement after his office said it received multiple threats about blowing up his car. Newsweek reached out to Mamdani's campaign and the New York City Police Department outside of business hours for comment. Mamdani has emerged as a leading candidate among the city's most progressive voters in the mayoral primary election due to policy proposals, including rent freezes and city-owned grocery stores to combat rising grocery costs. He has been endorsed by New York Representative Alexandria Ocasio-Cortez and Vermont Senator Bernie Sanders. Most polls show that one of his rivals,Andrew Cuomo, a centrist candidate who resigned in 2021 as New York's governor amid allegations of sexual harassment that he has denied, has a lead over Mamdani. Whichever candidate wins will likely become the favorite in the November general election, given that New York City is a Democratic stronghold. Mamdani's campaign recently hired security to deal with the increasing threats made against him. He told reporters this week that he receives anti-Muslim messages and death threats. Mamdani's office received four voicemails from an unknown individual who said they would blow up his car, a spokesperson for his campaign told various news outlets. "After multiple death threats and racist messages, Assemblymember Mamdani's office is participating in an ongoing investigation by the NYPD's Hate Crimes Task Force," the statement said. "While Zohran does not own a car, the violent and specific language of what appears to be a repeat caller is alarming and we are taking every precaution. While this is a sad reality, it is not surprising after millions of dollars have been spent on dehumanizing, Islamophobic rhetoric designed to stoke division and hate. Violence and racism should have no place in our politics. Zohran remains focused on delivering a safe and affordable New York." The NYPD said it was investigating the report and added that the calls, which included "threatening anti-Muslim statements," were made on various dates and reported on Wednesday. Zohran Mamdani told reporters earlier this week: "I get messages that say things like the only good Muslim is a dead Muslim. I get threats on my life and on the people that I love and I try not to talk about it." Former New York Governor Andrew Cuomo, who is also running in the primary, said in a statement thatit was "an atrocious threat of political violence" that "has no place in our politics or our society." The investigation into the threats is ongoing and is being conducted by the Hate Crime Task Force division of the NYPD. The primary election is next Tuesday, June 24, and early voting has opened. The general election for mayor is November 4, 2025.
