SC agrees to hear next week plea for removal of derogatory social media posts against judiciary

The Supreme Court on Tuesday agreed to list next week a plea seeking removal of derogatory social media posts directed towards the judiciary after BJP Lok Sabha member Nishikant Dubey made deplorable remarks regarding the top court and the Chief Justice of India (CJI).
The petitioner's counsel mentioned the matter before a Bench headed by Justice B.R. Gavai for an urgent hearing.
The lawyer said that after the legislator made comments targeting the top court, social media platforms were flooded with derogatory and contemptuous posts against the judiciary.
He said, 'Letters were sent to the Attorney General and Solicitor General for giving consent to initiate criminal contempt proceedings against the MP (Nishikant Dubey). No action is being taken by the government. Please give direction to social media platforms to remove videos, etc.'
After hearing the submission, the Justice Gavai-led Bench agreed to list the plea for hearing next week.
A day before, the Justice Gavai-led Bench told a lawyer that consent of the Attorney General (AG) of India, the highest law officer of the Centre, would be needed to initiate contempt proceedings against BJP MP Nishikant Dubey.
"Make a case before the AG. He will give permission. You file it (criminal contempt plea). For filing, you don't require our permission," it remarked.
Under Section 15 (1) (b) of the Contempt of Courts Act, 1971, the Supreme Court may initiate criminal contempt on a motion made by a private complainant only after obtaining the written consent of the Attorney General or the Solicitor General.
Amid ongoing hearings on the constitutionality of the Waqf (Amendment) Act, 2025, Dubey questioned the judiciary's role in legislative matters, suggesting that if courts assume the task of lawmaking, the existence of Parliament becomes redundant.
Dubey's comments targeting the Supreme Court have drawn significant attention, particularly, the word 'anarchy'' which he has used and "inciting religious wars".
The controversy has sparked political debate, with Opposition parties like the Congress accusing the BJP of attempting to undermine the judiciary.
During the hearings, the Central government assured the Supreme Court that it would not de-notify provisions related to 'Waqf-by-user' or include non-Muslim members in the Waqf Board.
This assurance followed the top court's indication that it might consider staying certain parts of the law.
Meanwhile, the BJP has disassociated itself from the remarks made by two of its Members of Parliament (MPs) -- Nishikant Dubey and Dinesh Sharma – clarifying that these statements were 'personal opinions' and do not reflect the party's stance.
In a post on X, BJP chief J.P. Nadda distanced the party from the comments by the MPs.
"The BJP has nothing to do with the statements made by BJP MPs Nishikant Dubey and Dinesh Sharma on the judiciary and the Chief Justice of the country. These are their personal statements, but the BJP neither agrees with such statements nor does it ever support such statements. The BJP completely rejects these statements," J.P. Nadda said.
The party reiterated its commitment to accepting judicial orders and suggestions and has instructed its members to refrain from making such statements in the future.

Despite chanting 'Garibi Hatao', the Congress party failed to eradicate poverty, or uplift the poor, Mr. Singh alleged. 'From Nehru to Rajiv Gandhi, no Congress leader truly worked for the poor,' he said. Lauding Mr. Modi's leadership for launching numerous welfare schemes and significantly expanding healthcare infrastructure, he said, 'In the last 11 years, the number of medical colleges has grown substantially, benefitting the underprivileged.' The 'AmritKaal' that Mr. Modi had ushered in saw women empowerment and SC representation in governance, he claimed. 'It is under Mr. Modi's rule that Dalits have been given power. They have been made Governors, Deputy Chief Ministers, and Union Cabinet Ministers,' Mr. Singh said. He also recalled Mr. Modi's tribute to Dr. Ambedkar through development of the 'Panch Teerth' — the five sites marking the birth, education, and contributions of the late leader. Purandeswari said the party planned to organise 'Dalit Sammelans' across Dalit colonies to create awareness about the party's welfare initiatives and counter misinformation. 'The BJP is the only party that has truly honored Dr. Ambedkar,' she said, recalling Mr. Modi's visit to Dr. Ambedkar's London residence and the government's development of Panch Teerth. Condemning the Congress party for using Dr. Ambedkar's name for political gains, she questioned, 'Can the Congress explain what it has truly done for Ambedkar?' 'Malicious propaganda' Mr. Modi's vision of Viksit Bharat by 2047 envisaged inclusive development, benefiting farmers, women, and youth, she said. Rejecting the claims of opposition parties that the BJP was anti-Dalit, she pointed to the expansion of welfare programmes, representation in top offices, and SC-focused policies. 'Despite malicious propaganda, people trust Mr. Modi's leadership,' she asserted. Ms. Purandeswari also expressed delight that Andhra Pradesh secured two Guinness records on International Day of Yoga, and described it as a proud moment for the State. RAIPUR: Former Chhattisgarh Deputy Chief Minister and senior Congress leader T S Singh Deo on Sunday has sparked a political firestorm, questioning Union Home Minister Amit Shah on a recent US travel advisory, which warns American citizens, particularly women, against traveling alone in India, with a specific caution against visiting Naxal-affected regions like Chhattisgarh. Taking to X, T S Singh Deo cited the advisory and asked, 'The US govt has clearly stated that women should not travel alone in India, especially in Chhattisgarh. Why? Because rape, violence, and terrorism are out of control.' The Bharatiya Janata Party (BJP) on Sunday flagged a resort close to Taraka Dam in H.D. Kote and alleged that it was an illegal property run by the private secretary of Minister for Housing Zameer Ahmed Khan. The BJP State spokesperson M.G. Mahesh, in a release, said that as per the Records of Rights, Tenancy, and Crops (RTC), the ownership of the property was in the name of Sardar Sarfaraz Khan, private secretary to the Minister. Mr. Mahesh alleged that the resort was operating illegally and accused the owner of misusing his political position in operating a commercial property on an agricultural land 'without legal approval'. The property is in the eco-sensitive zone (ESZ) and the buffer zone of the Nagarahole Tiger Reserve and within the elephant conservation area, said Mr. Mahesh. He alleged that the resort constructed in the floodplain of the river in contravention of the Environmental Protection Act, Wildlife Protection Act, and agricultural land conversion regulations. The BJP called for a site inspection of the property and urged Forest Minister Eshwar Khandre and the Forest Department officials to initiate legal action against the property owner for violation of the law. The action of Mr. Sarfaraz Khan went against public interest as it threatens to damage the environment, forest biodiversity, and elephant corridors, said the BJP, calling for a thorough inquiry into the legality of the resort.
